ORDINANCE NO. 11-004
AN ORDINANCE ESTABLISHING A FEE FOR THE RELEASE OF MOTOR VEHICLES HAVING BEEN IMPOUNDED BY THE CITY OF WILLIAMSBURG AND ESTABLISHING A CITY IMPOUND, AND STORAGE FEES FOR MOTOR VEHICLES IMPOUNDED BY THE WILLIAMSBURG POLICE DEPARTMENT
WHEREAS, the City of Williamsburg must periodically impound vehicles that are being operated with the City of Williamsburg and
WHEREAS, the City Council of the City of Williamsburg believes it is of benefit to the residents of the City of Williamsburg by maintaining a City-run impound lot; and
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Williamsburg, Kentucky, as follows:
1. The City of Williamsburg shall maintain an impound lot for the storage of each automobile, motorcycle, truck, and other miscellaneous vehicles impounded by the Williamsburg City Police Department.
2. The lot shall have storage facilities available to house all vehicles towed by a contract wrecker who will charge a towing fee of sixty-five dollars ($65.00).
3. The impound lot shall be secured in such a manner as to preclude tampering with vehicles stored therein and the City shall be required to take all necessary steps to prevent damage to vehicles while in the custody of the City.
4. The City of Williamsburg shall charge a storage fee of twenty-five dollars ($25.00) per day for each day of impoundment.
5. Day one of charges starts at noon (12:00) the following day of the tow.
6. Prior to release of an impounded vehicle, the owner or authorized agent shall provide proof of insurance and registration to the Williamsburg Police Department and the officer will see that all fees are paid in full before the release of vehicle.
7. The fee must be paid in full and in cash before the vehicle will be released from impoundment. Payment shall be made at City Hall, City Clerk’s Office, 423 Main Street, Williamsburg, KY 40769 between the hours of 8:30 am to 4:30 pm, Monday – Friday only.
8. If the owner of a vehicle does not pick up the impounded vehicle within 90 days, City Hall will send a certified letter to owner stating that they have 15 days from the receipt of the letter to pick up vehicle. If the owner still does not pick the vehicle up, the vehicle then becomes property of the City of Williamsburg and then it will be placed in the local newspaper to sell to the highest bidder. Once the vehicle has sold the City of Williamsburg will reimburse the towing company for the charge of the tow. If it is determined that the vehicle is of no value, the city may in turn sell the vehicle for scrap metal.
This Ordinance shall take effect after its passage and upon publication.

The proposed operation will disturb 100.8 surface acres and will underlie 18.5 acres, and the total area within the permit boundary will be 119.3 acres. The proposed operation is located approximately 2-1/2 miles north of Rock Spring Road’s intersection with KY Hwy 904, and approximately 3 miles northeast of the community of Nevisdale, in Whitley County, Kentucky.
The proposed operation is located on the Saxton U.S.G.S. 7-1/2 minute quadrangle map. The operation will use the Contour and Auger methods of mining. The surface area is owned by Michael Powers, Ernie McCullah, Terry Lowe, Doris Fay Fletcher, Jeff Fear and Tim Fear. The operation will not affect an area within 100 feet of a public road. The operation will not involve relocation and/or closure of a public road.

In accordance with the provisions of KRS 350.055, notice is hereby given that Mountainside Coal Co., Inc., 7692 S. Hwy. 25-W, Williamsburg, Kentucky 40769, has applied for renewal of an existing coal mining and reclamation, coal processing operation located 0.25 mile north of the community of Rain, Kentucky, in Knox County. The operation will disturb 25.3 acres of surface disturbance and will underlie an additional 304.6 acres.
The proposed renewal is located approximately 0.25 mile north of KY Route 1809’s junction with Goldens Creek Road and located 0.01 mile west of Davis Branch.
The operation is located on the Frakes U.S.G.S. 7 2 minute quadrangle map. The surface area to be affected is owned by David Gray, Tommy Gambrel, Carley Bennett and Girdner Properties, LLC., and will underlie land owned by David Gray, Tommy Gambrel, Carley Bennett and Girdner Properties, LLC.

NOTICE OF INTENTION TO MINE
Pursuant to Application Number 918-0408, Amendment#2
In accordance with KRS 350.070, notice is hereby given that Monties Resources, LLC, 4184 S. Hwy 25W, Williamsburg, KY 40769 has applied for an amendment to an existing surface coal mining and reclamation operation located 4 miles south of Corbin in Whitley County. The amendment will add 7.97 acres of surface disturbance and will underlie an additional 7.63 acres making a total area of 205.67 acres within the amended permit boundary.
The proposed amendment area is approximately 0.4 miles south from Steel Hollow Road’s junction with Corn Creek Road and located 0.1 miles east of Corn Creek.
The proposed amendment is located on the Corbin and Rockholds U.S.G.S. 7 ½-minute quadrangle map. The surface area to be disturbed by the amendment is owned by Monties Resources, LLC. The amendment will underlie land owned by Monties Resources, LLC. The operation will use the contour and auger methods of surface mining. The operation will affect an area within 100 feet of Steel Hollow Road. The operation will not involve relocation or closure of the public road.

NOTICE OF BOND RELEASE
In accordance with the provisions of KRS 350.093, notice is hereby given that Davenport Coal Company, LLC, P. 0. Box 856, Jellico, TN 37762, has applied for a Phase I bond release of Permit No. 918-0401, which was last issued on 7/14/2010. This application covers an area of 25.3 acres located approximately three miles east of Lot in Whitley County.
The permit area is approximately 0.6 mile northeast of Lot-Mud Creek Road’s junction Doc Siler Road and located 0.1 mile south of Sulfur Spring Church. The latitude is 36° 36’ 32”, the longitude is 84° 02’ 01”.
The cash and surety bonds now in effect total $111,500.00, of which approximately 60 percent is requested to be included in this phase of bond release.
Reclamation work performed includes: As of August 20, 2010, the mine site has been backfilled to the approved post mining slope, and seeded and mulched according to the revegetation plan.
Written comments, objections, and requests for a public hearing must be submitted to the Cabinet at: Director, Division of Field Services, #2 Hudson Hollow, Frankfort, KY 40601, by November 28, 2011.
A public hearing has been scheduled for 9:00 a.m. on November 29, 2011, at the Middlesboro Regional Office, 1804 E. Cumberland Ave., Middlesboro, KY 40965. This hearing will be canceled if the Cabinet does not receive a request in writing for the public hearing by November 28, 2011.

In accordance with 405 KAR 7:010 notice is hereby given that Alden Resources LLC, 332 West Cumberland Gap Parkway, Corbin, Kentucky 40701, intends to transfer permit number 918-5188 to Alden Resources LLC, 332 West Cumberland Gap Parkway, Suite 100, Corbin, Kentucky 40701. The new permit number will be permit number 918-5195. The operation disturbs 229.94 surface acres and 6.78 underlies acres. No new acreage is affected by the transfer.
The operation is located approximately 0.8 miles northeast of Mud Creek Road’s junction with Kentucky Route 1595 and located 1.1 miles southwest of Round Mountain. The latitude is 36°39’08”. The longitude is 83°57’16”. The proposed major revision is located on the Frakes U.S.G.S. 7 ½ minute quadrangle map.

Public Notice of Blasting Schedule
Mountainside Coal Co., Inc., 7692 South HWY. 25W, Williamsburg, Kentucky 40769, Telephone Number: (606) 786-3620, shall conduct blasting operations on its 614 acre surface mine permit, located sixteen and one-half (16.5) miles southeast of Williamsburg, Kentucky, on Kentucky Highway 92, near the community of Siler, in Whitley County, Kentucky.
The proposed operation is approximately two (2) miles northeast of Harpes Creek Road’s intersection with Kentucky Highway 92.
The latitude is 36-41-51N; the longitude is: 83-55-53W. The surface area on which blasting operations will be conducted is owned by Corrigan TLP LLC, TKY Acquisition, LLC, and Edd B. Jones.
Blasting Operations will begin October 24. Blasting will be conducted each day Monday through Saturday during daylight hours. No blasting will be conducted after official sunset. This schedule shall be in effect from October 2011 until October 2012.
Any major alterations to the blasting scheduled will be published. Unscheduled blasting may occur in emergency situations when rain, lightning or other atmospheric conditions or operator or public safety requires unscheduled detonation. The nearby residents will be notified of the unscheduled blast by the most appropriate means and the blast shall then proceed as a regular blast. Entry to blasting area will be regulated by signs or barriers. An authorized company representative will prohibit access to the blasting areas by unauthorized persons at least five (5) minutes before each detonation and until the all clear signal is sounded. WARNING SIGNAL: A one (1) minute series of long blasts five (5) minutes prior to the blast signal. BLAST SIGNAL: A series of short blasts one (1) minute prior to the detonation. ALL CLEAR SIGNAL: A prolonged blast following the inspection of the blast area. Events which could necessitate blasting at unscheduled times include, but are not limited to rain, lightning, or other atmospheric conditions, or deteriorated explosives which involve personnel, operational or public safety. Any major alteration of this blasting schedule will be published.
This notice is published pursuant to CFR 715.19 Surface Mining and Reclamation and Enforcement Provisions and KRS 350.220 and the regulations relating thereto. The MSHA ID Number is 15-pending. The Kentucky DNR Permit Number is 918-0422.
