NOTICE OF COMMISSIONER’S SALE
Pursuant to Judgment and Order of Sale entered by the Whitley Circuit Court on December 28, 2010, and a subsequent order entered May 9, 2011, I shall offer for sale at the Courthouse door in Williamsburg, Kentucky, at public action on Monday, August 8, 2011 at 12:00 p.m., or thereabout, the real property described in this Notice.
The judgment against the Defendants, Michael W. Hoskins and Jeanine E. Hoskins, plus costs, is as follows:
(1) The Defendants, Michael W. Hoskins and Jeanine E. Hoskins are indebted to the Plaintiff, Vanderbilt Mortgage and Finance, Inc., in the sum of $56,286.18, which includes the principal balance of $53,478.78, together with interest at the rate of 8.80% per annum from March 6, 2010, accrued interest through March 6, 2010 in the amount of $2,807.40; and amounts advanced by the Plaintiff for protection and preservation of the premises, all of which Vanderbilt Mortgage and Finance, Inc., shall have In Rem Default Judgment against the Defendants, Michael W. Hoskins and Jeanine E. Hoskins, in order to secure the sums above stated, together with interest and the costs of this action:
(2) There is a Clayton Mobile Home, Serial No. CLH030058TNAB included with the real property.
(3) The said real property is located in Whitley County, Kentucky and is more specifically described as follows:
Said property address is: 1540 Happy Hollow Road, Williamsburg, Kentucky 40769.
A certain tract or parcel of land lying and being on the S.W. side of Happy Hollow Road approximately 1.50 miles South of it’s junction with Ky. Hwy. 92, said junction being approximately 0.10 miles West of the junction of said Ky. Hwy. 92 and I-75 at exit 11, and being a portion of that property described in Deed Book 448, Page 638, being in Williamsburg, Whitley County Kentucky, bounded and described as follows to-wit:
Beginning at a 5/8”x20” steel rod and plastic cap stamped JDB LS 3409 set 50’ West of the approximate centerline of Happy Hollow Road, a new corner (from which a concrete R/W monument, parent tract corner, bears: N17-51-00W 80.73 feet), Thence running parallel to said approximate centerline; S17-51-00E 85.96 feet to a 5/8”x20” steel rod and plastic cap stamped JDB LS 3409 (set) on the South edge of a gravel driveway, Thence leaving said road and running new lines; S22-17-04W 379.16 feet to a 5/8”x20” steel rod and plastic cap stamped JDB LS 3409 (set) near the edge of said gravel driveway, S36-37-41W 145.48 feet to a 5/8”x20” steel rod and plastic cap stamped JDB LS 3409 (set) on the line of Tommy Gambrel (337/222), Thence leaving said Gambrel and running (2) two more new lines; N20-10-34W292.88 feet to a 5/8”x20” steel rod and plastic cap stamped JDB LS 3409 (set), N48-02-05E 410.51 feet to the point of beginning and containing 1.80 (one and eight-tenths) acres. All according to a survey performed by Blanton Land Surveying, James D. Blanton, KY. PLS#3409 in October 2004. All bearings referred to the 2004 magnetic meridian (random compass observation and angles turned therefrom). The tract or parcel described hereon is subject to any and all easements or rights of way, written or unwritten and may not be shown by this survey
Being the same property Michael Hoskins and his wife, Jeanine Hoskins obtained title to by Deed dated October 26, 2004, executed by Joshua Hoskins, Single, of record in Deed Book 456, Page 584, in the Office of the Whitley County Clerk.
TERMS OF SALE
1. The above property is indivisible and shall be sold as a whole to produce the sum of money so ordered to be made.
2. On the date of sale, the purchaser shall either pay cash or, with surety on a bond approved by the Commissioner, may pay (10%) down of the purchase price together with a bond (for the remainder of the purchase price) with good and sufficient surety, bearing interest from the day of the sale and payable to the Master Commissioner within thirty (30) days with interest at 12%. Signatures of principal and surety on the bond shall have the effect of a Judgment. In the event the Plaintiff or its representative is the purchaser, then, and in that event, it shall be entitled to a credit of its judgment against the purchase price and shall only be obligated to pay court costs, the fees and costs of the Master Commissioner and any real estate taxes payable pursuant to the judgment entered, and no payment shall be required and no bond shall be executed by them.
3. The risk of loss for the subject property shall pass to the purchaser on the date of sale. Possession of the premises shall pass to the purchaser upon payment of the purchase price and delivery of deed.
4. The purchaser shall be required to assume and pay all taxes or assessments upon the property for the current tax year and all subsequent years. All taxes or assessments upon the property for prior years shall be paid from the sale proceeds if properly claimed in writing and filed of record by the purchaser prior to payment of the purchase price.

The Whitley County Fiscal Court has received a $18177.00 grant from the Emergency Food and Shelter National Board Program for operation of local emergency food and shelter programs. The grant money will be allocated to nonprofit and government agencies that provide food and shelter to area residents. Existing agencies are encouraged to apply for the funds. The local board, made up of service organizations and local residents will review applications. Under the terms of the grant from the National Board, local governmental or private voluntary organizations chosen to receive funds must be nonprofit, have an accounting system and conduct an annual audit, and have demonstrated the ability to deliver emergency food and/or shelter programs. Commercial Area Development Infrastructure

Separate Sealed BIDS for the construction of Commercial Area Development Infrastructure will be received by the City of Williamsburg at Williamsburg City Hall, 423 Main Street, Williamsburg, KY 40769, until 2:00 PM (local time), August 3, 2011, and then publicly opened and read aloud.
The project consists of approximately 1,600 LF of 8” PVC waterline, 3,650 LF of 8” PVC gravity sewer, 680 LF of 10” PVC gravity sewer, 16 EA 48” diameter Precast Manholes, 3 EA 48” diameter Precast Drop Manholes, one aerial sewer creek crossing, tie-ins to existing lines and services, appurtenances associated with water and sewer construction, pavement repairs, testing and disinfection, and landscaping restoration and seeding.

Each Bidder must accompany his bid with a Bid Bond in amount of not less than five (5) percent of the base bid. No Bidder may withdraw his bid for a period of ninety (90) days. The Bidder awarded the contract shall execute a 100% Performance Bond and a 100% Payment Bond and shall furnish insurance as required, in the General Conditions. This contract shall be substantially completed within 90 calendar days, and fully completed within 120 calendar days after date of authorization to start work. Liquidated damages will be $500 per calendar day.

WHITLEY COUNTY TAXPAYERS
Kay Schwartz, Whitley County Clerk, pursuant to KRS 424.130, and the Whitley County Fiscal Court, announces that the 2010 Delinquent Real Property Tax Bills (Certificates of Delinquency) will be published in the News Journal Newspaper on July 27, 2011.
The list of Certificates of Delinquency is also available for public inspection during the hours of 7:30 am – 6:00 pm on Mondays and 7:30 am – 4:30 pm Tuesdays through Fridays, at the County Clerk’s office located at 200 Main St. {Courthouse} Room 2, Williamsburg, KY. This list may also be inspected on the Software Management, LLC website. The Uniform Resource Locater {URL} of the website is 174.141.82.110.
The tax sale will be held on August 26, 2011 beginning at 9:00 am. All interested participants must register with the County Clerk’s office by the close of business on August 16, 2011.
Please contact the County Clerk’s office if you need additional information about the tax sale registration process. Taxpayers can continue to pay their delinquent tax bills to the County Clerk’s office anytime prior to the tax sale. Some delinquencies – although they have been advertised – will be excluded from the tax sale in accordance with the provisions of KRS 134.504(10)(b).
