NOTICE OF APPLICATION FOR RECLAMATION DEFERMENT
In accordance with 405 KAR 16:020, notice is hereby given that Mountainside Coal Co., Inc., 7692 S. HWY 25W, Williamsburg, KY 40769 has applied for a coal marketing reclamation deferment for its surface coal mining and reclamation operation, permit number 918-0465. Deferment of reclamation is being requested for approximately 1.8 acres which is owned by TKY Acquisitions (Surface), Corrigan TLP LLC (Surface), and Ed Jones (Surface). The operation for which the deferment is being requested is located 2.4 miles northeast of the community of Siler and 1.8 miles north of the confluence of Harpes creek and Puncheon branch in Whitley County. The permit area is approximately 1.16 miles north of the intersection of Puncheon Branch Road and Harpes Creek road. The latitude is 36° 41’ 51” N and the longitude is 83° 55’ 33”W.
The deferment is being sought due to a coal marketing problem and is being requested for an initial period of six (6) months. The deferment may be renewed for additional periods up to a maximum of 30 months.
The application has been filed for public inspection at the Department for Natural Resources Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965. Written comments or objections must be filed within ten (10) days of this notice with the Director, Division of Permits, #2 Hudson Hollow, U.S. 127 South, Frankfort, Kentucky 40601.
NOTICE OF PUBLIC HEARING
Notice is hereby given that the City of Williamsburg, Kentucky (the “Issuer”), will hold a public hearing to be conducted by its City Council, at a meeting to be held on Monday, March 9, 2015, at 5:00 p.m. Eastern time, in the City Hall, Main and Fifth Streets, Williamsburg, Kentucky, regarding the proposed issuance by the City of its City of Williamsburg, Kentucky Educational Facilities Revenue Improvement Bond, Series 2015 (University of the Cumberlands, Inc. Project), in the principal amount of $10,000,000 (the “Series 2015 Bond”). The net proceeds of the Bond will be loaned to the University of the Cumberlands, Inc. (the “University”), a nonprofit Kentucky corporation, institution of higher education and 501(c) (3) organization, in order to finance the costs of, and to reimburse the University for costs already incurred in connection with, the acquisition of parcels of real property and improvements described below. The University will loan a portion of the net proceeds of the Bond to Cumberland Wellness Properties, Inc. (“CWP”), a nonprofit Kentucky corporation and 501(c) (3) organization which exists to provide support and assistance to the University, to finance the costs of, and to reimburse CWP for costs already incurred in connection with, the acquisition of certain parcels of real property and certain improvements as described below.
The project to be funded with proceeds of the Bonds involves the redevelopment and expansion of the University’s sport facilities and the expansion of the University’s wellness center. Certain components of this redevelopment and expansion will be owned by CWP; in particular, land for the University’s new entry boulevard (2nd Street and Rant Street, Williamsburg, Kentucky 40769), land in front of the football stadium (81 Rant Street, Williamsburg, Kentucky 40769), and parking improvements and stadium and field improvements (225 South 10th Street, Williamsburg, Kentucky 40769). The University will loan approximately $8,270,000 of Bond proceeds through a New Markets Tax Credit (“NMTC”) transaction, which amount will ultimately flow through the NMTC structure to CWP, to be used by CWP to pay or provide reimbursement for the costs of these improvements and to pay costs of issuance. The improvements will be leased by CWP to the University for its use.
The balance of the proceeds of the Bond (approximately $1,730,000) will be used by the University to pay or provide reimbursement for the costs of improvements to and equipping of the wellness center on the University campus (815 Cumberland Avenue, Williamsburg, Kentucky 40769) and to pay costs of issuance. The expansion of the wellness center involves a 15,000 sq. building addition which will include exercise rooms, health education rooms and community service space for seminars, training and public involvement; and improvements to the attached student center with upgrades to the post office, bookstore and HVAC/Electrical.
The public hearing with respect to the issuance of the Series 2015 Bond is being held pursuant to section 147[f] of the Internal Revenue Code of 1986, as amended.
THE BOND AND THE INTEREST THEREON SHALL NEVER CONSTITUTE A GENERAL OBLIGATION OR INDEBTEDNESS OF THE CITY OF WILLIAMSBURG, KENTUCKY (THE “ISSUER”) OR THE COMMONWEALTH WITHIN THE MEANING OF THE CONSTITUTION AND LAWS OF THE COMMONWEALTH AND SHALL NOT CONSTITUTE NOR GIVE RISE TO A CHARGE AGAINST THE GENERAL CREDIT OR TAXING POWER OF THE ISSUER OR THE COMMONWEALTH, BUT SHALL BE A LIMITED OBLIGATION OF THE ISSUER, PAYABLE SOLELY FROM PAYMENTS TO BE MADE BY THE UNIVERSITY OF THE CUMBERLANDS, INC. AND CUMBERLAND WELLNESS PROPERTIES, INC.
Interested persons who wish to express their views, either orally or in writing, concerning the proposed issuance of the Bond or the location and nature of the facilities proposed to be financed or refinanced will be given the opportunity to do so at the above-stated time and place.
