Corbin man charged with punching, injecting estranged wife
It remains unknown whether the case against a Corbin man who allegedly broke into his estranged wife’s home and injected her with an unknown substance will be presented to a Whitley County grand jury, but a judge did agree to amend his bond Tuesday.
Thirty-three-year-old Bobby Joe Bailey was arrested last Wednesday afternoon on charges of violation of a Kentucky EPO/DVO, second-degree assault, second-degree unlawful imprisonment, third-degree terroristic threatening, second-degree burglary, second-degree criminal mischief, first-degree possession of a controlled substance and possession of drug paraphernalia.
Bailey had pleaded not guilty to the charges and returned to Whitley District Court Tuesday for a preliminary hearing.
Judge Fred White agreed to continue the case for one week as neither the complaining witness, nor the arresting officer, Corbin Police Colonel David Maiden, were in court. However, at the request of Bailey’s attorney, White agreed to amend Bailey’s $15,000 cash bond to $10,000 third-party surety bond.
That means another individual must sign paperwork with the court stating the person agrees to ensure Bailey will appear in court as required.
At the prosecutor’s request, White ordered that Bailey have no contact with his wife, adding that means by mail, e-mail or through another person.
Bailey is scheduled to return to court at 1 p.m. Tuesday for a preliminary hearing.
Bailey was arrested early last Wednesday morning at a residence on Madison Street off of West 16th Street.
Maiden wrote in the arrest citation that he was called just after midnight in response to a domestic violence complaint.
The caller told police that the alleged victim was en route to the hospital.
“She said that he wouldn’t let her leave, but that he finally fell asleep and when he did, she took her child and fled,” Maiden said.
Maiden went to the residence where he reported finding a man, later identified as Bailey, asleep on the couch.
According to the citation, the victim told Maiden that Bailey, whom she described as her estranged husband, came to the residence and when she refused to let him in, he kicked in the door.
Bailey then allegedly punched the victim in the head multiple times with a closed fist and used a syringe to inject her with an orange substance.
“The victim said Bailey made the comment that if she called police, they would take her to jail as well because she was high,” Maiden said adding police found a used needle in Bailey’s pocket and a white powdery substance suspected to be Suboxone.
Bailey was taken into custody without incident and lodged in the Whitley County Detention Center.
Maiden said the victim told police that Bailey had told her she needed to decide who her son was going to be left with as he intended to kill her and then kill himself.
