Pursuant to a Judgment and Order of Sale entered by the Whitley Circuit Court on April 13, 2009, I shall offer for sale at the Courthouse door in Williamsburg, Kentucky, at public auction on Monday, June 1, 2009, at 12:00 p.m., or thereabout, the real property described in this Notice.
The judgment against the defendant, Jason Wilson, plus costs, are as follows:
(1) The sum of $68,230.21 as of March 23, 2009, with interest continuing to accrue thereon at a variable rate not less than 6.25% per annum and not to exceed 10.25% per annum, or a daily rate of $11.12 as of March 23, 2009, until paid in full; plus the sum of $20,642.88 as of March 23, 2009, with interest continuing to accrue thereon at a variable rate not less than 6.5% per annum and not to exceed 10.50% per annum, or a daily rate of $3.99 as of March 23, 2009, until paid in full; plus attorney fees.

The proposed operation will disturb 173.9 surface acres and will underlie 1,841.0 acres and the total area within the permit boundary will be 2,014.9 acres.
The proposed operation is approximately 8.5 miles southeast from KY Hwy. 92’s junction with KY 904 and located at the head of Bennetts Branch.
The proposed operation is located on the Saxton and Frakes, KY 7½ minute quadrangle maps. The surface area to be disturbed is owned by Begley Properties, LLC. The operation will underlie land owned by Begley Properties, LLC.

Amendment No. 2
In accordance with KRS 350.070 notice is hereby given that Alden Resources LLC 332 West Cumberland Gap Parkway, Suite 100, Corbin, Kentucky 40701 has applied for an amendment to an existing surface coal mining and reclamation operation located 3.2 miles southeast of Nevisdale in Whitley County. The amendment will add 30.02 acres of surface disturbance making a total area of 390.85 acres within the amended permit area.
The proposed amendment area is approximately 2.7 miles southeast from Keswick-Gatliff Road’s junction with KY 904 and located near the head of Cane Creek.
The proposed amendment is located on the Frakes and Saxton, KY 7½ minute quadrangle map. The operation will use the contour and auger method of surface mining. The surface area to be disturbed by the amendment is owned by the Gibbs & St. Clair Heirs. The operation will use the contour, area and auger methods of mining.
The amendment application has been filed for public inspection at the Department for Mining Reclamation and Enforcements, Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965-1229. INSPECTION PERIOD
FOR THE PROPERTY TAX ASSESSMENT ROLL
The Whitley County real property tax roll will be opened for inspection from May 11 through May 26, 2009. The courthouse will be closed in observance of Memorial Day on May 25, 2009. Under the supervision of the property valuation administrator or one of the deputies, any person may inspect the tax roll.
This is the January 1, 2009 assessment on which state, county, and school taxes for 2009 will be due about September 15, 2009.
The tax roll is in the office of the property valuation administrator in the county courthouse and may be inspected between the hours 8:00 am and 4:30 pm.
Any taxpayer desiring to appeal an assessment on real property made by the PVA must first request a conference with the PVA or a designated deputy. The conference may be held prior to or during the inspection period.
Any taxpayer still aggrieved by an assessment on real property, after the conference with the PVA or designated deputy, may appeal to the county board of assessment appeals.
The taxpayer can appeal his assessment by filing in person or sending a letter or other written petition stating the reasons for appeal, identifying the property and stating the taxpayer’s opinion of the fair cash value of the property.
The appeal must be filed with the county clerk’s office no later than one work day following the conclusion of the inspection period.
A taxpayer failing to appeal to the county board of assessment appeals, or failing to appear before the board, either in person or by designated representative, will not be eligible to appeal directly to the Kentucky Board of Tax Appeals.
Appeals of personal property assessments shall not be made to the county board of assessment appeals. Personal property taxpayers shall be served notice under the provisions of KRS 132.450(4) and shall have the protest and appeal rights granted under the provisions of KRS 131.110.
