Notice is hereby given that Corbin Independent Schools, 108 Roy Kidd Avenue, Corbin, KY 40701, has filed an application with the Energy and Environment Cabinet to construct new synthetic turf fields for the existing baseball and softball fields.  The property is located south of Corbin High School, 1901 Snyder St, Corbin, KY 40701 to the east and west of the existing track and field, adjacent to Bacon Creek. WHITLEY COUNTY FISCAL COURT

ORDINANCE NO. 2023-06

AN ORDINANCE OF WHITLEY COUNTY, KENTUCKY RELATING TO THE REAPPORTIONMENT OF THE WHITLEY COUNTY MAGISTERIAL DISTRICTS SUPERCEDING ORDINANCE 2011-11.

WHEREAS, the Whitley County Fiscal Court has appointed three (3) Reapportionment Commissioners; and,

WHEREAS, in conformity with applicable state statutes, the Commissioners filed their report “Attachment A” with the Whitley County Clerk and the Whitley County Fiscal Court; and.

WHEREAS, the Whitley County Clerk has provided the Whitley County Fiscal Court with “Attachment B” which shows the latest precinct codes, numbers, names and locations; and,

WHEREAS, upon review of the report “Attachment A”, and by recommendations made in the report that in order to conform to the applicable KRS, the magisterial districts change as follow: A103 change along the line of D102 to match the line of the magisterial districts. A104 changes to match the original description at the junction of lines A103 and A104. A portion of A105 moves to C108 and C110 in order to make the +/- 5% in the population. A106 precinct line is moved back to the Williamsburg City limits line. A107 was expanded to the city limit line and was expanded to include part of Croley Bend Road. A109 the line is changed back to the Williamsburg City limit line. C112 is changed to the Williamsburg City limit line to make the +/- 5% in the population. C114 precinct line is changed in order to make the +/- 5% in the population. D102 line is changed to follow the original precinct line.

NOW THEREFORE, BE IT ORDAINED BY THE FISCAL COURT OF THE COUNTY OF WHITLEY, COMMONWEALTH OF KENTUCKY, THAT IN CONFORMITY WITH KRS 67:045, THE WHITLEY COUNTY FISCAL COURT ADOPTS THE MAP AND REPORT OF THE REAPPORTIONMENT COMMISSIONERS, THAT;

Section 1 – Magisterial District 1:  Population: 8,817

The following precincts compose the First Magisterial District: City School (A101), Rockholds (A103), Wofford (A104), Level Green (A105), Highland Park/Hanging Rock (A106), Courthouse (A107), College Hill (A109), and Meadow Creek (A111).

Beginning at a point on the common border of Whitley and Knox County in northeast Whitley County. The line extends a westerly direction through Cedar Gap, Bald Knob, King Mountain, through Johnny Hollow. Crossing Highway 26 due west to Interstate 75.

The line continues south on Interstate 75 to the underpass of Kentucky Highway 836 (Cripple Creek Road) where that highway intersects Kentucky Highway 2985. The line continues south on Kentucky 2985 about one-half mile to Cripple Creek, then down that creek to Blakes Fork Creek and down Blakes Fork Creek to its confluence with Watts Creek. Then it extends down Watts Creek to the Cumberland River and downstream to Interstate 75. Thence going in a southerly direction down Interstate 75 to where it intersects the city limits of Williamsburg. The line then turns westward to Redbird Road and follows the city boundary until it reaches Waterpark Way. Then it follows Briar Creek to George Hayes Road. Thence following George Hayes Road northward to the railroad tracks. Then north on George Hayes Road to the CSX Railroad. Then north along the railroad to Main Street in Williamsburg.

The line then extends northeast down Main Street to the intersection of US Highway 25W and Main Street. Then south along US Highway 25W to Kentucky Highway 92. Then northeast on Kentucky Highway 92 to a point one hundred feet north of the confluence of the Cumberland River and Clear Fork River where the line leaves Kentucky Highway 92 and extends eastward to the Cumberland River crossing the city boundary. It then follows the Cumberland River upstream to Faulkner Bend Road north of Rains Cemetery. Thence in a northerly direction between the watersheds of Bradford Branch and Bunch Creek, to the head waters of Bunch Creek. Thence to a point between King Mountain and Wood Mountain. Thence westerly crossing Reese Creek, Deep Branch to Maple Creek Subdivision.

Southbound along Maple Creek to the intersection of Kentucky 92 E. West along Kentucky 92 E to the intersection of Maiden Bend Road and Lawson Road. Thence south along Maple Creek until it intersects the Cumberland River. Thence following the Cumberland River southbound to a point east of Maiden Bend Spur and Maiden Bend Road. Thence west crossing Highway 1064 and back to the Cumberland River. Thence following the Cumberland River upstream to Highway 779 and the common boundary of Knox and Whitley Counties. Thence northbound along the common boundaries of Knox and Whitley Counties back to the beginning point.

Section 2 – Magisterial District 2:  Population: 9,529

The following precincts compose the Second Magisterial District: Tattersall (B101), Corbin #7 (B102), South Corbin (B104), South Ward (B105), Mastertown (B106), Barton (B107), Corbin #40 (B108), Corbin #41 (B109), and Corbin #45 (B110).

From the point where Spruce Creek empties into Laurel River Lake, southward up Spruce Creek to the point where it crosses US Highway 25W. Then eastward along US Highway 25W to the Corbin Municipal Boundary. The line then follows the Corbin Municipal Boundary to Bacon Creek Road, crosses the road and extends due east to where Howard Perkins Road crosses Lynn Camp Creek, which is the common border of Whitley and Knox Counties.

The line then follows the Knox/Whitley County border north, then westward along the common border of Whitley and Laurel Counties to the beginning point where Spruce Creek empties into Laurel River Lake.

Section 3 – Magisterial District 3:  Population: 8,763

The following precincts compose the Third Magisterial District: Poplar Creek (C101), South America (C102), Pine Mountain (C103), Boston (C104), Jellico (C105), Saxton (C106), Pleasant View (C107), Verne (C108), Depot/Army (C109), Savoy (C110), Emlyn (C111), Jellico Creek (C112), Nevisdale (C113), and Liberty (C114).

Beginning at a point in the Cumberland River near Bee Shoals at the common border of Whitley and McCreary Counties. Thence easterly along the Cumberland River continuing through the community of Redbird, north of Prewitt Bend and Croley Bend, to the intersection of Interstate 75. Thence due south with a common line with the First Magisterial District. Thence following the southern boundary of the First Magisterial District to the Knox County Line. The line then extends southward along the common border of Whitley and Bell Counties to the Tennessee State line.

It then extends westward along the Tennessee State Line to the McCreary County line. Then it extends northwestward along the common border of Whitley and McCreary Counties to the beginning point in the Cumberland River.

Section 4 – Magisterial District 4:  Population: 9,603

The following precincts compose the Fourth Magisterial District: Midsprings (D101), Goldbug (D102), Martin Springs (D104), Woodbine (D105), and Spruceburg (D106).

Beginning where Spruce Creek empties into Laurel River Lake, the line follows the western and southern boundaries of the Second Magisterial District to a point along Lynn Camp Creek, then along the common border of Whitley and Knox Counties to the beginning point of the First Magisterial District. The line then follows the northern and western boundaries of the First Magisterial District to a point in the Cumberland River where it is closest to Interstate 75. Thence follows the western boundary of the First Magisterial District to another point in the Cumberland River at Interstate 75 near Croley Bend. Thence follows the northern boundary of the Third Magisterial District westward which is the Cumberland River to a point on common boundary of Whitley and McCreary Counties. Then the line follows the common boundary between McCreary and Whitley Counties northward to the Laurel County line. Then eastward along the common boundary of Laurel and Whitley Counties to the beginning point of the mouth of Spruce Creek where it empties into Laurel River Lake.

Section 5 – The provisions of this Ordinance are severable. If any sentence, clause or section or any application thereof is found to be invalid or unconstitutional such shall not affect or repeal any of the remaining provisions, sentences, clauses or sections or this Ordinance.
