preliminary findings suggest trooper involved in fatal accident acted properly
Kentucky State Police Trooper Dwayne Foley remains off duty as he continues to recover from his injuries, but an initial investigation has revealed no wrong doing on his part in the wreck that took the life of a Williamsburg man last Wednesday afternoon.
“Trooper Foley did nothing outside of KSP policy as far as investigators are concerned, right now,” said Trooper Lloyd Cochran, public affairs office at Post 11 in London.
Cochran said the investigation is continuing and accident reconstructionists are still working to compile and complete the report concerning the wreck that occurred on U.S. 25W in the Goldbug community about 3 p.m.
Forty-one-year-old James King was pronounced dead at the scene near the intersection with Shiner Church Road after Foley’s cruiser struck his car as Foley responded to a wreck with injuries.
Foley was reportedly travelling north with his lights and sirens activated. He was reportedly attempting to pass several vehicles. King, who was driving one of those vehicles, reportedly attempted to make a left turn when the collision occurred.
"It wasn’t a t-bone [accident], it was more of a rear-end type of deal," Cochran said, noting King and the other vehicle had almost stopped in the roadway.
The wreck forced Foley’s cruiser off the road and over an embankment.
Foley was taken by ambulance to Baptist Health Corbin where he was treated and released.
Police say King was wearing his seat belt at the time of the collision. Neither drugs nor alcohol are suspected to be a factor in the crash,
Cochran said Foley has over five years of service with KSP. He is regularly answering calls throughout Whitley County and is familiar with driving on U.S. 25W.
KSP Sgt. Greg Hill is in charge of the investigation and was assisted at the scene by the Whitley County Sheriff’s Office, Whitley County EMS, Woodbine Volunteer Fire and Rescue Department, Oak Grove Volunteer Fire Department, and the Goldbug Volunteer Fire Department.

A shame that a man had to die because of the indifference and recklessness of a cop. He should be arrested for manslaughter. Just because a cop has a badge, gun, and fast car gives him no license to act with careless disregard for others. Hope he remembers this shameful act the rest of his life
Typical Johnny Cop behavior. This man’s death was unnecessary and preventable. There is no justifiable reason the Trooper needed to be in emergency mode to get to an accident on the other end of town just because it was a buddy’s wife. That’s the First Responders’ duty! The troopers’ job is to write the accident report and direct traffic. This cop has an innocent man’s blood on his hands.
