Pursuant to Application Number 861-0528, Amendment #1
In accordance with KRS 350.070, notice is hereby given that Mountainside Coal Co., Inc.; 7692 South Hwy. 25W; Williamsburg, Kentucky 40769 has applied for an amendment to an existing permit for a surface/underground coal mining and reclamation operation located 1.7 miles northwest of the community of Permon in Knox and Whitley Counties, Kentucky. The amendment will add 0.0 acres of surface disturbance and will underlie an additional 90.2 acres, for a total of 662.8 acres within the amended permit boundary.
The proposed amendment is approximately 1.6 miles northeast from HWY 1418’s junction with HWY 511 and located approximately 0.4 miles north of Cotton Creek. The Latitude is 36°48’52”N. The Longitude is 84°00’53”W.
The proposed amendment is located on the Barbourville & Rockholds U.S.G.S. 7½ minute quadrangle maps. The amendment will underlie land owned by Robert Brown & Kathy Brown, Hubert Grant & Arnold David Grant, Ray & Geneva Hill, David Logan & Tim Logan, Randy D. Mackey, Norma Lene Foley, Arthur Foley, David & Brenda Monhollen, Jack & Sadie Smith, Blair Farms, L.L.C., Kevin Holbrook and Gary Partin.
This is the final advertisement of this application. All comments, objections or requests for a permit conference must be received within thirty (30) days of today’s date. The amendment application has been filed for public inspection at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office; 1804 East Cumberland Avenue; Middlesboro, Kentucky 40965-1229. NOTICE:
The Williamsburg Independent Board of Education will hold a public hearing in the Auditorium on September 3, 2015 at 6:00 P.M. to hear public comments regarding a proposed general fund tax levy of 46.4 cents on real property and 46.4 cents on personal property.
The General Fund tax levied in fiscal year 2015 was 44.6 cents on real property and 44.6 cents on personal property and produced revenue of $632,142.23. The proposed General Fund tax rate of 46.4 cents on real property and 46.4 cents on personal property is expected to produce $719,630.67. Of this amount $88,993.17 is from new and personal property. The compensating tax for 2016 is 44.7 cents on real property and 44.7 cents on personal property and is expected to produce $693,264.89.
The general areas to which revenue of $87,488.44 above 2015 revenue is to be allocated are as follows: Cost of collections, $0; building fund, $0; instruction $87,488.44; transportation, $0; and maintenance of plant, $0.

An ordinance amending the Whitley County Budget for Fiscal Year 2015- 2016, to include unanticipated receipts increasing/decreasing from the Gen, Road, Jail, LGEA, Ambulance, Forest, Occupational Tax and 911 Fund in the amount of $398,202.00 and increasing/decreasing expenditures from the Gen, Road, Jail, LGEA, Ambulance, Forest, Occupational Tax and 911 Fund in the amount of $398,202.00 was passed on 08/18/15. WHITLEY COUNTY BOARD OF EDUCATION
The Whitley County Board of Education will hold a public hearing at the Whitley County Board of Education Central Office on September 10, 2015 at 5:45 p.m. to hear public comments regarding tax levies for fiscal year 2016.
The General Fund tax rate levied in fiscal year 2015 was 40.2 cents for real property and 40.2 cents for personal property resulting in tax bills of $2,847,544 before delinquencies and exonerations. The Whitley County Board of Education is proposing a 1.0 cent increase over last year’s real property rate (41.2 cents) personal property rate (41.2 cents), along with the allowable additional 0.4 cents on each rate to compensate for last year’s exonerations per KRS134.590.
The proposed General Fund real estate tax rate and personal property tax rate (including the allowable 0.4 cents for prior year’s exonerations per KRS134.590) is expected to produce $2,532,090 prior to delinquencies and exonerations. Of this amount, $465,033 is from new and personal property. The compensating tax rate for 2016 is 40.1 cents on real property and 40.1 cents on personal property (including the allowable 0.4 cents added for prior year’s exonerations per KRS134.590) and is expected to produce $2,717,488. The general area to which revenue of $130,056 is to be allocated is instruction.

PUBLIC NOTICE
A Petition to Close Galilean Childrens Home Road, a County Road with the length of .159 miles and a Portion of Singing Hills Road, a County Road, concerning 0.331 miles, has been presented to the Whitley County Fiscal Court. Pursuant to KRS 178.050, the hearing for this road closure, open to all interested parties, is scheduled to convene on September 15, 2015 at 6:00 p.m. during the regular scheduled court meeting. A written report from the two Viewers and the Road Department Supervisor will be presented at the meeting. A review of the map pertaining to the road closure is available for viewing at the Whitley County Judge Executive’s office during regular business hours.

BLASTING SCHEDULE

This is notice that In accordance with Federal Regulations, 30 CFR 715.19, and State Regulation, 405 KAR 16:120 Sec 3 (1) (a) (b) (c), Public Notice of Blasting Schedule, ACPKY1, LLC, 2200 Winter Springs BLVD #317, Suite 106, Oviedo, FL 32765, Telephone Number (407) 620-4038, will conduct blasting operations in Whitley County at mining operation is located approximately 1.43 miles southwest from KY 1064 junction with Corn Creek Road and located 1.06 miles south of the Corn Creek. The latitude is 36° 51’ 43” and the Longitude is 84° 05’ 36”. Blasting activity will be conducted on approximately 45.48 surface acres. Blasting will be done daily. No blasting will be conducted before sunrise or after sunset. At least 10 minutes before the blast, Company personnel will control access to the area. Before each blast is detonated the following type(s) of audible warning will be given: WARNING SIGNAL – A one-(1) minute series of long blasts of a siren, five (5) minutes prior to the blast signal. BLAST SIGNAL – A series of short blasts of a siren, one (1) minute prior to the shot. The all-clear signal(s) after blasting will be: A prolonged blast of a siren, following the inspection of the blast area. Blasting will not be conducted at times different from those given above except in emergency situations where rain, lightning, other atmospheric conditions, or operator or public safety requires unscheduled detonation. Prior to these detonations, the following audible warning will be given. A one-(1) minute series of long blasts of a siren, five (5) minutes prior to the blast signal. BLAST SIGNAL – A series of short blasts of a siren, one (1) minute prior to the shot. The all-clear signal(s) after blasting will be: A prolonged blast of a siren, following the inspection of the blast area Also prior to detonations in emergency situations the permittee, using audible signals, shall notify all persons within one half (1/2) mile of the blasting site. All roads leading to or located within 1000’ feet of the blast area will be blocked by flagman a minimum of 1000’ feet from the blast prior to detonation and remain closed until the all clear is given.

Person(s) or Agency must submit their mailed bids or submit them to the Whitley County Judge Executive at the Whitley County Courthouse, P.O. Box 237, Williamsburg, Kentucky, on or before 2:00 p.m. local time on September 14, 2015 at which time bids will be opened and read aloud. Bids will then be presented to the Fiscal Court at the regular scheduled meeting at 6:00 p.m. on September 15, 2015. All bids shall be marked “SURPLUS PROPERTY” on front of envelope.
The surplus property is available for inspection located at Whitley County Ambulance, Aviation Blvd, Williamsburg, KY 40769 and can be viewed during 8:00 AM and 3:30 PM, Monday through Thursday.
Payment from the recipient(s) awarded the Bid shall be made with the County Treasurer. Removal of the vehicles/equipment shall be the responsibility of the recipient of the BID and shall have until 3:30 PM on September 18, 2015 to remove all vehicles or equipment.
Conflicts of interest, gratuities and kickbacks are defined in KRS 45A.445 and as provided for in KRS 45A.445 are absolutely prohibited.
No bidder may withdraw his/her bid for 60 days after the date the bids are opened. Any bid received after the time specified shall not be considered and will be returned unopened to the bidder.
