Three busted for marijuana in Bee Creek area
If you’re going to have marijuana laying around on a table and the cops knock on your door wanting you to come outside and speak to them, then it’s probably not a good idea to insist they come inside to speak with you.
Whitley County Sheriff’s deputies say that is exactly what happened while they went to answer a disturbance call Wednesday in the Bee Creek community.
Deputies Cody Harrell and David Rowe went to the residence at 100 Osborne Lane, but the homeowner refused to come outside to speak with police, Deputy Shawn Jackson said in a press release.
"He insisted that the deputies come in and talk with him inside the residence," Jackson wrote.
When they got inside, Rowe and Harrell noticed a small amount of what appeared to be marijuana laying on a table in "plain view," Jackson wrote.
Jackson soon arrived at the residence to assist with the investigation. Officers received "consent to search" the residence where they discovered another small amount of what appeared to be marijuana hidden in a pill bottle in the back room of the residence. In addition, other items of paraphernalia were discovered throughout the residence, Jackson wrote.
Jackson added that over the last few weeks, deputies have received complaints about a lot of traffic in the Bee Creek area involving possible drug activity.
Deputies arrested and charged Bennis "Benny" Brown, 42, and Deborah Brown, 53, both of 100 Osborne Lane, with possession of marijuana and possession of drug paraphernalia.
Deputies also charged a third person at the residence, Timothy Leach, 40, of Young’s Chapel Road,with possession of marijuana.
During their arraignments Thursday morning in Whitley District Court Bennis Brown and Leach both pleaded guilty, and received probated 30-day jail sentences.
Harrell and Rowe are continuing the investigation.

I am sure you’re aware that they were charged with misdemeanors which do not carry hefty jail sentences and a probated sentence is not uncommon since the county would have to pay for the incarceration…. If you are so concerned with the “slap on the wrist” perhaps you should take it up with the legislature since they are the ones that actually construct the statutes and afford judges discretion in these matters. Naturally, I assume that you were completely cognizant of these realities and were not truly suggesting that a judge violate the law and impose an unlawful sentence, right? Now, if you truly believed what you wrote, I think, it just confirms the uneducated stereotype of Kentuckians and I am ashamed for us all….
If its against the law dont do it We have a heriff now who is a people sheriff and will uphold the law. Dont shoote the sheriff if you do something no matter how small you think it is folks in the neighbohood might have complained> You can call the sheriff and they really come out now!Let them get all the drugs ,Go sheriff get the Woodbine meadowcreek pushers next
I happen to know these two fine citizens. They live on disability checks, Don’t/can’t work, but have everything handed to them. They have free medical and travel as far as Somerset and Lexington for this treatment all at taxpayers expense. Wonder who bought this harmless drug for them. Me and you if you work and pay taxes. Yes I for one, am FED UP. It’s time for these judges to start enforcing the law instead of allowing them to meet the arresting officer at the door and laughing at him for going to the trouble to do his job, who, by the way helps to pay for these people’s drugs too.
In response to last post…Another year or two???If your meaning someone should serve 2 years for marijuana possession you’ve lost your mind. Marijuana is harmless, police should be more concerned with drunk drivers or meth addicts or pill pushers, those are the ones that need 2 or more years for dealing with the crap…
Well don’t it just figure that Whitley District court judge Cathy Prewitt gave them 30 days probated. Maybe she should have continued it for another year or two that seems to be a favorite of hers. If you get charged with drugs in Whitley County and go in front of her you can bet she’ll let you off with a slap on the wrist.
