Pursuant to 405 KAR 8:010, Section 16(5), the following is a summary of permitting decisions made by the Department for Natural Resources, Division of Mine Permits with respect to applications to conduct surface coal mining and reclamation operations in Whitley County. NOTICE OF INTENTION TO MINE
Pursuant to Application 918-0458
In accordance with the provisions of KRS 350.055, notice is hereby given that Mountainside Coal Company, Inc., 7692 South Highway 25W, Williamsburg, KY 40769, has applied for a permit for a surface and auger coal mining operation located approximately two miles west of the community of Jellico Creek in Whitley County. The proposed operation will disturb 229.0 surface acres and underlie an additional 57.2 acres. The total area within the permit boundary will be 286.2 acres.
The proposed operation is approximately 0.04 mile northeast of KY Route 92’s junction with Newman Campbell Road and 0.1 mile south of Pleasant Run of Jellico Creek.
The proposed operation is located on the Hollyhill U.S.G.S. 7 ½ minute quadrangle map. The operation will use the contour and auger methods of surface mining. The surface area is owned by Glenn & Marlene Hamblin, Pearl Davis, Irvin Scharfenberger, John & Deborah Gifford, Thomas & Inez Troxel, Paul & Delores Rowe, Keith Rowe, White Lumber Sales, LLC., Matthew & Ashley Ratliff, Clifford & Martha Partin, and Whitley County, Kentucky. The operation will affect an area within 100 feet of Ball Branch Road. The operation will involve closure of sections of this public road for a period of five years.
The application has been filed for public inspection at the Division of Mine Reclamation and Enforcement’s Middlesboro Regional Office, 1804 E. Cumberland Ave., Middlesboro, Kentucky 40965. Written comments, objections or requests for a permit conference must be filed with the Director of the Division of Mine Permits, #2 Hudson Hollow Complex, U.S. 127 South, Frankfort, Kentucky 40601.
NOTICE OF INTENTION TO MINE
Pursuant to Application Number 918-0447, Amendment No. 3
In accordance with KRS 350.070 notice is hereby given that Alden Resources LLC 332 West Cumberland Gap Parkway, Suite 100, Corbin, Kentucky 40701 has applied for an amendment to an existing surface coal mining and reclamation operation located 0.5 miles north of Perkins in Whitley County. The amendment will add 83.61 acres of surface disturbance and 17.66 acres of auger area making a total area of 101.27 acres within the amended permit area. The total area of the permit is 351.74 acres.
The proposed amendment area is approximately 0.9 miles east from the Maple Creek Road (KY HWY 779) junction with Brown Creek Road and located 600 feet southeast of Phoebe Fork.
The proposed amendment is located on the Rockholds, KY 7½ minute quadrangle map. The surface area to be disturbed by the amendment is owned by Charles Paul, Johnnie Johnson, Edwin Webb, Rick Thornsberry, James Martin, Jerry Croley, and Georgie Terrell. The amendment will underlie land owned by Ella Baker Heirs, Charles Paul, Johnnie Johnson, Edwin Webb, Rick Thornsberry, Jerry Croley, and Georgie Terrell. The operation will use the contour and auger methods of mining. The operation will affect an area within 100 feet of public road KY 779. The operation will not involve relocation or closure of the public road.
This is the final advertisement of the application. All comments, objections or requests for a permit conference must be received within thirty (30) days of today’s date. The amendment application has been filed for public inspection at the Department for Mining Reclamation and Enforcements, Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965-1229. Separate Sealed BIDS for the construction of Water & Sanitary Sewer Reloctions for 10th Street will be received by the City of Williamsburg at Williamsburg City Hall, 423 Main Street, Williamsburg, KY 40769, until 2:00 PM (local time), Tuesday, October 8, 2013, and then publicly opened and read aloud.
The project consists of approximately: 2,300 LF of 8” PVC & DIP waterline, 475 LF of 12” DIP waterline, 2,950 LF of 8” PVC gravity sewer, 600 LF of 12” PVC gravity sewer, 1,000 LF of 15” PVC gravity sewer, 28 EA 48” diameter Precast Manholes, 6 EA Manhole Drops, one sewer creek crossing, tie-ins to existing lines and services, appurtenances associated with water and sewer construction, pavement repairs, testing, disinfection, and landscaping restoration and seeding.

Copies of the CONTRACT DOCUMENTS may be obtained from Lynn Imaging, 328 Old Vine Street, Lexington, KY 40507 (859-226-5850) and www.lynnimaging.com upon payment of a non-refundable price of $150.00 for each set plus any shipping charges.
Each Bidder must accompany his bid with a Bid Bond in amount of not less than five (5) percent of the base bid. No Bidder may withdraw his bid for a period of ninety (90) days. The Bidder awarded the contract shall execute a 100% Performance Bond and a 100% Payment Bond and shall furnish insurance as required, in the General Conditions. This contract shall be substantially completed within 90 calendar days, and fully completed within 120 calendar days after date of authorization to start work. Liquidated damages will be $500 per calendar day.

Bidders must comply with the President’s Executive Order Nos. 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Any bid that is obviously unbalanced may be rejected. The City of Williamsburg reserves the right to reject any and all bids and waive informalities.

Notice
The 2012 Whitley County Sheriff Fee Account Audit Report has been released. A copy of the complete audit report is on file and available for public inspection during normal business hours, Monday through Friday from 8:00 a.m. to 4:30 p.m. If any citizen wishes to obtain a complete copy including financial statements and supplemental information for their personal use copies will be made available upon request. Copies will be charged at the rate of 25¢ per page. Copies of the financial statement prepared in accordance with KRS 424.220 are available to the public at no cost from the Whitley County Sheriff’s Department.
PUBLIC HEARING
The Williamsburg Independent Board of Education will hold a public hearing in the auditorium on September 25, 2013, at 5:30 p.m. to hear public comments regarding a proposed general fund tax levy of 43 cents on real property and 43 cents on personal property.
The General Fund tax levied in fiscal year 2013 was 41.6 cents on real property and 41.9 cents on personal property and produced revenue of $603,674.81. The proposed General Fund tax rate of 43 cents on real property and 43 cents on personal property is expected to produce $658,370.54. Of this amount, $86,092.73 is from new and personal property. The compensating tax for 2014 is 41.4 cents on real property and 41.4 cents on personal property and is expected to produce $633,873.03.
The general areas to which revenue of $54,695.73 above 2013 revenue is to be allocated are as follows: Cost of collections, $0; building fund, $0; instruction, $54,695.73; transportation, $0; and maintenance of plant, $0.
The General Assembly has required publication of this advertisement and information contained herein.
