Pursuant to a Judgment and Order of Sale entered by the Whitley Circuit Court on February 13, 2012, I shall offer for sale at the door of the Whitley County Judicial Center, (new courthouse), 100 Main Street, Williamsburg, Kentucky, at public auction on Monday, April 9, 2012, at 12:00 p.m., or thereabout, the real property described in this Notice.
The Judgment against the Defendant, Shanna Paul, plus costs, is as follows:
(1) The principal sum in the amount of $62, 164.88, plus interest on the principal sum at the rate of 5.125% per annum from March 1, 2010 until paid, plus the costs and fees of this action, plus reimbursement for attorney’s fees in this action, plus sums advanced in payment of ad valorem taxes, insurance premiums, winterization, or in preservation of the real estate, plus late fees, costs, attorney’s fees, and other advances made pursuant to the terms of the Note.

Angel, deceased as recorded in Deed Book 278, Page 470, Lodged For Record: March 10, 1979 and is more particularly described as follows:
Beginning at a survey marker set this survey at the base of a 40” Walnut on the Northwest side of Black Diamond Road, said survey marker being located N 47 degrees 14’ 40” W, 15.00 feet from the center line of said road; thence with the Northwest side of said road S 38 degrees 02’ 49” W, 191.53 feet to a found survey marker with a surveyors identification cap stamped “Ledington 3132” on the Northwest side of said road, said survey marker being a property corner common to Vincent A. Hoover and wife Toni Hoover, Deed Book 421, Page 204, Dated July 28, 2000; thence leaving said road and with the boundary line of said Hoover N 54 degrees 51’ 08” W. 120.43 feet to a found leaning iron pipe painted (3) three times located at the base of a 36” Pine tree; thence continuing with the boundary line of said Hoover N 15 degrees 47’ 19” E, 345.21 feet to a survey marker set this survey, a property corner common to said Hoover; thence leaving the boundary line of said Hoover severing the parent tract with the boundary division line S 78 degrees 39’ 10” E, 182.01 feet to a survey marker set this survey in the West Edge of a private gravel driveway, a property corner common to Lloyd Ridener and wife, Alene Ridener, Deed Book 420, Page 709. Dated November 6, 2000; thence with the boundary line of said Ridener, crossing said gravel driveway S 04 degrees 52’ 38” W, 78.27 feet to a 16” Walnut, a property corner common to said Ridener and also a corner of the parent tract; thence with the boundary line of said Ridener S 46 degrees 01’ 02” E. 92.58 feet to a survey marker set this survey near a 28” Pine tree on the North side of said Black Diamond Road, a property corner common to said Ridener; thence leaving the boundary line of said Ridener and with the North by Northwest side of said road with the following calls.
S 79 degrees 08’ 21” W, 31.32 feet; thence S 69 degrees 57’ 06” W, 34.73 feet; thence S 53 degrees 04’ 48” W, 32.82 feet; thence S 42 degrees 45’ 20” W, 23.05 feet to the beginning property corner containing 1.56 acres.
The above described tract or parcel of land is bounded on the North by Elizabeth Angel, Deed Book 278, Page 470, Lodged For Record: March 10, 1979 (To Be Conveyed), on the East by Lloyd Ridener and wife, Alene Ridener, Deed Book 420, Page 709, Dated November 6, 2000, on the South & Southeast by Black Diamond Road and on the Southwest & West by Vincent A. Hoover and wife, Toni Hoover, Deed Book 421, Page 204, Dated July 28, 2000.
All survey markers set this survey are 1/2” x 18” rebars with an orange surveyors identification cap stamped “G. Brock L.S. 558”.
All bearings in the above described tract or parcel of land were referenced to a survey and plat by Hi-Tech Engineering, Surveyor Harrison Smith. P.L.S. 3301. See plat titled “Map Showing The Property To Be Sold To Larry Ramsey, Canoe Branch Road, Corbin Whitley County, Kentucky.
The field work was started on August 10, 2002 and was completed on August 12, 2002.
Being the same property conveyed to Shanna Paul, a married person who acquired title by virtue of a deed from Alene Ridener, a single person, dated April 1, 2005, filed April 8, 2005, recorded in Deed Book 460, Page 308, County Clerk’s Office, Whitley County, Kentucky.

TERMS OF SALE
1. The above property is indivisible and shall be sold as a whole to produce the sum of money so ordered to be made.
2. On the date of sale, the purchaser shall either pay cash or, with surety on a bond approved by the Commissioner, may pay ten percent (10%) down of the purchase price together with a bond (for the remainder of the purchase price) with good and sufficient surety, bearing interest from the day of the sale and payable to the Master Commissioner within thirty (30) days with interest at 12%. Signatures of principal and surety on the bond shall have the effect of a Judgment. In the event the Plaintiff or its representative is the purchaser, then, and in that event, they may take a credit upon its judgment, and in that event, no payment shall be required and no bond shall be executed by them.
3. The risk of loss for the subject property shall pass to the purchaser on the date of sale. Possession of the premises shall pass to the purchaser upon payment of the purchase price and delivery of deed.
4. The purchaser shall be required to assume and pay all taxes or assessments upon the property for the current tax year and all subsequent years. All taxes or assessments upon the property for prior years shall be paid from the sale proceeds if properly claimed in writing and filed of record by the purchaser prior to payment of the purchase price.
