Vandemark accused of trying to assault his brother with a vehicle

A Corbin man pleaded not guilty to assaulting his brother with a vehicle.

While he did not actually strike his brother, 23-year-old Cody L. Vandemark is facing charges of first-degree assault and second-degree disorderly conduct in connection with the incident that occurred Saturday afternoon off of Wells Drive.

“If you got hit by a vehicle, you could have serious injuries or be killed,” said Laurel County Sheriff’s Deputy Gilbert Acciardo explaining that the intent constitutes assault under Kentucky law.

“Under circumstances manifesting extreme indifference to the value of human

life he wantonly engages in conduct which creates a grave risk of death to

another and thereby causes serious physical injury to another person,” the law states.

Deputies were called to the scene off of East Ky. 1223 about 1:40 p.m. in response to a fight complaint.

Acciardo stated that an investigation by Deputies Josh Scott and Brandon Broughton indicated that Vandemark and his brother had been in a fight when Vandemark jumped into a vehicle and attempted to strike his brother.

Vandemark was taken into custody and lodged in the Laurel County Correctional Facility.

Vandemark is scheduled to return to Laurel District Court Tuesday for a preliminary hearing to determine whether there is probable cause to present the case to a grand jury.

Vandemark has been released from jail on a $2,500 surety bond.
