ORDINANCE 2022-02

AN ORDINANCE PURSUANT TO KRS 67.083(3)(j) AND (x) GRANTING FIRESTONE INDUSTRIAL PRODUCTS COMPANY, LLC, A WAGE ASSESSMENT REBATE AND SPECIFYING THE COMPANY’S PERFORMANCE OBLIGATIONS.

WHEREAS, Firestone Industrial Products Company, LLC (hereinafter referred to as “Firestone”), has expressed an interest in expanding its manufacturing operation within the boundaries of Whitley County, Kentucky (hereinafter referred to as “County”); and

WHEREAS, KRS 67.083(3)(j) empowers the Whitley County Fiscal Court to cause the facilitation of the construction and redevelopment of commercial, industrial and service facilities in urban or rural areas;

WHEREAS, KRS 67.083(3)(x) empowers the Whitley County Fiscal Court to carry out governmental functions necessary for the operation of the County, including the authority to enact ordinances and appropriate funds for the promotion of economic development of the county,) directly or in cooperation with public or private agencies.

NOW, THEREFORE, be it ORDAINED by the Whitley County, Kentucky Fiscal Court as follows:

Section 1. As consideration for and an inducement to the construction and expansion of its manufacturing facility within Whitley County, Kentucky, the Whitley County, Kentucky Fiscal Court does hereby authorize and grant to Firestone, for its creation and continuous maintenance of at least two hundred and fifty (250) new full-time jobs within five (5) years within Whitley County, Kentucky, a wage assessment equivalent to 0.25% of Whitley County, Kentucky’s occupation license fee payable by the company’s new, permanent, full-time employees (excluding contract or temporary employees) as a result of this approved economic development project, which assessment shall be recovered by rebate from Whitley County, Kentucky, and shall exist for a period of five (5) years from the final activation of the project or until Firestone recovers a total wage assessment rebated from Whitley County, Kentucky, in an amount not to exceed $115,625.00, whichever comes first.

Section 2. By acceptance of this grant, Firestone agrees to the following provisions for its job creation performance:

1. Nature of Performance: The grant of the wage assessment specified in Section 1. of this Ordinance is based solely upon Firestone’s job creation performance; and Firestone shall receive the benefit of its granted wage assessment only to the extent the company performs by creating 250 new full-­time jobs associated with this approved economic development project utilizing Firestone’s base jobs at 505 as of May 27, 2021;
2. Performance Term: The term for Firestone’s performance under this Ordinance shall be for a period of five (5) years or until Firestone recovers a total wage assessment rebated from Whitley County, Kentucky, in an amount not to exceed $115,625.00, whichever comes first; recovery of this wage assessment rebate shall be on a quarterly basis with Firestone’s verification certificate to be filed with the Whitley County Judge/Executive no later than fifteen (15) days after the end of a quarter with the County to remit the rebate within thirty (30) days of receipt of same from the Whitley County Occupational Tax collector; and the performance term shall commence and coincide with final activation of the company’s sate incentive package granted by the Kentucky Economic Development Finance Authority (KEDFA);
3. Employment Reduction during Performance Term: If for any reason Firestone’s full-time employment associated with this approved economic development project is reduced during the performance term below that specified in subsection (a) of this section, Fire-stone shall receive the granted wage assessment rebate only for the number of new full-time jobs then employed;
4. Performance Verification: Firestone shall verify job creation performance to be eligible for the granted wage assessment rebate; said verification shall be filed by Firestone with the County on a quarterly basis utilizing an Employment and Wage Verification Certificate available at the Whitley County Judge/Executive’s Office.

Section 3. The grant provided herein is applicable only to Firestone and is not assignable or transferable to any other entity without approval of the Whitley County Fiscal Court.

Section 4. If any section, sentence, clause, or portion of this Ordinance is for any reason declared illegal, unconstitutional, or otherwise invalid, such declaration shall not affect the remaining portions hereof; and, to the extent that any section, sentence, clause, or portion of this Ordinance is in conflict with any other previous ordinance of Whitley County, Kentucky, then the provisions of this Ordinance shall take precedence.

Section 5. This Ordinance shall be effective upon its final passage and publication.

NOTICE OF BOND RELEASE

In accordance with KRS 350.093, notice is hereby given that Alden Resources LLC, 332 West Cumberland Gap Parkway, Suite 100, Corbin, KY 40701, has filed for a Phase II & III Bond Release on Increment No. 1 of permit number 918-0447 which was last issued on 12/18/2017. The application covers an area of approximately 497.38 surface acres located 0.9 miles east from the Maple Creek Road (KY HWY 779) junction with Brown Creek Road and located 600 feet southeast of Phoebe Fork and located 0.5 miles north of Perkins in Whitley County Kentucky.

The bonds now in effect are as follows:

Increment one (1) is a Surety Bond in the amount of $604,300.00. Approximately 100% of the original bond amount of $604,300.00 is included in this application for release.

Reclamation work performed includes: Backfilling, re-grading, topsoil replacement, and drainage control including soil preparation and initial seeding and mulching in accordance with the approved reclamation plan, completed in March 2014.

Written comments, objections, and requests for a public hearing of informal conference must be filed with the Director, Division of Field Services, 300 Sower Boulevard, 2nd Floor, Frankfort, KY 40601, by 10/02/2022.

A public hearing on the application has been scheduled for 12/05/2022 at 9:00 am the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, KY 40965-1229. The hearing will be cancelled if no request for a hearing or informal conference is received by 12/02/2022.
