WHITLEY COUNTY BOARD OF EDUCATION
The Whitley County Board of Education will hold a public hearing at the Whitley County Board of Education Central Office on September 11, 2014 at 5:45 p.m. to hear public comments regarding tax levies for fiscal year 2015.
The General Fund tax rate levied in fiscal year 2014 was 38.6 cents for real property and 39.8 cents for personal property resulting in tax bills of $2,577,160 before delinquencies and exonerations. The Whitley County Board of Education is proposing a 1.0 cent increase over last year’s real property rate (39.6 cents) and no increase over last year’s personal property rate (39.8 cents), along with the allowable additional 0.4 cents on each rate to compensate for last year’s exonerations per KRS134.590.
The proposed General Fund real estate tax rate and personal property tax rate (including the allowable 0.4 cents for prior year’s exonerations per KRS134.590) is expected to produce $2,696,975 prior to delinquencies and exonerations. Of this amount, $432,428 is from new and personal property. The compensating tax rate for 2015 is 38.7 cents on real property and 40.1 cents on personal property (including the allowable 0.4 cents added for prior year’s exonerations per KRS134.590) and is expected to produce $2,623,212. The general area to which revenue of $73,763 is to be allocated is instruction.

In accordance with KRS 350.055, notice is hereby given that Alden Resources, LLC of 332 W. Cumberland Gap Parkway, Corbin, KY 40701, has applied for a permit for a surface contour and auger/highwall mining coal mining and reclamation operation located approximately 0.6 miles east of Rockholds in Whitley County. The operation will disturb 179.46 surface acres and will underlie an additional 244.94 acres, making a total area of 424.40 acres within the permit boundary.
The proposed operation is approximately 0.6 miles northeast of the junction of KY Route 511 and Ky Route 26 and located approximately 0.6 miles northeast of Colonel Hollow streams confluence with Watts Creek. The latitude is 36°50’20” and the longitude is 84°05’21”.
The proposed operation is located on the Rockholds 7 1/2 min. quadrangle map. The surface to be disturbed is owned by Gatliff Coal Co., Inc., Conley and David Manning, and Darrell and Joanne Ball. The auger and highwall mining will underlie land owned by Gatliff Coal Co., Inc.
The application has been filed for public inspection at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional office at 1804 East Cumberland Avenue, Middlesboro, KY 40965. Pursuant to Application Number 918-5197, Amendment #1
In accordance with KRS 350.070, notice is hereby given that Alden Resources LLC; 332 W. Cumberland Gap Pkwy., Suite 100; Corbin, Kentucky 40701 has applied for an amendment to an existing surface coal and underground coal mining and reclamation operation. The amendment will add 40.4 surface acres and will underlie an additional 71 acres, making a total permit area of 853.3 acres within the amended permit boundary.
The proposed amendment area is located approximately 1.5 miles Southwest of Lick Fork Road’s intersection with KY Hwy 92, and approximately 0.9 miles west of Poplar Creek in Whitley County, Kentucky. The operation is further located 1.5 miles southwest of the community of Carpenter, Kentucky.
The proposed amendment is located on the Frakes and Saxton U.S.G.S. 7½ minute quadrangle maps. The amendment operation will use the Contour and Auger methods of mining. The surface area to be disturbed is owned by Three C Land Company, LLC, Mattie Davis and James & Charlotte Monhollen. The operation will underlie land owned by TKY Acquisitions, LLC, Three C Land Company, LLC, Mattie Davis, Johnny & Flora Patterson and James & Charlotte Monhollen. The operation will not affect an area within 100 feet of Lick Fork Road. The operation will not involve the relocation or temporary closure of Lick Fork Road.

The above described having an area of 2.0000 acres as surveyed by Bobby Hudson, LPLS 1263 on August 29, 2000, and being a portion of the property conveyed to Warren Hale, by Deed recorded in Deed Book 326, Page 069, records of the Whitley County Court Clerk’s Office at Williamsburg, Kentucky.
All corners or witness monuments referred to herein as iron pins set are one-half inch rebar 18 inches long and capped with an orange cap marked LS 1253, except otherwise noted. All bearings are referenced to the magnetic meridian.

TERMS OF SALE
1. The above property is indivisible and shall be sold as a whole to produce the sum of money so ordered to be made.
2. On the date of sale, the purchaser shall either pay cash or, with surety on a bond approved by the Commissioner, may pay one-third (1/3) down of the purchase price together with a bond (for the remainder of the purchase price) with good and sufficient surety, bearing interest from the day of the sale and payable to the Master Commissioner within thirty (30) days with interest at 12% per annum from the date of sale until paid. Signatures of principal and surety on the bond shall have the effect of a Judgment. In the event the Plaintiff or its representative is the purchaser, then, and in that event, they may take a credit upon its judgment against the purchase price and shall only be obligated to pay court costs, the fees and costs of the Master Commissioner and any real estate taxes payable pursuant to the judgment, and in that event, no payment shall be required and no bond shall be executed by them.
3. The risk of loss for the subject property shall pass to the purchaser on the date of sale. Possession of the premises shall pass to the purchaser upon payment of the purchase price and delivery of deed.
4. The purchaser shall be required to assume and pay all taxes or assessments upon the property for the current tax year and all subsequent years. All taxes or assessments upon the property for prior years shall be paid from the sale proceeds if properly claimed in writing and filed of record by the purchaser prior to payment of the purchase price.

Pursuant to a Judgment and Order of Sale entered by the Whitley Circuit Court on June 30, 2014, I shall offer for sale at the door of the Whitley County Judicial Center, (new courthouse), 100 Main Street, Williamsburg, Kentucky, at public auction on Monday, September 15, 2014, at 12:00 p.m., or thereabout, the real property described in this Notice.
The IN Rem Judgment against the Defendants, Charles Wilson and Sharon Wilson, is for the sale of the real property and is not a personal Judgment against the Defendants, Charles Wilson and Sharon Wilson, and is as follows:
