NOTICE OF INTENTION TO MINE

In accordance with KRS 350.055, notice is hereby given that Nally & Hamilton Enterprises, Inc., P. O. Box 157, Bardstown, KY 40004, has applied for renewal of a permit for a surface coal mining and reclamation operation affecting 503.80 acres located 4.61 miles southwest of Kayjay in Bell, Knox and Whitley Counties. The area is approximately 3.21 miles east from Hwy 92’s junction with Hwy 904 near the Goins community. The nearest stream is Long Fork.
The operation is located on the Frakes and Kayjay U.S.G.S. 7 1/2 minute quadrangle maps. The operation will use the area, contour strip and auger methods of surface mining. The surface area owner is Penn Virginia Resource Partners, L.P., 1 Cloverleaf Square, Suite E-3, Big Stone Gap, VA 24219.

NOTICE OF BOND RELEASE
In accordance with KRS 350.093, notice is hereby given that Alden Resources LLC, 332 West Cumberland Gap Parkway, Suite 100, Corbin, KY 40701, has filed for a Phase I Bond Release on Increments No. 1, 2, 3, 4, 5, 6, 7, 8, and 9 of permit number 918-0445 which was last issued on April 02, 2012. The application covers an area of approximately 340.1 acres located 2.26 miles south of the junction of Gatliff Road with KY 904 near the head of Patterson Creek south of Nevisdale in Whitley County, KY. The latitude is 36°39’32”. The longitude is 84°02’37”.
The bonds now in effect are as follows:
Increment One (1) is a Surety Bond in the amount of $45,900.00. Approximately 60% of the original bond amount of $45,900.00 is included in this application for release. Increment Two (2) is a Surety Bond in the amount of $50,500.00. Approximately 60% of the original bond amount of $50,500.00 is included in this application for release. Reclamation work performed includes: Backfilling, re-grading, topsoil replacement, and drainage control including soil preparation and initial seeding and mulching in accordance with the approved reclamation plan, completed September 2011.

A public hearing on the application has been scheduled for January 2, 2013 at 10:00 am at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, KY 40965-1229. The hearing will be cancelled if no request for a hearing or informal conference is received by December 28, 2012.

In accordance with KRS 350.055, notice is hereby given that Mountainside Coal Co., Inc.; 7692 South Hwy. 25W; Williamsburg, Kentucky 40769 has applied for a permit for a surface coal mining and reclamation operation affecting 402.8 acres of surface disturbance with auger operations underlying 167.0 acres, for a total of 569.8 acres. The proposed operation is located 1.7 miles northwest of the Community of Permon in Knox and Whitley Counties, Kentucky.
The proposed operation is approximately 1.6 miles northeast from HWY 1418’s junction with HWY 511 and located approximately 0.4 miles north of Cotton Creek. The Latitude is 36°48’52”N. The Longitude is 84°00’53”W.
The proposed operation is located on the Barbourville & Rockholds U.S.G.S. 7½ minute quadrangle maps. The operation will use the Contour and Auger methods of mining. The surface area is owned by Robert Brown & Kathy Brown, Jack & Sue Clark, Tommy Gambrel, Hubert Grant & Arnold David Grant, Ray & Geneva Hill, Venda S. In accordance with KRS 350.070 notice is hereby given that Alden Resources LLC 332 West Cumberland Gap Parkway, Suite 100, Corbin, Kentucky 40701 has applied for an amendment to an existing surface coal mining and reclamation operation located 0.5 miles north of Perkins in Whitley County. The amendment will add 34.87 acres of surface disturbance and 27.61 acres of auger area making a total area of 62.48 acres within the amended permit area.
The proposed amendment area is approximately 0.9 miles east from Maple Creek Road’s junction with Brown Creek Road.
The proposed amendment is located on the Rockholds, KY 7½ minute quadrangle map. The operation will use the contour and auger method of surface mining. The surface area to be disturbed by the amendment is owned by Ella Baker Heirs, Charles Paul, and Samuel McFarland.
