The Kentucky Department of Parks has a 1987 white garbage truck that will be sold at Cumberland Falls State Resort Park in Corbin, Kentucky via a sealed bid process at 12:00 p.m. (noon – EST), Wednesday, December 9, 2009. Any questions should be directed to Lisa Davis or Donna Loudermilk at 606-528-4121. Appointments to view should also be made with Ms. Davis or Ms. Loudermilk.
The sealed bid process will be used as stated above to liquidate this item. No minimum bid is necessary. Bids will be accepted until 12:00 noon p.m. (EST) December 9, 2009, in the business office at the park.
The highest awarded bidder will be contacted that afternoon and will have until noon, Wednesday, December 23, 2009, to remove the garbage truck from park premises. All bids must be submitted in writing and hand delivered OR mailed to:

CITY OF WILLIAMSBURG ORDINANCE NO. 09-003
AN ORDINANCE ESTABLISHING REQUIREMENTS AND RESTRICTIONS ON OPERATION OF GARAGE SALES/YARD SALES, SETTING FEES, PROVIDING FOR PENALTIES AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY OF WILLIAMSBURG, KENTUCKY, AS FOLLOWS:
WHEREAS, the City Council recognizes that a city’s residential areas are a source of civic pride to homeowners, home renters and home buyers alike, and;
WHEREAS, as a matter of public policy the City Council aims to preserve, enhance and perpetuate the economic value and the residential character of the city’s neighborhoods in part by regulating garage sales/yard sales, and that such preservation promotes and protects the health, safety, comfort, economic investment, and general welfare of the people living in Williamsburg, and;
WHEREAS, this ordinance specifically seeks to achieve the following goals:
•To protect residential areas from the permanent encroachment of commercial uses;
•To limit the proliferation of unsightly signs and signage structures;
•To protect the aesthetic qualities of neighborhoods;
•To ensure the harmonious and orderly operation of garage sales/yard sales in residential areas.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WILLIAMSBURG, KENTUCKY, THAT THE FOLLOWING REGULATIONS ARE HEREBY ESTABLISHED WITH THE CITY OF WILLIAMSBURG.
SECTION ONE: Definitions.
a) Garage sale/yard sale: An organized sale for the purpose of disposing of tangible personal property that is open or advertised to the public conducted from or at a residence (single-family, duplex or apartment) or within any area zoned residential, and includes the sale of more than five (5) specific items of tangible personal property. Garage sales/yard sales shall not include sales on commercial or vacant lots.
b) Residence: Any single-family structure or multi-family complex, which may be owned, rented or leased.
c) Garage sale/yard sale operator: Any person operating a garage sale/yard sale.
d) Person: Includes individuals, partnerships, voluntary associations and corporations.
e) Personal property: Property which is owned, utilized, and maintained by an individual or members of his or her residence and acquired in the normal course of living in or maintaining a residence.
f) Charitable/non profit organization: An organization qualifying as a nonprofit under Section 501 (c) of the Federal Income Tax Code of the Kentucky Nonprofit Corporation Act.
SECTION TWO: Display of signs.
a) No signs shall be exhibited more than two days prior to the sale, and shall be removed 24 hours upon expiration of the garage sale/yard sale. The person or persons exercising ownership or leasehold rights over property on which a garage sale/yard sale is held or advertised to be held shall be presumed to have placed and exhibited the sign advertising the garage sale/yard sale that identifies the person’s address or location at which the garage sale/yard sale is to be held. This presumption may be rebutted by evidence to the contrary.
b) Garage sale/yard sale signs may be posted on city property, or on private property with the express permission of the property owner. Garage sale/yard sale signs shall not be mounted upon or attached to any utility pole, traffic sign or street sign or other public device or structure. Signs must be securely staked or otherwise secured.
c) A garage sale/yard sale operator shall remove all signs within 24 hours after expiration of the garage sale/yard sale. Violators of this section are subject to a fine of $25.00 for each day past the deadline for removing signs.
SECTION THREE: Exception for churches, charitable and nonprofit organizations.
Any church, charitable or nonprofit organization may hold a maximum of twelve (12) garage sale/yard sales per year provided:
a) The church or organization does not hold more than one (1) garage sale/yard sale per month.
b) The sale must be conducted on the church or organization’s property, with permission from organizations.
c) None of the net earnings of a garage sale/yard sale shall inure to a shareholder or other individual.
SECTION FOUR: That any violation of the terms of this ordinance shall be deemed a misdemeanor and, upon conviction thereof, any person so violating same shall be fined a sum of $25.00 for each offense and each day violation shall constitute a separate offense. This fine shall be in addition to any court costs,
SECTION FIVE: This ordinance shall be in full force and effect after passage and publication as required by law.

CITY OF WILLIAMSBURG ORDINANCE NO. 09-004
ORDINANCE RELATING TO HARBORING, REGISTRATION, REGULATION, AND SAFETY OF DOMESTICATED ANIMALS, I.E. DOGS AND CATS, BY THE OWNERS OR CUSTODIANS AND REPEALS ORDINANCE NO. 07-001 RELATING TO THE FINES-ANIMALS RUNNING AT LARGE.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WILLIAMSBURG, KENTUCKY, that:
SECTION 1: Registration of Animals and/or Pets.
A. It shall be unlawful for any person or group to keep, harbor or own any animal and/or pet within the City limits of Williamsburg without a current vaccination tag for rabies.
B. It shall be the duty of the keeper, harborer, or owner of the animal(s) and/or pet(s) to have vaccination for rabies by an approved veterinarian.
C. Persons bitten by dogs or other animals are to be reported to the local health department within 12 hours.
SECTION 2: Public Nuisance Prohibited.
A. Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
Habitually: three or more times during any one 30-day period.
Keep or Harbor: to habitually allow the dog or animal to lodge or to be fed within a person’s home, yard, building or enclosure, or on his/her premises.
B. No person shall keep, harbor, or own any dog which shall do any one or more of the following objectionable actions, each of which is hereby declared to be a public nuisance:
1. Incessantly barks, howls, yelps or whines loud enough to be heard beyond the premises where it is kept or harbored.
2. Habitually goes upon any property or premises not owned or occupied by the person who keeps, harbors, or owns said animal.
3. Habitually turns over or invades garbage cans, damages shrubbery, lawns, and items of personal property located on any premises other than those that own, keep, or harbor said animal.
4. When not on property of its keep or owner, habitually runs at, jumps upon, chases, barks at, bites at, or any way frightens, molests, or scares any child or adult other than the one who keeps, harbors, or owns said animal and members of immediate family.
5. Chases, attacks or kills any other animal/livestock besides those owned by the person who keep, harbors, or owns said animal.
6. Bites any person on sidewalks, streets, or any property other than that of the keeper, harborer, or owner.
SECTION 3: Restrained Dogs.
No person shall keep, harbor, or own any dog, either licensed or unlicensed, which is not restrained at all times by:
A. Being confined on his own premises within an enclosure; or
B. Being firmly secured by means of collar and chain or leash or other device so that the dog cannot stray from its owner’s custody or from the premises on which it is secured; or
C. Being in the immediate control of its owner, custodian, or possessor.
SECTION 4: Impounding of Animals and/or Pets.
A. Any animal and/or pets without a proper and current vaccination tag as ordained in Section 1 or any animal and/or pet which has committed any one or more of the nuisances defined in Section 2 or any animal and/or pet which is running unrestrained as described in Section 3 may be taken up and impounded at any time by those persons officially appointed by the Whitley County Fiscal Court to serve as animal control officers or by any peace officer of this city, county, or state. Additionally, the owner, custodian, or possessor of such animal and/or pet may be cited to appear in court to answer charges of violation of this subchapter and shall be subject to the penalties stipulated in this chapter.
B. For the purpose of discharging the duties imposed by this subchapter and to enforce its provisions, any animal control officer appointed by the Whitley County Fiscal Court or peace officer is empowered to enter upon premises on which the animal and/or pet is kept or harbored to request the exhibition of such animal and/or pet to take it for impounding.
C. It shall be the duty of all peace officers within the City of Williamsburg to support and aid the Animal Control Officer(s) in their duties when called upon, and this shall include the issuing of a summons to the keeper, harborer, or owner of any animal and/or pet whether licensed or unlicensed, which has been permitted to be a public nuisance as defined in Section 2, or at large as in Section 3.
D. Impoundment shall be at Knox-Whitley Animal Shelter, or any other place that meets the specifications of the Humane Society.
E. Immediately after impounding of animal, the Animal Control Officer shall make every possible effort to notify the owners whereby they may regain custody of such animal.
F. Animals and/or pets shall be confined in a humane manner under the supervision of the Knox-Whitley County Animal Shelter or the Whitley County Humane Society.
SECTION 5: Reclaiming or Purchasing Impounded Animals.
A. Any animal and/or pet may be reclaimed by its keeper, harborer, owner by the rules and regulations of the Knox-Whitley County Animal Shelter.
B. An unclaimed animal and/or pet shall also fall under rules and regulations of same facility.
SECTION 6: Enticing Animal and/or Pet from Owner.
A. It shall be unlawful for a person to entice an animal from the yard or enclosure of its keeper or owner, causing it to be impounded.
SECTION 7: Animal Waste.
A. Failure to keep an animal and/or pet’s pen, yard, lot or other enclosure in a sanitary condition and free from preventable offensive odors is unlawful and shall be declared a nuisance.
B. The owner or custodian of every animal and/or pet shall contain and remove any excrement deposited by their animal(s) on public walks, streets, recreation areas, or private property belonging to another within the city limits of Williamsburg.
1. It is the duty and responsibility of each animal and/or pet owner to custodian to remove and dispose immediately any animal and/or pet excrement in any area described above.
2. Any excrement not removed is declared a public nuisance.
SECTION 8: Penalties.
A. Any person, firm or organization violating any provision of this chapter, including permitting their animal and/or pet to be a nuisance, shall be fined $25.00 for each offense, with each day’s violation being considered a separate offense, and this penalty shall be in addition to any court costs if any should occur.

Pursuant to Application No. 918-0408 Amendment No. 1
In accordance with KRS 350.070, notice is hereby given that Monties Resources, LLC, 4184 S HWY 25W Williamsburg, KY. 40769 has applied for an amendment to an existing surface coal mining and reclamation operation located 0.1 mile south of Corn Creek in Whitley County. This amendment will add 21.41 acres of surface disturbance and will underlie and additional 40.52 acres making total area of 190.07 acres within the amended permit boundary.
The proposed amendment area is approximately 0.4 mile southwest of Corn Creek McNeil Hollow Road’s junction with State Route 1064 and located approximately 0.5 mile SE of Corn Creek Church.
The proposed Amendment is located on the Corbin & Rockholds U.S.G.S. 7 1/2 Minute Quadrangle Map. The surface area to be disturbed by this amendment is owned by; Joy Likins & James Roy Fox and Monties Resources, LLC. The amendment will underlie land owned by Monties Resources, LLC. The operation will use the; Contour and Auger methods of Mining.
The amendment application has been filed for public inspection at the Department for Natural Resources; Middlesboro Regional Office, 1804 E. Cumberland Ave. Middlesboro, KY 40965. NOTICE OF INTENTION TO MINE
Pursuant to Application 918-0420, Transfer
In accordance with 405 KAR 8:010, notice is hereby given that Buried Sunshine Transport, Inc., P.O. Box 1006, Williamsburg, KY 40769, intends to transfer its permit number 918-0396 to Engle Hollow Mining, LLC, 3411 Cumberland Falls Highway, Corbin, KY 40701. The new permit number will be 918-0420. This permit is for an auger mining operation. The permit area is located 2.5 miles east of Rockholds in Whitley County, Kentucky. The proposed permit area will disturb 22.3 surface acres and underlie 23.7 acres, for a total area within the permit boundary of 46.0 acres.
The proposed operation is located approximately 0.3 miles northeast of Tyes Ferry Road’s junction with Gail Hart Road and located 0.1 miles East of Bays Hollow.
The proposed operation is located on the Rockholds U.S.G.S. 7 1/2 minute quadrangle map. The permit surface area to be disturbed is owned by Jeff Canada and Thomas Mason Jr. The auger area will underlie land owned by Jeff Canada and Thomas Mason Jr.
The application has been filed for public inspection at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 Cumberland Ave., Middlesboro, Kentucky 40965.

Pursuant to a Judgment and Order of Sale entered by the Whitley Circuit Court on August 10, 2009, and subsequent Order entered on November 9, 2009, I shall offer for sale at the Courthouse door in Williamsburg, Kentucky, at public auction on Monday, December 14, 2009, at 12:00 p.m., or thereabout, the real property described in this Notice.
The judgment against the defendant, George Allen Snelson, plus costs, are as follows:
(1) The principal sum in the amount of $74,756.78 plus interest from 10/1/08 through 6/5/09 in the amount of $3,799.28 plus advancements for the protection of the property, including taxes and insurance (negative escrow) in the amount of $245.30 plus attorney fees (KRS 411.195) in the amount of $1,100.00 for a total in the amount of $79,901.36.

Being all the same property conveyed to Virginia M. Collins, a unmarried person from Eldon David Jr., and Nancy Davis husband and wife and Barbara Ann Hall and Kenny Hall, wife and husband, Thomas G.
