NOTICE OF INTENTION TO MINE
Pursuant to Application Number 918-0409
In accordance with KRS 350.055 notice is hereby given that Alden Resources LLC 332 West Cumberland Gap Parkway, Suite 100, Corbin, Kentucky 40701 has applied for a permit for a surface coal mining and reclamation operation affecting 139.38 acres located 2.26 miles south of Nevisdale in Whitley County.
The proposed operation is approximately 2.26 miles south from Patterson Creek Road’s junction with KY 904 and located near the head of Patterson Creek.
The proposed operation is located on the Saxton, KY 7½ minute quadrangle map. The operation will use the contour and auger method of surface mining. The surface area is owned by Andy Shelton Heirs and the Gibbs & St. Clair Heirs.
The application has been filed for public inspection at the Department for Natural Resources, Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965-1229. Written comments, objections or requests for a permit conference must be filed with the Director, Division of Mine Permits, #2 Hudson Hollow, U.S. 127 South, Frankfort, Kentucky 40601.
NOTICE OF ADOPTION AND SUMMARY OF BOND RESOLUTION
The Fiscal Court of the County of Whitley, Kentucky (the “County”), gave reading to and adopted the Resolution below at a regular meeting held on July 21, 2009, in the Fiscal Courtroom of the Whitley County Courthouse, Williamsburg, Kentucky.
A RESOLUTION OF THE FISCAL COURT OF THE COUNTY OF WHITLEY, KENTUCKY DIRECTING THE WHITLEY COUNTY, KENTUCKY PUBLIC PROPERTIES CORPORATION TO TAKE CERTAIN FORMAL ACTIONS AS THE AGENCY AND INSTRUMENTALITY AND AS THE CONSTITUTED AUTHORITY OF THE COUNTY OF WHITLEY, KENTUCKY; SPECIFICALLY DIRECTING THE ISSUANCE OF AND AUTHORIZING AND APPROVING $16,630,000 [WHICH AMOUNT MAY BE INCREASED OR DECREASED BY AN AMOUNT NOT TO EXCEED TEN PERCENT (10%)] FIRST MORTGAGE REVENUE BONDS, (JUSTICE CENTER PROJECT), DESIGNATED IN SUCH SERIES AS DETERMINED BY THE FINANCIAL ADVISOR, OF THE WHITLEY COUNTY, KENTUCKY PUBLIC PROPERTIES CORPORATION; APPROVING AND AUTHORIZING A LEASE AGREEMENT WITH THE CORPORATION AND THE ADMINISTRATIVE OFFICE OF THE COURTS OF THE COMMONWEALTH OF KENTUCKY; DIRECTING THE APPROVAL OF A MORTGAGE DEED OF TRUST; AND, AUTHORIZING SUCH OTHER AGREEMENTS, INCLUDING A CONTINUING DISCLOSURE AGREEMENT, AND CERTAIN ACTIONS AND CERTIFICATES NECESSARY FOR THE ISSUANCE AND SALE OF THE BONDS.

In accordance with the provisions of KRS 350.055, notice is hereby given that Gatliff Coal Company, 200 Allison Blvd., Corbin, KY 40701, has applied for a permit for a surface coal mining and reclamation operation affecting 76.9 acres located approximately 1.5 miles northeast of Rockholds, Kentucky, in Whitley County.
The proposed operation is approximately 1.4 miles northeast of Colonel Hollow Road’s junction with Kentucky Route 26.and located on Bald Knob of King Mountain.
The proposed operation is located on the Rockholds U.S.G.S. 7 ½ minute quadrangle map. The operation will use the contour and area methods of surface mining. The surface area is owned by Donald and Barbara Shupe, Mike and Leslie Nantz, Alva J. Nantz, Carol and John Mize, and Gatliff Coal Company.
The application has been filed for public inspection at the Division of Mine Reclamation and Enforcement’s Middlesboro Regional Office, 1804 E. Cumberland Ave., Middlesboro, Kentucky 40965. Written comments, objections or requests for a permit conference must be filed with the Director of the Division of Mine Permits, #2 Hudson Hollow Complex, U.S. 127 South, Frankfort, Kentucky 40601.
PUBLIC NOTICE
Second Reading of a proposed Ordinance amending the Whitley County Budget for Fiscal Year 2009-2010, to include unanticipated receipts increasing / decreasing from the following funds, Gen, Road, Jail, LGEA, Ambulance, Forest, Occupational Tax, Tourism and 911 Funds in the amount of $ 962,771.00 and increasing / decreasing expenditures in the Gen, Road, Jail, LGEA, Ambulance, Forest, Occupational Tax, Tourism and 911 Funds in the amount of $ 962,771.00 will be held on 08/18/09 at 6:00 PM in the Whitley County Fiscal Court Room during the Regular Meeting. A copy of the proposed Ordinance with full text is available for public inspection at the Office of the County Judge Executive during normal business hours.

PUBLIC NOTICE
The annual financial statement of the County Treasurer required by KRS 424.220 has been prepared and accepted by the Whitley County Fiscal Court for the fiscal year ended June 30, 2009. Copies have been provided to each local newspaper of general circulation, each news service and local radio and television station which has on file a written request to be provided a statement.
The Whitley County Fiscal Court, pursuant to KRS 424.220 (8) chooses to however publish the auditor’s report for the fiscal year ended June 30, 2009.

ADVERTISEMENT FOR BIDS
Sealed Proposals for the following equipment will be received by the Whitley County Fiscal Court in the manner and on the date hereinafter specified for the proposed equipment for the Whitley County Road Department.
Specifications:
72 Horse Power, 2 Wheel Drive, Cab with A/C and Heat, Working / Road Lights, Tire Size: 9.5L-15 6 ply 16.9X30 6ply, Front 9.5L-15 SL F2 8 ply, Rear 13.6-38 RI 6 ply 12X4 Side shift transmission, 2 spool valve hyd. 2 Year 2000 hour total machine warranty, Delivered to Whitley County Road Dept. garage. Must be capable of operating RSM 48 side mounted bush hog.
Agency must submit their mailed bids or submit them to the Whitley County Judge Executive at the Whitley County Courthouse, P.O. Box 237, Williamsburg, Kentucky, on or before 2:00 p.m. local time on August 18, 2009, at which time bids will be opened and read aloud. Bids will then be presented to the Fiscal Court at the regular scheduled meeting at 6:00 p.m. on August 18, 2009. All bids shall be marked “Tractor Bid” on front of envelope.
Conflicts of interest, gratuities and kickbacks are defined in KRS 45A.445 and as provided for in KRS 45A.445 are absolutely prohibited.
No bidder may withdraw his/her bid for 90 days after the date the bids are opened. Any bid received after the time specified shall not be considered and will be returned unopened to the bidder.

Work is to be performed in accordance with plans, specifications, and addenda prepared by MURPHY GRAVES ARCHITECTS (ARCHITECT), MARCUM ENGINEERING (MECHANICAL AND ELECTRICAL ENGINEER), GEOTECH ENGINEERING & TESTING (CIVIL/STRUCTURAL ENGINEER), and WEE LANDSCAPE ARCHITECTS, INC. (LANDSCAPE ARCHITECT).
