UPDATED: Wilson charged with murder, wanton endangerment following fatal shooting at Root Beer Stand

Authorities now say a Williamsburg tow truck operator has formally been charged with murder and first-degree wanton endangerment in the wake of a shooting late Friday that ended in the death of a Woodbine resident.
Larry Wilson, 55, owner of Wilson’s Towing in Williamsburg, has said little to police about why he shot and killed 38-year-old Todd Carter in the parking lot of the Root Beer Stand in Corbin. He will likely be arraigned in Whitley District Court on Monday on the charges.
"He hasn’t told us anything," said Corbin Police Sgt. Bill Rose, the lead investigator in the case. "All he did was request a lawyer. That’s it."
The shooting happened at about 10:00 p.m. Friday. Police were on the scene within minutes after a 911 call was made reporting the incident. They were able to detain Wilson, who was still sitting in his tow truck when they arrived. He was taken into custody without a struggle and the gun used in the shooting, a 9mm pistol, was recovered from his truck.
Police say Wilson fired a single shot at Carter through the open window of his tow truck, striking him the armpit area. Initially, authorities said Carter assaulted Wilson immediately prior to the shooting, but are now investigating that part of the case with a little more scrutiny. Wilson had bleeding wound below his left eye visible when he was taken to the police department for questioning. Rose said Wilson did not struggle with police and was in no way injured by officers during his arrest.
The bullet Wilson fired passed through Carter and hit a vehicle parked next to Wilson’s tow truck in the rear passenger side. Wilson faces an additional charge of wanton endangerment, police say, because a small child was seated in the vehicle near where the bullet hit. Authorities have yet to find the bullet, but plan to comb the area again Saturday night with thermal imaging cameras in an attempt to locate it.
"Hopefully after the sun heats things up a bit today, the heat signature of the bullet will show up on the camera," Rose said.
Police used a metal detector and the cameras to look for the bullet Friday but were unsuccessful.
Rose said Wilson had a permit to carry a concealed deadly weapon and added the gun used in the shooting did not appear to be stolen or illegally obtained.
For customers of the Root Beer Stand, the incident was traumatic.
"I was ordering my food and I heard a gunshot," said Patty Shelton, a customer at the Root Beer Stand at the time of the shooting. "At first I thought it was some kids playing with firecrackers or something, then I seen him [Carter] coming back and he fell on the car. Then people just told me to run."
Shelton said she panicked, got out of her car and sought safety in the restroom.
According to Root Beer Stand owner Willie Champlin, Carter approached Wilson’s tow truck from the opposite side of the drive-in restaurant. Soon after, chaos erupted.
"I’ve got four girls working out there and they all came in screaming ‘Call 911! Call 911! They were panicked," Champlin said. "They were shouting so loud I couldn’t find out why they wanted me to call 911. Then finally somebody told me Todd had got shot."
Champlin said Carter, whose wife is an employee at the Root Beer Stand, was still conscious when police and EMS personnel arrived. Some customers tried to stop the bleeding with napkins and towels until he could be transported to the hospital.
"In 40 years we’ve never had anything like this," Champlin said. "We’ve had a fist fight or two out in the parking lot before, but that’s about it … nothing this serious."
As for Wilson, witnesses say he never made any attempt to elude authorities.
"He never ran. He never even got out of his truck as far as I know," Champlin said. "The police came and got him. They put him on the ground and put him in the car and that was it."
A large pool of blood was clearly visible near where Carter collapsed to the ground. A small pool of blood could be seen near the driver’s side door of Wilson’s tow truck.
Rose said he interviewed about five people regarding the case Friday and plans to talk to many more in the coming days. He said he still does not yet know what kind of disagreement between the two men may have led to the shooting.
"I just don’t know a whole lot right now," Rose said. "Obviously, Carter had some kind of problem with the tow truck driver and he confronted him but that is about all I know."
Police strung crime scene tape around much of the perimeter of the Root Beer Stand shortly after the shooting. The restaurant was closed for the remainder of the evening. Police and Corbin Fire Department personnel were searching for shell casings and other forensic evidence after the shooting.
Authorities confirmed early Saturday morning that Carter passed away at Baptist Regional Medical Center. Whitley County Cororner Andy Croley has ordered an autopsy be performed.

How easy it is to get bits and pieces of information and then say this person should have done something different or that person should have reacted differently. Lots of talk here about facts, too. Well, the FACTS are that none of us were actually there! Mistakes were made on both sides. But these are HUMAN BEINGS! Humans make mistakes. I know Larry and he is a very good man. I hate that anyone would loose there life for any reason except for the will of GOD. But I have to say that in this world every one has to defend there self one way or another. If this man didn’t want to take the chance of loosing his life he should have just stayed in his car and let Larry stay in his truck. Everyone wants to say bad things about Larry but he is not the one who got out to start trouble. As for this other man if his wife was cheating on him with Larry it wasn’t his fault that Mr. Carter couldn’t keep his wife happy but that gives him no reason to start trouble with Larry. Clearly, Mr. Wilson, could have rolled up his window, locked his doors & called 911 if someone was coming to attack him.
But, I have seen Mr. Wilson on the news before, I am not sure sure for what, but, I have seen his mug shot before, was it over another shooting as well?

My understanding is that Mr. Wilson had been harassing Mr. Carters wife who worked at the Root Shack as a server, and she had most likely told her husband, who was going to tell him (Wilson) to stop this, and that this was the second time he (Carter) had, had to say something to Wilson, if this is fact, it looks to me that Wilson clearly carried his weapon to do this, Wilson knew Carter came to get his wife when the root beer stand closed, so why did Wilson come at this time of night. So as I see it is a case of Premeditated Murder. period/end of discussion.

As far as the incident is concerned; there will never be a happy ending or peaceful resolution for either family. For one family, they have lost a loved one and for another family, they are going to be put through the mill for their loved one who will be fighting a murder charge for trying to protect himself. I have known Larry Wilson for many years and think very highly of him. He is a good man who unfortuneately was in the wrong place at the wrong time and was left no choice but to defend himself against Carter. Anyone that knows Larry Wilson knows that he is a good friend and has often gone out of his way to help them. I know that if Larry had seen him coming to the side of the vehicle, Larry would have held his own against him in a normal brawl. However, all he could have known at the time of this incident is that he is being beat in the head with a hard object by someone who jumped up at the window of his truck. Who wouldn’t try to defend themselves if they were in the very same situation? For all any of us knows, Larry was confined by his seatbelt and couldn’t move. Do you sit there and take it, knowing that the person could kill you or do you protect yourself by trying to stop the person by any means necessary???? Most of us can honestly answer that we would protect ourselves by any means necessary. As for the comments about Carter being unarmed; I would consider a glass mug a weapon if I was the one being beaten with it. The fact that Carter was shot in shoulder area, should be reason enough to know that Larry did not intend to kill him; his only intent was to get him off of him to keep from being beat to death himself. Another thing to consider, who leaves their little girl in the car while they go attack someone who is sitting in their truck minding their own business. I can assure you that if Larry had seen this man, he would have been out of his truck defending himself and hopefully none of this would have happened. He would not have just sat there and been blindsided. These are all things that people should consider before they so quickly pass judgement on Larry Wilson. As for all situations like this, there will always be two sides of the story. To me, it is clearly self-defense.

two men BOTH fighting over the same woman = something bad will always happen. if someone hit me with a mug i would get out and whoop butt not pull out a gun and shoot. before you know it kids in high school will pull guns someone might get hit during a fight with a big book never know. the wife should not have had 2 men . its a all around bad situation. in the end the court will decide. hopefully
I have known the Carter family my entire life no matter what they might have charged with or how they lived their lives they were kind hearted people and I truely feely very sorry for Todd’s family and especially his daughter. Self defense my ass all Mr. Wilson had to do was start his truck and leave if conforntation was getting that bad. Hell he should have seen Todd coming to his vechile and at that point is when I would have rolled up my window and left the restaurant parking lot. To me Wilson was looking for a fight and a reason to harm Carter. Whether or not Carter’s wife was cheating on him with Wilson and caused several problems between the two men it is not all her fault Wilson should have had common sense and Carter should have stayed in his vechile but either way Wilson had no right what so ever to fire his gun at Carter and kill a innocent man that was dragged in the middle of this love triangle just has wilson was. I have known Todd and his family for years everyone seems to think that Todd was beating him and Wilson was defending him self. Tell me how Wilson had only one place on his cheek if he was being assaulted for his life. I am sure Todd was not as tall as the tow truck he would have had to be reaching through the window of the truck so there was know way he could get in the truck and beat him. What gives Wilson the right to shoot at him in a public place where other innocent people are. He was there to get food for his daughter not looking for a fight. It doesn’t matter what Todd had done in his past it has nothing to do with this everyone has something they don’t want to be remembered for.

Going back & forth between the 2 of these men, and you wonder why the guys hated each other? Shame on the woman for creating this situation in the first place! Looks to me like the Tow Truck Drive was busted open on the left side of his face. How can you say there was no altercation?
You also say he was sitting in his tow truck and should have seen him coming, but I know when I eat at a drive-in type place, I am eating and not staring straight forward to see if someone is coming at me with a rootbeer mug.
The wife doesn’t have any guilt in the situation. The husband should have never taken her back after she cheated on him numerous times. She didn’t throw any punches or pull any triggers. She is just a horrible person ethically.
It appears very obvious that the tow truck drive acted in self-defense. I’m sure he didn’t aim for the shoulder or the heart or anything. I am sure he grabbed his gun and fired to try to get a maniac off of him.

to the person that said, this is why we need more gun control, the “gun” was only an instament in the incident. The “gun” did not committ an impropper act, it is the user of it and how one is used that is a problem, if there were no guns people would still defend or kill them self with something else: ie a knife, club. weather it is self defence or not the “gun” is not to be judged by the courts nor society. And it looks like “the shooter had full control of the gun”
It amazes me how when something like this happens, everyone talks about how good of a person each one of them was. If they were both such good people, we wouldn’t have the crime scene, now would we? Todd was shot in the Heart…NOT the upper Shoulder! Mr. Wilson was sitting in a TOW TRUCK parked across from Todd. How could Mr. WIlson NOT have seen Todd coming. DO not give me this crap about how he was blindsided with Todd beating the crap out of him. We all know that Tow trucks sit a good 5 ft higher than a normal vehicle maybe a lil less, maybe a lil more. He would have seen him coming. Gees. I have no side in this…but i did hear from several witnesses who worked at the Rootbeer stand. They said there was no fight. That Todd was walking toward Mr. Wilson’s vehicle and Mr. Wilson shot him. Some said they heard 1 pop…others said they heard 3. We may never know the truth.

sounds like self defince to me or as the leagal term justifiable homaside but as I know from experiance the judge in whitly county does not belive in Ky law . once the man climbed in mr,Willsons truck and asoulted him he was commiting a feliony. it seems to me that one Mr. Willson was just defending himself and that by shooting the man in the shoulder not the chest he was just trying to get the man off hin. think god we live in a free country where and old or disabled man can carry a gun to protect themselves from young healthy people that just want to run over them and terorize them

I happen to know Larry Wilson. I have read all these entries & feel led to say something. What you have here is a man sitting in his truck eating his meal (not bothering anyone) & some nut takes a root beer glass & comes through the open window & hits Wilsaon in the face, All of this nonsense that one man can’t ever take another man life is bogus! What do you think precious Carter was trying to do to Wilson – give him a love tap? If someone done this to me & knocket me in the head like that I’d be searching for my gun too! It is very sad for someone to lose theit life, but in America you have the right to defend yourself & clearly Mr. Wison did just that! I happen to know Larry Wilson. I have read all these entries & feel led to say something. What you have here is a man sitting in his truck eating his meal (not bothering anyone) & some nut takes a root beer glass & comes through the open window & hits Wilsaon in the face, All of this nonsense that one man can’ ever take another man life is bogus! What to you thing precious Carter was trying to do to Wilson – give him a love tap? If someone done this to me & knocket me in the head like that I’d be searching for my gun too! It is very sad for someone to lose theit life, but in America you have the right to defend yourself & clearly Mr. Wison did just that! It doesn’t matter what happened in the past between these tow guys (neither deserved to die). My heart goes out to the Carter Family, He shouldn’t have died, however with the circumstanses that happened, should Wilson set there & allow someone to kill him? So much good is being said about Todd. What about Larry? He is a good man and would do anything for anyone. This is just a very unfortunate situation. No one knows the details and the incidents leading up to this situation so no one has the right to judge. Pray for both families and especially the little girl, she will need Gods guidance the rest of her life.

when did it become ok to shoot an unarmed man in front of his child even if there was some kind of altercation why shoot someone why not just leave or get out and fight one on one. tod was unarmed, no weapon, only fist to fight…last time i checked it was not ok to shoot an unarmed person.. lots of love to the whole carter family…
The shooting is a sad thing to have happened. We need to keep the families in our prayers. The way it sounds to me, is that Carter attacked Wilson in his tow truck. Maybe Wilson couldn’t drive off with Carter beating on him(referring to the picture above), looks like to me Wilson got hit pretty hard. What would you do if someone came out of nowhere & attacked you. That is a question, we all need to ask ourslves . Me, I would defend myself the best way I could. There are two sides to every story.
All i can say is I know everyone that works at the root beer, I have family that still works there, one is a curb girl. This is outrageous and completely uncalled for. This man took the lives of many people in his hand when he fired that gun. I have also heard from people that were there that Carter’s daughter was there, how sad! I know this little girl, her bubbly full of life spirit was broken with that shot.This man may have taken Carter’s life, but he has also taken hers. I pray she can find peace!

I have known the carter family for many years, and have never known of these boys causing trouble, Todd was a good guy with a family who needed and loved him, way too young to loose his life, a daughter who will always grieve her dad and a wife who will never forget. along with many others who will morn him,never mind gun control what about self control. I was at the hospital when the ambulance came, I was there when several witnesses were outside, I even talked to most of them. They said there was NO altercation between Carter and Wilson. So can someone PLEASE clarify!?
