The application covers an area of approximately 386.27 acre 5.25 miles east of Rockholds in Whitley & Knox County Kentucky, and is approximately 0.64 miles east of KY 1064 junction with Terrell Hollow Road and approximately 700 feet east of Meadow Creek.

PUBLIC NOTICE OF BLASTING SCHEDULE

Mountainside Coal Co., Inc., 5540 Kentucky 1809, Barbourville, Kentucky 40906, Telephone Number: (336) 986-0059, shall conduct blasting operations on its 434.6 acre surface mine permit located near the community of Permon, in Knox and Whitley Counties, Kentucky.
The proposed operation is approximately one and two-tenths (1.2) miles north of the intersection of HWY 779 and HWY 1418.
This schedule shall be in effect from January 2023, until January 2024.
Any major alterations to the blasting scheduled will be published. Unscheduled blasting may occur in emergency situations when rain, lightning or other atmospheric conditions or operator or public safety requires unscheduled detonation. The nearby residents will be notified, of the unscheduled blast, by certified mail, regular mail or hand delivery and the blast shall then proceed as a regular blast. Entry to blasting area will be regulated by signs or barriers. An authorized company representative will prohibit access to the blasting areas by unauthorized persons at least five (5) minutes before each detonation and until the all clear signal is sounded. WARNING SIGNAL: A one (1) minute series of long blasts five (5) minutes prior to the blast signal. BLAST SIGNAL: A series of short blasts one (1) minute prior to the detonation. ALL CLEAR SIGNAL: A prolonged blast following the inspection of the blast area. Events which could necessitate blasting at unscheduled times include, but are not limited to rain, lightning, or other atmospheric conditions, or deteriorated explosives which involve personnel, operational or public safety. ORDINANCE NO. 2022 – 07
AN ORDINANCE RELATING TO THE ANNUAL INCREASE OF SALARIES OF CERTAIN ELECTED PERSONNEL AS PROVIDED BY KRS 64.527, KRS 64.5275 AND KRS 64.530
WHEREAS, the Whitley County Fiscal Court has heretofore annually provided for cost of living adjustments according to consumer price index prepared by the Department of Local Government;
WHEREAS, the offices of Magistrates of the Fiscal Court and the County Attorney have their salaries set pursuant to KRS 64.530, and in addition to those offices the office of coroner are subject to annual cost of living adjustments pursuant to KRS 64.527;
WHEREAS, the offices of County Judge/Executive, County Clerks, Sheriff and Jailer have their salaries set pursuant to KRS 64.5275 and are subject to annual cost of living adjustments as set forth therein;
WHEREAS, the Whitley County Fiscal Court, in order to provide its local governmental officials with the means to keep up with annual adjustments in the Consumer Price Index as provided in said statutes, desires to provide stability and consistency to the salaries of these elected offices;
NOW, THEREFORE, BE IT ORDAINED BY TIIE WHITLEY COUNTY FISCAL COURT:
- That the compensation paid by the Whitley County Fiscal Court shall hereafter be annually adjusted for the offices of County Judge/Executive, Magistrates, County Clerk, Sheriff, Jailer, Coroner and County Attorney.
- That all compensation to those officials identified in paragraph 1 shall be adjusted according to the Consumer Price Index as determined by the Department of Local Government.
- That the cost of living adjustments provided for herein shall be retroactive after the determination of such adjustment is made to January 1 of each year.
- Nothing herein shall prohibit the Whitley County Fiscal Court, in its discretion to annually determine an amount different from the annual increase in the Consumer Price Index, provided it does not exceed that amount.
- All ordinances in conflict with this ordinance, or portions thereof, shall be deemed repealed from and after the effective date of this ordinance, to the extent of such conflict.
