NOTICE OF INTENTION TO MINE
Pursuant to Application 918-0415, Renewal
In accordance with the provisions of KRS 350.055, notice is hereby given that D & H Coal Company of Laurel County, Inc., P. O. Box 1016, Williamsburg, Kentucky 40769 has applied for renewal of a permit for a surface coal mining and reclamation operation affecting 58.4 surface acres located 1.0 mile west of the community of Faber in Whitley County.
The proposed operation is approximately 0.1 mile northwest from the junction of KY Route 26 and Faber Corinth Road and located 0.3 miles west of Watts Creek. The proposed operation is located on the Wofford and Vox U.S.G.S. 7 ½ minute quadrangle maps. The operation will use the area, remining and auger methods of surface mining. The surface area is owned by Cumberland College and Carl & Virginia Smith.
This is the final advertisement of the application. All comments, objections or requests for a permit conference must be received within thirty (30) days of today’s date. The application has been filed for public inspection at the Division of Mine Reclamation and Enforcement’s Middlesboro Regional Office, 1804 E. Cumberland Ave., Middlesboro, Kentucky 40965. Written comments or objections must be filed with the Director, Division of Mine Permits, #2 Hudson Hollow Complex, U.S. 127 South, Frankfort, Kentucky 40601.
NOTICE OF BOND RELEASE
In accordance with the provisions of KRS 350.093, notice is hereby given that Monties Resources, LLC, 4184 S HWY. 25W Williamsburg, KY. 40769 has applied for a Phase I Bond Release on Increment No. 2 of Permit No. 918-0408 which was last issued on 3-10-2009. This application covers an area of approximately 12.58 surface acres located approximately 0.1 miles south of Corn Creek in Whitley County, Kentucky. The permit is approximately 0.4 miles southwest of Corn Creek McNeil Hollow Roads junction with State Route 1064 and located approximately 0.5 miles SE of Corn Creek Church.
A cash bond is now in effect for this increment in the amount of: $32,000.00. Approximately sixty (60%) percent of this total original bond amount of $32,000.00 is requested to be released in this request for a Phase One Bond Release.
As of April 9, 2010 Increment No. 2 had been backfilled and graded to the approved final slope configuration, with all surface disturbed areas seeded, and mulched.
Written comments, objections, and requests for a public hearing must be submitted to the Dept. for Natural Resources; Director, Division of Field Services, #2 Hudson Hollow, Frankfort, KY 40601, by 7-9-2010. A public hearing has been scheduled for 10:00 AM on 7-12-2010 at the Middlesboro Regional Office, 1804 E. Cumberland Ave. Middlesboro, KY 40965.
This hearing will be cancelled if the cabinet does not receive a request in writing for the public hearing by 7-9-2010.

In accordance with KRS 350.055, notice is hereby given that Alden Resources LLC
332 West Cumberland Gap Parkway, Suite 100, Corbin, Kentucky 40701 has applied for renewal of a permit for an underground coal mining operation located 2.0 miles northeast of Goins in Knox County and Whitley counties. The proposed operation will disturb 34.47 surface acres and will underlie 1,134.23 acres and the total area within the permit boundary will be 1,168.7 acres.
The proposed operation is approximately 3.3 miles east from KY Hwy. 92’s junction with Harpes Creek Road and located along Harpes Creek.
The proposed operation is located on the Frakes, KY 7½ minute quadrangle map. The surface area to be disturbed is owned by Gatliff Coal Company, Arnold T. Goins, Antony Greene, Alton Wilson, Lisa Fuson Brock, Freda Barnett and Cleveland Wilson Heirs. The operation will underlie land owned by Gatliff Coal Company, Arnold T. Goins, Alton Wilson, Begley Properties, LLC, Bryant Mahan, Jim Lambdin, Henry & Doris Lee, Leonard & Louise Lee, Lisa Fuson Brock, Ataya Hardwoods, Freda Barnett and Cleveland Wilson Heirs.
The application has been filed for public inspection at the Department for Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965-1229. Written comments, objections or requests for a permit conference must be filed with the Director, Division of Mine Permits, #2 Hudson Hollow, U.S. 127 South, Frankfort, Kentucky 40601.
ADVERTISEMENT FOR BIDS
Separate sealed bids for the construction of one (1) new single family dwelling will be received by Bell-Whitley CAA, Inc. at their office at 129 Pine St, Pineville, KY until 10:00 o’clock AM EST, June 7, 2010, and then at said office publicly opened and read aloud. Each bid must be labeled on the outside front cover as “Construction Project #5 2010 – Lot #35 Chestnut Hills.
The dwellings are described as:
• Construction Project #5 – One new lock and key complete 1185 sq. ft. three bedroom house to be located in Chestnut Hills Subdivision, Lot #35, Corbin, Kentucky. Successful bidder is responsible for site preparation, Termite Pre-treatment, paved parking area, utility hookups, and installation of septic system, and all permits.
The information for bidders, form of bid, form of contract, plans, specifications and other contract documents may be examined at 129 Pine St., Pineville, KY. Due to the limited availability of copies of the house plans, the plans will remain in the office and be available for review by potential bidders. The successful bidder must purchase one set of plans for $250 each for each house to be built.
The owner or agency reserves the right to waive any informalities or to reject any or all bids.
Attention of bidders is particularly called to the requirements as to conditions of employment to be observed and minimum wage rates to be paid under the contract. Further attention is directed to CABO Code 1995 Edition, the 2002 Kentucky Residential Code and the 2003 Kentucky Residential Code supplement, Model Energy Code 1992, Section 3, Segregated Facilities, Section 109, Executive Order 11246, Title VI, Minimum Design and Universal Design restrictions and requirements, Kentucky Housing Corporation’s requirements in addition to KRC, and any other applicable local, state, and federal laws.

VOLUNTARY ACQUISITION NOTICE
Bell-Whitley Community Action Agency, Inc. seeks to acquire land for home construction.
Whitley County and Bell-Whitley Community Action Agency, Inc. have established a Voluntary Acquisition Policy for the Whitley County CDBG-R Zero Energy Homes Project. This notice invites offers from property owners to be made to Bell-Whitley Community Action Agency.
The properties that Bell Whitley Community Action Agency wishes to acquire must be located in the Jellico Electric and Water service area, must have access to city water, must be unoccupied or vacant with minimal improvements and must have water service to the property. The properties will be utilized for the Whitley County CDBG-R Program sponsored by the Kentucky Department for Local Government for homebuyer activities. The terms and conditions of the sale will result in Bell Whitley Community Action Agency receiving unencumbered fee simple title to the property at the time of sale.
The owner of the vacant property will be required to waive relocation benefits as a condition of the sale. Whitley County will not invoke its powers of condemnation to secure any property offered if a mutually satisfactory sale is not concluded in order to acquire the property.

The Whitley County Board of Education will receive bids for construction of the above named project on June 22, 2010, at the Whitley County Board of Education, 300 Main Street, Williamsburg, KY 40769-1124 4’ floor until 2:00 PM EDT at which time and place all bids will be publicly opened and read aloud.
The Whitley County High School Addition & Renovation project consists of a new 23,845 square foot addition there will also be major renovation work to the existing facility. The project includes sitework, demolition, concrete, masonry, structural steel, mechanical, fire protection and electrical.

A Pre-Bid Meeting will be held June 4, 2010, at 10:00 A.M. EDT at Whitley County High School, 350 Boulevard of Champions Road, Williamsburg, KY 40769. This Prebid is not mandatory, however bidders are strongly encouraged to attend as this is a major renovation project. Any other site visits will have to be coordinated with the Construction Manager.
Bidding Documents, including Drawing and Specifications, may be obtained upon deposit of $ 260.00 per set cash or check, payable to Whitley County Board of Education. Deposit checks should be delivered to Lynn Imaging. After receipt of deposit by Lynn Imaging, documents may be picked up at Lynn Imaging, 328 E. Vine Street, Lexington, KY 40507, (859) 255-1021. If documents are to be mailed, shipping should be paid separately to Lynn Imaging.
Deposit will be returned upon receipt of Bidding Documents in good condition within ten days after bids are opened. If more than one set of Bidding Documents are desired, the cost of $260.00 per additional set must be remitted by separate check payable to Whitley County Board of Education. The deposits for additional sets will not be returned.
A certified check, payable to the Whitley County Board of Education, or a satisfactory Bid Bond executed by the bidder and acceptable sureties in an amount equal to 5% of the bid shall be submitted with each bid.
Successful bidders will be required to furnish and pay for satisfactory Performance and Labor and Material Payment Bonds. The bond shall cover the entire base bid cost and any accepted alternates.
Prevailing wage rates will apply to this Project.
The Owner reserves the right to reject any and all bids or to waive any informality in the bidding. Bids received after the scheduled closing time for the receipt of bids will be returned unopened to the bidders. Any bid not submitted on the proper form shall not be considered. No bid may be withdrawn for a period of sixty days subsequent to the opening of bids without consent of the Whitley County Board of Education.
The Form of Proposal and Proposal Envelope must be requested and obtained from the Construction Manager, Branscum Construction Company, Inc., Key Village Office Park, P.O. Interested material suppliers should contact the Construction Manager, Branscum Construction Company, Inc., for the names of Contractors who have expressed interest in the Bid Packages involved. Each Contractor must note that the Material Supplier Authorization letter (included with the Form of Proposal) for each supplier must be filled out, executed by the supplier, and submitted as part of the Bid, or within 24 hours or bids will be invalidated.
Bids MUST be submitted in triplicate. Bids must be submitted in the Bid Envelope supplied by the Construction Manager. If bids are to be mailed, enclose CM Envelope within Bidder’s Envelope and address to:
