NOTICE OF NONCOMPLIANCE
Pursuant to KRS 65A.040, the Kentucky Department for Local Government hereby gives public notice that Woodbine Volunteer Fire Rescue Department, Incorporated is in violation of Kentucky law for failure to comply with the reporting requirements of KRS 65A.020. The point of contact for Woodbine Volunteer Fire Rescue Department, Incorporated is Rick Fore who may be reached at (606) 344-8775 and/or Post Office Box 247, Woodbine 40771. The board members are Brandi Baird, Clarence Eaton, Harold Barton Sr., Phillip ‘BRIAN’ Sluss, Rickie Fore. The Auditor of Public Accounts has been notified. Any state funding for this entity will be withheld until further notice. The Department for Local Government encourages this entity to comply with the law.
ORDINANCE NO. 15-004
AN ORDINANCE RELATING TO CLOSING THE ENTRANCE FROM CARDINAL HEIGHTS TO CEMETERY ROAD IN THE CITY OF WILLIAMSBURG, KENTUCKY
WHEREAS, the residence of Cardinal Heights have requested for the safety of their neighborhood that the outlet onto Cemetery Road will be closed and it being in the best interest of the citizens of the City of Williamsburg, Kentucky;
NOW THEREFORE BE IT ORDAINED BY THE CITY OF WILLIAMSBURG, KENTUCKY, as follows:
That the northern entrance to Cardinal Heights where it connects to Cemetery Road in the city limits of the City of Williamsburg, Kentucky shall be closed.
This Ordinance shall take affect after its passage and upon publication.

NOTICE OF BOND RELEASE
In accordance with KRS 350.093, notice is hereby given that Mountainside Coal Co., Inc., 7692 S. HWY 25W, Williamsburg, KY 40769 has applied for a Phases I Bond Release on Increment 1 of Permit #918-0465, which was last issued on May 13, 2015. The application covers an area of Approximately 150.7 acres of surface area located 2.4 miles northeast of the community of Siler and 1.8 miles north of the confluence of Harpes creek and Puncheon branch in Whitley County. The permit area is approximately 1.16 miles north of the intersection of Puncheon Branch Road and Harpes Creek road. The latitude is 36° 41’ 51” N and the longitude is 83° 55’ 33”W.
The bond now in effect on Increment 1 is a Letter of Credit for $4,000.00, and $6,000.00 by the Kentucky Reclamation Guaranty Fund. The required bond amount for increment 1 is $373,400.00. In accordance with an Agreed Order between The Kentucky Energy and Environmental Cabinet, Department for Natural Resources and Mountainside Coal Co., Inc., the remainder of the bond after Phase 1 bond release (approximately $150,000.00) will be posted by Mountainside Coal Co., Inc.
Reclamation work performed includes: Backfilling, grading, fertilizing, seeding and mulching.

Notice of Bond Release
In accordance with KRS 350.093, notice is hereby given that Clear Energy Corporation, P.O. Box 1385 Lafollette, TN. 37766 has applied for a Phase I Bond Release on increment no.’s 1 and 2 of Permit 918-0446 which was last issued on April 06, 2015. The application covers an area of approximately 80.8 acres located 1.2 miles Northeast of the community of Rockholds in Whitley County, Kentucky.
The permit area is approximately 1.1 miles Northeast of Watts Creek and 1.0 miles Northeast of Colonel Hollow Road’s intersection with Highway 26. The latitude is 36 degrees, 50 minutes and 34 seconds. The longitude is 84 degrees, 06 minutes and 17 seconds.
The bonds now in effect are as follows:
Increment one (1) is a Surety Bond in the amount of $75,000.00. Approximately 60% of the original bond amount is included with this application. Increment two (2) is a Surety Bond in the amount of $301,600.00. Approximately 60% of the original surety bond amount is included with this application.
Reclamation work performed includes: Backfilling, grading and re-grading, drainage control including initial seeding and mulching of disturbed and graded areas in accordance with the approved reclamation plan that was completed on July 10, 2015.

NOTICE OF BLASTING SCHEDULE
PERMIT NO. 918-0462
In accordance with the provisions of 405 KAR 16:120 Section 3, Investment Energy LLC., PO Box 174, Gray, Kentucky 40734, Phone (606) 622-0464, proposes the following blasting schedule. The blasting site consists of approximately 13.56 acres located in Whitley County approximately 1 mile north of Mountain Ash and 1.2 miles north of the intersection of US 25w and Old Mountain Ash Road. Detonations of explosives are proposed to occur from sunrise to sunset Monday thru Saturday. The blasting schedule is for the period from 11/07/2015 to 11/07/2016. Entry to the blasting area will be regulated by people, signs and barriers. An authorized company representative will prohibit access to the blasting area by unauthorized persons at least 10 minutes prior to each detonation. Warning signals will be given by a siren and shall be audible at least one-half mile from the blasting area. These signals are:
WARNING SIGNAL – a one minute series of long blasts five minutes prior to the blast signal
BLAST SIGNAL – a series of short blasts one minute prior to the shot
ALL CLEAR SIGNAL – a prolonged blast following inspection of the blast area
Events which could necessitate blasting at unscheduled times include but are not limited to rain, lightning, other atmospheric conditions, or deteriorated explosives which involve personnel, operational, or public safety. Residents within one-half mile will be notified of an unscheduled blast by going to the residences and telling them of the unscheduled blast.
NOTICE OF BOND RELEASE
In accordance with KRS 350.093, notice is hereby given that Mountainside Coal Co., Inc., 7692 S. HWY 25W, Williamsburg, KY 40769 has applied for a Phase II Bond Release of Increments 2 and 3 on Permit #918-0464, which was last issued on March 19, 2014. The application covers an area of approximately 173.7 acres located 1.5 miles northwest of Frakes, KY in Whitley County.
The permit area is approximately 0.8 miles northeast from Mud Creek Road’s junction with KY 1595 and located along Doolin Branch. The latitude is 36° 39’ 08”. The Longitude is 83° 57’ 16”.
The bond now in effect on Increment 2 is Letters of Credit No. LC8011560 in the amount of $5,000.00 and NO. LC8010389 in the amount of $93,700.00. The bond now in effect on increment 3 is a Letter of Credit No. LC8010389 in the amount of $31,100.00.
Reclamation work performed includes: backfilling, grading, fertilizing, seeding and mulching, completed in November of 2012.
Written comments, objections or requests for a public or informal conference must be filed with the Director, Division of Field Services, #2 Hudson Hollow, Frankfort, KY 40601, by December 18, 2015.
A public hearing on the application has been scheduled for 9:00 AM on December 21, 2015, at the Division of Mine Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, KY 40965-1229. The hearing will be cancelled if no request for hearing or informal conference is received by December 18, 2015.
PUBLIC NOTICE
An ordinance amending the Whitley County Budget for Fiscal Year 2015-2016, to include unanticipated receipts increasing/decreasing from the Road Fund in the amount of $473,647.00 and increasing/decreasing expenditures from the Road Fund in the amount of $476,647.00 was passed on 10/20/15. A copy of the Emergency Ordinance with full text is available for public inspection at the Office of the County Judge Executive during normal business hours.
