NOTICE OF INTENTION TO MINE
Pursuant to Application Number 918-0421
In accordance with KRS 350.055, notice is hereby given that Fraziernanatz, 541 Blakes Fork Road, Williamsburg, KY 40769 has applied for surface coal mining and reclamation operation located 1.20 miles north of Louden in Whitley County. The proposed operation will disturb 10.36 surface acres and will underlie and additional 18.82 acres with a total area within the permit boundary will be 29.18 acres.
The proposed operation is approximately 0.2 miles north from KY 1064’s junction with Poynter Road and located 0.5 miles east of Whetstone Creek. The Latitude is 36-46-08 and the Longitude is 84-02-20.
The proposed operation is located on the Rockhold U.S.G.S. 7 ½-minute quadrangle map. The operation will use the surface and underground method of mining. The surface and underground areas to be disturbed are owned by Ada Powers.
The application has been filed for public inspection at the Division of Mining Reclamation and Enforcement Middlesboro Regional Office, 1804 E. Cumberland Ave, Middlesboro, KY 40965. Written comments, objections, or requests for a permit conference must be filed with the Director, Division of Permits, #2 Hudson Hollow, U.S. 127 South, Frankfort, Kentucky 40601.

Second Reading of a proposed Ordinance amending the Whitley County Budget for Fiscal Year 2009-2010, to include unanticipated receipts increasing/decreasing from the following fund, Federal Grants – CDBG Fund in the amount of $300,050.00 and increasing/decreasing expenditures in the Federal Grants – CDBG Fund in the amount of $300,050.00 will be held on 01/19/10 at 6:00 PM in the Whitley County Fiscal Court Room during the Regular Meeting. A copy of the proposed Ordinance with full text is available for public inspection at the Office of the County Judge Executive during normal business hours.

PUBLIC NOTICE – REQUEST FOR QUALIFICATIONS FOR HOUSING DEVELOPMENT/CONSTRUCTION SERVICES
Bell-Whitley Community Action Agency, Inc. as a sub-recipient of grant funds from Whitley County is seeking qualifications for housing development and construction services related to a Community Development Block Grant funded through the Kentucky Department for Local Government (DLG) under the American Recovery and Reinvestment Act of 2009 (ARRA). The development consists of scattered site construction of zero/highly energy efficient homes located in Whitley County Kentucky.
Minimum requirements include previous experience in housing development and construction, the ability to provide zero energy/high energy efficiency design and specifications, the ability to meet time constraints, as well as the experience and knowledge involving single family low income residential housing development and construction. This includes bidding, contracting, and inspection. This project may also require coordination of financing options as part of the development package.

VOLUNTARY ACQUISITION NOTICE
Whitley County and Bell-Whitley Community Action Agency have established a Voluntary Acquisition Policy for the Whitley County CDBG-R Zero Energy Homes Project. This notice invites offers from property owners to be made to Bell-Whitley Community Action Office.
The properties that Bell Whitley Community Action Agency wishes to acquire must be located in the electrical service area of the Tennessee Valley Authority, must be unoccupied or vacant with minimal improvements and must have water and sewer service to the property. The properties will be utilized for the Whitley County CDBG-R Program sponsored by the Kentucky Department for Local Government for homebuyer activities. The terms and conditions of the sale will be Bell Whitley Community Action Agency will be receiving unencumbered fee simple title to the property at the time of sale.
The owner of the vacant property will be required to waive relocation benefits as a condition of the sale. Whitley County will not invoke its powers of condemnation to secure any property offered if a mutually satisfactory sale is not concluded in order to acquire the property.

Homebuyer Applicants Requested
The Whitley County Fiscal Court, is a recipient of Community Development Block Grant (CDBG-R) Program funds to build and provide financing for zero energy housing in the community. The goal of the CDBG-R Program is to provide affordable housing that is energy efficient for low- and moderate-income persons. Financing assistance will be offered to homebuyers through this federally funded program in the form of a ten year, forgivable 2nd mortgage. Assistance will be offered to applicants who meet required income characteristics and complete homebuyer counseling requirements. The zero energy homes may have additional maintenance requirements to relative to maintaining the energy components.
If you are interested in applying for assistance and your household meets the following basic criteria, please contact Bell-Whitley Community Action Agency to apply. Representatives from Bell-Whitley Community Action Agency will contact you to obtain basic information.

Ranking of households is subject to change if a top ranked applicant chooses not to participate in the project.
In the event that not all interested households can receive assistance, households with the greatest need will have top priority. Selection criteria of participants will be based upon income, single head of household, ability to obtain first mortgage financing, completion of counseling program, and established residency in Whitley County.
