Notice of Intention to Mine
Pursuant to Application Number 861-0528, Amendment #1
In accordance with KRS 350.070, notice is hereby given that Mountainside Coal Co., Inc.; 7692 South Hwy. 25W; Williamsburg, Kentucky 40769 has applied for an amendment to an existing permit for a surface/underground coal mining and reclamation operation located 1.7 miles northwest of the community of Permon in Knox and Whitley Counties, Kentucky. The amendment will add 0.0 acres of surface disturbance and will underlie an additional 90.2 acres, for a total of 662.8 acres within the amended permit boundary.
The proposed amendment is approximately 1.6 miles northeast from HWY 1418’s junction with HWY 511 and located approximately 0.4 miles north of Cotton Creek. The Latitude is 36°48’52”N. The Longitude is 84°00’53”W.
The proposed amendment is located on the Barbourville & Rockholds U.S.G.S. 7½ minute quadrangle maps. The amendment will underlie land owned by Robert Brown & Kathy Brown, Hubert Grant & Arnold David Grant, Ray & Geneva Hill, David Logan & Tim Logan, Randy D. Mackey, Norma Lene Foley, Arthur Foley, David & Brenda Monhollen, Jack & Sadie Smith, Blair Farms, L.L.C., Kevin Holbrook and Gary Partin.
The amendment application has been filed for public inspection at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office; 1804 East Cumberland Avenue; Middlesboro, Kentucky 40965-1229. Written comments, objections, or requests for a permit conference must be filed with the Director; Division of Permits; #2 Hudson Hollow Road, U.S. 127 South; Frankfort, Kentucky 40601.
NOTICE OF BOND RELEASE
In accordance with KRS 350.093, notice is hereby given that Fraziernantz, LLC., 541 Blakes Fork Rd., Williamsburg, Ky. 40769 has applied for a Phase 2&3 Bond Release on Permit Number 918-0432 which was last issued on June 11, 2012. The application covers an area of approximately 26.07 acres located 1.0 miles Southwest of Yaden in Whitley County.
The proposed operation is approximately 1.0 mile southwest from KY 904’s junction with Dal Road and located 0.1 mile west of the Cumberland River. The Latitude is 36-43-23 and the Longitude is 84-06-20.
The bond now in effect for increments 1,2,3 and is a total of $42,500 which is a Letter of Credit bond. Approximately 34.6% of the original bond amount of $122,600.00 is included in the application for reIease.
Reclamation work performed includes: Backfilling, grading, fertilizing, seeding, and mulching was completed in October of 2012.
This is the final advertisement of the application. Written comments, objections, and requests for a public hearing or informal conference must be filed with the Director, Division of Field Services, #2 Hudson Hollow, Frankfort, Kentucky 40601, by September 18, 2015 @ 11:00 am.
A public hearing on the application has been scheduled for September 21, 2015 @ 9:00 am at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office, Regional State Office Building, 1804 E Cumberland, Middlesboro, KY 40906. The hearing will canceled if no request for a hearing or informal conference is received by September 18, 2015 11:00 am.

NOTICE:
The Williamsburg Independent Board of Education will hold a public hearing in the Auditorium on September 3, 2015 at 6:00 P.M. to hear public comments regarding a proposed general fund tax levy of 46.4 cents on real property and 46.4 cents on personal property.
The General Fund tax levied in fiscal year 2015 was 44.6 cents on real property and 44.6 cents on personal property and produced revenue of $632,142.23. The proposed General Fund tax rate of 46.4 cents on real property and 46.4 cents on personal property is expected to produce $719,630.67. Of this amount $88,993.17 is from new and personal property. The compensating tax for 2016 is 44.7 cents on real property and 44.7 cents on personal property and is expected to produce $693,264.89.
The general areas to which revenue of $87,488.44 above 2015 revenue is to be allocated are as follows: Cost of collections, $0; building fund, $0; instruction $87,488.44; transportation, $0; and maintenance of plant, $0.
The General Assembly has required publication of this advertisement and information contained herein.
LEGAL NOTICE
In accordance with Chapters 65 and 424 of the Kentucky Revised Statutes, the financial report and supporting data may be inspected by the general public at the Whitley County Conservation District, located at 1707 Cumberland Falls Hwy, Suite L3, Corbin, KY, between the hours of 8:00am and 4:30pm Monday through Friday. Meetings are held on a monthly basis on the third Thursday of the month at 6:30pm, with the exception of December, and are open to the public.
