EXTRA CONTENT: Kentucky AG says ‘ballot selfies’ are OK
The Kentucky Attorney General issued an opinion Monday that paved the way for voters across the Commonwealth to takes photos of themselves in the ballot box, but urged caution for those who choose to do so.
The opinion said the practice of taking “ballot selfies” does not violate a Kentucky law that prohibits the recording and photographing of other voters while in the voting room. The law also does not allow voters to express support or non support for a candidate or ballot measure while in the voting area. There is an exemption in that law that allows news media to conduct limited recording and documentation of the voting process.
An outright ban on the practice, according to the opinion, would likely violate constitutional protections offered by the First Amendment.
Kentucky Secretary of State Alison Lundergan Grimes had asked for an opinion on the issue from the Attorney General due to recent news media coverage.
Though legal, voters who do decide to take “ballot selfies” are encouraged to be cautious and not inadvertently reveal the identity of other voters in the voting room on Election Day.
Polls will be open from 6:00 a.m. until 6:00 p.m. Tuesday.
