NOTICE OF BOND RELEASE

In accordance with KRS 350.093, notice is hereby given that Alden Resources LLC, 332 West Cumberland Gap Parkway, Corbin, KY 40701, has filed for a Phase III bond release on Increment No. 2, and 4 of permit number 918-5195 which was last issued on March 13, 2012. The application covers an area of approximately 236.72 acres located 0.8 miles of Mud Creek road and the junction with KY 1595.
The permit area is approximately 1.5 miles northwest of Frakes, KY, and located 0.8 miles northeast of Mud Creek Road with the junction of KY 1595 and located 1.1 miles southwest of Round Mountain in Whitley County, Kentucky.
The bond now in effect for increment 2 is a surety in the amount of $39,400.00. Approximately 100% of the original bond amount of $224,500.00 is included in this application for release. The bond now in effect for increment 4 is a surety bond in the amount of $23,000.00. Approximately 100% of the original $53,100.00 is included in this application for release.
Reclamation work performed includes: Backfilling, regrading, topsoil replacement, and drainage control including soil preparation and initial seeding, mulching and tree planting in accordance with the approved reclamation plan completed November 15, 2010.
Written comments, objections, and requests for a public hearing or informal conference must be filed with the Director, Division of Field Services, 300 Sower Boulevard 2nd Floor, Frankfort, Kentucky 40601, by October 14, 2016.
A public hearing on the application has been scheduled for October 17, at 9:00 am. The Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, KY 40965-1229. The hearing will be cancelled if no request for a hearing or informal conference is received by October 14, 2016.
NOTICE OF BLASTING SCHEDULE
PERMIT NO. 918-0472
In accordance with the provisions of 405 KAR 16:120, Section 3, Alden Resources, LLC, 332 W. Cumberland Gap Pkwy. Corbin, KY 40701, phone No. (606) 523-9760, proposes the following blasting schedule. The blasting site will be conducted on Increment 1 only.
The area is located 0.6 miles east of Rockholds in Whitley County at latitude 36° 50’20” and longitude 84’0521”. The area lies north and northwest of the intersection of Colonel Hollow County Road and State Route 26 and the intersection of the Imperial Hollow stream and State Route 511. Detonations of explosives are proposed to occur from sunrise to sunset and from Monday through Saturday for the period beginning, September 2016 through, September 2017.
Entry to the blasting area will be regulated by signs and barriers. An authorized company representative will prohibit access to the blasting area by unauthorized persons at least ten minutes prior to each detonation. The warning signal shall consist of three long blasts on a siren five minutes prior to the detonation. The blast warning signal will consist of three short blasts on the siren one minute prior to detonation. The all clear signal shall consist of one long blast on a siren following the inspection of the blast site. All roads leading to or near the blast site will remain closed until the all clear signal is given. The warning and all clear signals will be audible within one-half mile from the blast point. The above notice of blasting schedule will be published in the News-Journal at least ten (10) days, but not more than thirty (3 0) days before beginning blasting.
Copies of the above blasting schedule will be mailed to the regional KDSMRE office in Middlesboro, Ky., to the Whitley County Judge Executive, to all local utilities and to each resident within one-half mile of the blasting site at least 10 days prior to, but no sooner than 30 days prior to beginning blasting.
NOTICE OF INTENTION TO MINE

In accordance with KRS 350.055 notice is hereby given that Alden Resources LLC 332 West Cumberland Gap Parkway, Suite 100, Corbin, Kentucky 40701 has applied for an amendment to an existing permit for a surface, auger/highwall coal mining and reclamation operation. The amendment will add 43.81 of surface disturbance and 22.93 acres of Auger/HM area making a total of 66.74 acres within the permit area. The total area of the permit is 228.13 acres. The permit is located 3.9 miles southeast of Rockholds in Whitley County.
The proposed operation is approximately 0.8 miles northwest of KY 779 junction with KY 3423 and located 2.2 miles northwest of the confluence of an un-named tributary of Meadow Creek with Meadow Creek.
The proposed operation is located on the Rockholds, KY 7½ minute quadrangle map. The operation will use a combination of contour, area and auger/highwall miner methods of surface mining. The surface and auger/highwall mining area is owned by Glenn D. Miller, Gary McKeehan, Lloyd Jackson, Don Young and Donald Bunch. The operation will affect an area within 100 feet of public road (CR) Springtown Road. The operation will not involve relocation or closure of the public road.
The application has been filed for public inspection at the Department for Surface Mining and Reclamation and Enforcement’s, Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965-1229. Whitley County Board of Education
The Whitley County Board of Education will hold a public hearing at the Whitley County Board of Education Central Office on September 15, 2016 at 5:00 p.m. to hear public comments regarding proposed tax levies for fiscal year 2017.
The Whitley County Board of Education is proposing a tax rate of 42.0 cents for both personal and real property, which is equal to last year’s rate of 41.6 (for both personal and real property) plus an additional 0.4 cents for prior year losses due to exonerations per KRS 134.590. The General Fund tax levied in fiscal year 2016 produced revenue of $2,553,607.
The proposed General Fund tax rate of 42.0 cents on real property and 42.0 cents on personal property is expected to produce $2,695,423 (assuming a collection rate of 90%). Of this amount $465,406 (assuming a collection rate of 90%) is from new and personal property.
The general area to which revenue of $141,816 above 2016 revenue is to be allocated is instruction.
The General Assembly has required publication of this advertisement and information contained herein.

INVITATION TO BID
BRIDGE ABUTMENTS
Alsile Bridge
Bids will be accepted for the concrete bridge abutments for a 20’ x 24’ bridge, and the installation of a premanufactured steel bridge package. The abutments are to be built on Alsile Road (CR 1355), and the bridge passes over Hominey Creek, in Whitley County.
Detailed plans are available at the Whitley County Judge Executive’s office. As the steel deck has already been bid, and accepted, the contractor will disregard that portion of the plans except where it pertains to the abutments.
Contractor shall provide the Whitley County Fiscal Court proof of Liability Insurance and a bid bond equal to ten percent (10%) of the total bid. All bidders must be prequalified by the Kentucky Department of Transportation.
County road department personnel will be responsible for demolition of existing structure and the removal of the bridge debris.
The county will procure all necessary permits prior to installation. Whitley County Road Department will be responsible for backfilling both ends of the bridge to road grade.
Contractor will not begin work until given the release to start work. The county will give the contractor a notice to proceed after receiving the permitting, and the KYDOH Memorandum of Agreement. Once notified to begin, the contractor will be given 30 working days to complete the project.
The Whitley County Fiscal Court reserves the right to reject any and all bids
Conflicts of interest, gratuities and kickbacks are defined in KRS 45A.445 and as provided for in KRS 45A.445 are absolutely prohibited
Sealed bids must be at the Whitley County Judge Executive’s office no later than 3:00 pm, on Monday September 19th 2016. Bids will be clearly marked, Alsile Bridge. Bids will be opened at that time. The bid will be awarded at the Fiscal Court meeting which begins a 6 pm, September 20th 2016. ADVERTISEMENT FOR BID
Sealed proposals for the following work will be received by the Whitley County Fiscal Court in the manner, and the date hereinafter specified for the furnishing of all labor, materials, supplies, tools, equipment, services, etc., necessary for the repair, and stabilization of Poplar Creek Road (CR1174). The site is located approximately 500 feet North of the junction of Hamblin Hollow and Poplar Creek Road.
Contractors must submit their sealed proposals to the Whitley County Judge Executive office, at the Whitley County Courthouse, 200 Main Street, Williamsburg, KY 40769, on or before 3:00 p.m. local time on September 19th. Proposal envelopes or packages must be clearly marked Poplar Creek Road, on the front of the envelope or package. Bids will be opened at this time, and read aloud. Bids will be presented, and awarded at the regular scheduled meeting of the Whitley County Fiscal Court, which takes place at 6:00 p.m. on September 20th, 2016.
Contractor must provide proof of liability insurance, a bid bond equal to 10% of bid price, and a performance bond.
Cost estimates will be based on 200 linear feet of roadway, but site conditions will determine actual footage requirements.
Scope of work to be performed: The steel will be installed into the bedrock to a depth no less than ½ the distance to the existing bedrock, or a minimum of 10 feet into the bedrock. The dirt will then be excavated to a minimum of 8 feet so panels can be attached to the installed steel. Type IV fabric will be installed and #2 gravel will be place in the annular space between the panel and roadway. A 6 inch layer of DGA will then be installed over the disturbed area to provide a smooth driving surface.
Conflict of interest, gratuities, and kickbacks are defined in KRS 45A.445, and as provided for in KRS 45A.445 are absolutely prohibited.
No bidder may withdraw his/her bid for 90 days after the date the bids are opened. Any bid received after the time specified shall not be considered and will be returned unopened to the bidder.
Whitley County reserves the right to waive any informality, and may reject any and all bids. Whitley County reserves the right to award bid based upon availability, service and in the best interest for the public safety of the citizens of Whitley County.
