PUBLIC NOTICE OF BLASTING SCHEDULE
Mountainside Coal Co., Inc., 7692 South Highway 25W, Williamsburg, KY 40769; Phone: (606) 785-7277 proposes the following blasting schedule. The blasting site encompasses approximately 136 acres of contour surface mining located approximately located approximately 2.5 miles west of the community of Jellico Creek in Whitley County, and approximately 2.0 miles east of the community of Hollyhill, in McCreary County along KY Route 92 and KY Route 1673. The surface of the area on which blasting operations will be conducted is owned by George & Daisy Caddell, Bobby & Freda Mays, Donnie Patrick, Donald B. Patrick, Ronnie Patrick, Thomas & Inez Troxel, Paul & Delores Rowe, and White Lumber Sales, LLC.
Detonations of explosives are proposed to occur from sunrise to sunset Monday through Saturday. The blasting schedule is for a period from July 2013 to July 2014. Entry to the blasting area will be regulated by signs and barriers. A warning signal will be given, that consists of a one minute series of long blasts of a siren, sounded five (5) minutes prior to the blast signal. The blast signal will consist of a series of short siren blasts given one (1) minute prior to the detonation of the shot. A post-detonation all-clear signal, consisting of a prolonged siren signal, will follow the inspection of the blast site. When the permittee conducts an unscheduled blast, the permittee, using audible signals, shall notify all persons within one-half mile of the blasting site and document the reason for the unscheduled blast.
This notice is published pursuant to CFR 715.19 Surface Mining and Reclamation and Enforcement Provisions and KRS 350.220 and the regulations relating thereto. The Kentucky DMRE Permit Number is 918-0429.

An emergency ordinance amending the Whitley County Budget for Fiscal Year 2012-2013, to include unanticipated receipts increasing / decreasing from the General and Jail funds in the amount of $ 239,751.00 and increasing / decreasing expenditures from the General and funds in the amount of $ 239,751.00 was passed on 06/18/13. A copy of the Ordinance with full text is available for public inspection at the Office of the County Judge Executive during normal business hours.

TERMS OF SALE
1. The above property is indivisible and shall be sold as a whole to produce the sum of money so ordered to be made.
2. On the date of sale, the purchaser shall either pay cash or, with surety on a bond approved by the Commissioner, may pay one-third (1/3) down of the purchase price together with a bond (for the remainder of the purchase price) with good and sufficient surety, bearing interest from the day of the sale and payable to the Master Commissioner within thirty (30) days with interest at 12%. Signatures of principal and surety on the bond shall have the effect of a Judgment. In the event the Plaintiff or its representative is the purchaser, then, and in that event, they may take a credit upon its judgment against the purchase price and shall only be obligated to pay court costs, the fees and costs of the Master Commissioner and any real estate taxes payable pursuant to the judgment, and in that event, no payment shall be required and no bond shall be executed by them.
3. The risk of loss for the subject property shall pass to the purchaser on the date of sale. Possession of the premises shall pass to the purchaser upon payment of the purchase price and delivery of deed.
4. The purchaser shall be required to assume and pay all taxes or assessments upon the property for the current tax year and all subsequent years. All taxes or assessments upon the property for prior years shall be paid from the sale proceeds if properly claimed in writing and filed of record by the purchaser prior to payment of the purchase price.
5. The property shall be sold subject to the following:
a. Easements, restrictions and stipulations of record;
b. Assessments for public improvements levied against the following real estate;
c. Any facts which an inspection and accurate survey of the following described real estate may disclose.
6. If the property does not bring two-thirds of its appraised value, a one year right of redemption will exist pursuant to KRS 426.530.

Sealed proposal for the following work will be received by the Whitley County Fiscal Court in the manner, and the date hereinafter specified for the furnishing of all labor, materials, supplies, tools, equipment, services, etc., necessary for the repair and stabilization of Mountain Ash/Tackett Creek Road. The three locations the work is to be performed are: site number 1, mile marker .9, latitude 36.6747 and longitude -84.1197, site number 2, mile marker .8: latitude 36.6779 and longitude -84.1193, and site number 3, mile marker 1.7: latitude 36.6694 and -84.1262
Contractors must submit their sealed proposals to the Whitley County Judge Executive, at the Whitley County Courthouse, 210 Main Street, Williamsburg, Kentucky, on or before 2:00 p.m. local time on July 15th, 2013. Proposal envelopes or packages must be clearly marked Mountain Ash/Tackett Creek Stabilization, on the front of the envelope or package. At this time bids will be opened, and read aloud. Bids will be presented to, and awarded at the regular scheduled meeting, of the Whitley County Fiscal Court, which takes place at 6:00 p.m., on July 16th, 2013.
A mandatory pre-bid meeting will be held on Wednesday, July 1st, at 10:00 a.m. at the Whitley County Courthouse in the Fiscal Courtroom. All potential bidders must attend to be eligible to bid this project.

Contractor must provide proof of liability insurance, a bid bond equal to 10% of bid price, and a performance bond.
Cost estimates will be based on the installation of 4840 linear feet of steel, 2880 square feet of cribbing, 628 tons of #2 stone backfill, 69 tons of DGA shoulder stone, 857 square feet of type IV fabric, and the excavation of 536 cubic yards of dirt.
Scope of work to be performed: The steel will be installed into the bedrock to a depth no less than ½ the distance to the existing bedrock. Then the dirt will be excavated to a minimum of 8 ft. so panels can be attached to the installed steel. Type IV fabric will be installed, and #2 gravel will be placed in the annular space between the panel and roadway. A 6 inch layer of DGA will then be installed over the disturbed area to provide a smooth driving surface.
Conflicts of interest, gratuities, and kickbacks are defined in KRS 45A.445, and as provided for in KRS 45A.445 are absolutely prohibited.
No bidder may withdraw his/her bid for 90 days after the date the bids are opened. Any bid received after the time specified shall not be considered and will be returned unopened to the bidder.
