A former University of the Cumberlands wrestler was released from jail Tuesday afternoon after allegedly tying up his girlfriend and ripping part of her cloths off in a school parking lot during the early morning hours of Sept. 2.
Carlton Thompson, 22, of Williamsburg, was being held in the Whitley County Detention Center in lieu of a $25,000 cash bond following his Sept. 7 arrest on charges of unlawful imprisonment, first-degree sexual abuse and violation of a domestic violence or emergency protective order.
As part of an agreement with prosecutors Monday afternoon, in exchange for waiving his right to a preliminary hearing District Judge Cathy Prewitt agreed to let Thompson free on a $50,000 surety bond Tuesday provided he have no contact with the victim.
He was released to the custody of his mother, Pamela Wade, on the condition she take him back to Georgia, following a hearing Tuesday afternoon concerning the alleged violation of the EPO/DVO.
Whitley County Attorney Paul Winchester told Prewitt that the agreement was made with the consent of the victim.
Incident takes place
Williamsburg Police Chief Wayne Bird said that Thompson and the alleged victim, who was also a student at the school, had been dating for more than one year when the incident took place about 3 a.m. on Sept. 2.
She told police that Thompson had restrained her and held her against her will inside her vehicle for about three to four hours before he released her, Bird said.
"The victim alleges that after a verbal argument with her boyfriend, she was forced into her vehicle that was located in a parking lot at the University of the Cumberlands," Bird wrote in a press release.
"While inside the vehicle, the boyfriend allegedly ordered the victim to remove her clothes. According to the victim, he then ripped her clothes off and restrained her with a TV cable threatening to kill her."
The victim told police that she was held for hours until she talked her boyfriend into releasing her, Bird said.
On Sept. 3, the victim petitioned the court for an emergency protective order that was granted. Williamsburg police served Thompson with the emergency protective order on Sept. 5, according to the press release.
The next day, the victim petitioned the court for an arrest order alleging that Thompson had violated the EPO by sending her text messages, calling her on her home and cell phones, and had sent a friend request to her on Facebook, according to court documents.
On Sept. 7, Williamsburg Police Detective Bobby Freeman arrested Thompson without incident, and lodged him in the Whitley County Detention Center on the emergency protective order violation charge.
While Thompson was in custody, Williamsburg police asked Commonwealth’s Attorney Allen Trimble to review the case.
Afterwards Circuit Judge Dan Ballou signed an arrest warrant charging Thompson with unlawful imprisonment and first-degree sexual abuse.
Bird is continuing the investigation. The case will be presented to the Whitley County Grand Jury when it meets again next month.
Thompson pleaded not guilty to the charges during his arraignment Thursday in Whitley District Court.
Victim testifies
Following a brief hearing Tuesday afternoon, Prewitt agreed to dismiss the protective order violation charge against Thompson, but she granted a domestic violence order, which will be in effect for three years.
The victim was the only person, who testified during the hearing, and Thompson’s attorney, B.J. Foley, questioned her.
The two had dated for about 16 months when the incident occurred.
Thompson had borrowed her computer earlier in the day, and found things on there, which led him to believe she might be cheating on him, the victim testified.
She testified Thompson shoved her in the car, made her take off her clothes, but didn’t have sexual contact with her other than ripping off her underwear.
She didn’t yell for help during the incident, and he tied her hands up with an XBOX cord and her bra, she testified.
After about three hours Thompson released her, and the two went to the Qwik Shop together to get a soda. Then they went back to her dorm where campus security was present.
The victim testified she didn’t yell for help or report the incident to campus security right away because Thompson was, "calmed down then."
The two text messaged each other later that day, and she obtained an EPO the following day.
Thompson no longer a student
According to the University of the Cumberlands’ website, Thompson was a junior on the 2010-2011 wrestling team.
University of the Cumberlands Vice-President for Student Services Dr. Michael Colegrove said Friday morning that Thompson was no longer enrolled as a student at the university.
He said efforts are being made to see what could be done to keep something like this from happening again on campus.
"In light of the fact that it happened on campus, we are always looking at ways we can improve the situation," Colegrove said.
"That is under review right now. I would say we will take very serious consideration of some things we can do better."
Foley said that his client is innocent.
"Mr. Thompson is a young man with a bright future. Based on the evidence presented to us today, Mr. Thompson is innocent of the charges against him. He looks forward to his day in court," Foley said in a written statement Monday afternoon.
