ADVERTISEMENT FOR BIDS
The Whitley County Fiscal Court is accepting Sealed Proposals for Rubber Modified Chip Seal. The Fiscal Court was recently awarded a grant from the Kentucky Energy and Environment Cabinet to complete this project on Tiny Branch Road. The project will include 10,560 square yards of 3 layers of rubberized chip seal. The project will also include application and should conform to specifications found on our website at www.whitleycountyfiscalcourt.com.
Proposals must be received in the Judge Executive’s Office located at 200 Main Street, Williamsburg, KY 40769 or by mail to: PO Box 237, Williamsburg, KY 40769 by 2:00 PM on Monday, September 19th, 2016, at which time the bids will be read aloud. The bid will be awarded during the regularly scheduled meeting of the Fiscal Court on Tuesday, September 20th, 2016 at 6:00 pm in the Fiscal Court Room.
All bids shall be marked “Rubber Modified Chip Seal” on the front of envelope.
Conflicts of interest, gratuities and kickbacks are defined in KRS 45A.445 and as provided for in KRS 45A.445 are absolutely prohibited.
No bidder may withdraw his/her bid for 90 days after the date the bids are opened. Any bid received after the time specified shall not be considered and will be returned unopened to the bidder.
Whitley County reserves the right to waive any informality and may reject any and all bids. Whitley County reserves the right to award bid based upon availability, service and in the best interst for the public safety for the citizens of the County. Whitley County is an Equal Opportunity Employer.
NOTICE OF BOND RELEASE
Permit # 918-5195
In accordance with KRS 350.093, notice is hereby given that Alden Resources LLC, 332 West Cumberland Gap Parkway, Corbin, KY 40701, has filed for a Phase III bond release on Increment No. 2, and 4 of permit number 918-5195 which was last issued on March 13, 2012. The application covers an area of approximately 236.72 acres located 0.8 miles of Mud Creek road and the junction with KY 1595.
The permit area is approximately 1.5 miles northwest of Frakes, KY, and located 0.8 miles northeast of Mud Creek Road with the junction of KY 1595 and located 1.1 miles southwest of Round Mountain in Whitley County, Kentucky.
The bond now in effect for increment 2 is a surety in the amount of $39,400.00. Approximately 100% of the original bond amount of $224,500.00 is included in this application for release. The bond now in effect for increment 4 is a surety bond in the amount of $23,000.00. Approximately 100% of the original $53,100.00 is included in this application for release.
Reclamation work performed includes: Backfilling, regrading, topsoil replacement, and drainage control including soil preparation and initial seeding, mulching and tree planting in accordance with the approved reclamation plan completed November 15, 2010.
Written comments, objections, and requests for a public hearing or informal conference must be filed with the Director, Division of Field Services, 300 Sower Boulevard 2nd Floor, Frankfort, Kentucky 40601, by October 14, 2016.
A public hearing on the application has been scheduled for October 17, at 9:00 am. The Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, KY 40965-1229. The hearing will be cancelled if no request for a hearing or informal conference is received by October 14, 2016.
Notice of Blasting Schedule
Alden Resources, LLC, 332 W. Cumberland Parkway, Corbin, KY 40701, phone number (606)523-9760, gives notice that blasting operations will be conducted on its coal mine permit number 918-0447, Increment 5 only.
The proposed operation is located approximately 0.5 miles north of Perkins, Kentucky, and is approximately 0.80 miles east of the Maple Creek Road junction with Brown Creek Road and located 3.9 miles north of the mouth of Maple Creek.
Blasting will be conducted each day Monday through Saturday during daylight hours. No blasting will be conducted after official sunset. This schedule shall be in effect from September 2016, until September 2017.
Blasting will be conducted between sunrise and sunset except in emergency situations. Emergency situations include, but are not limited to, lightning, the imminent threat of lightning, or other circumstances that require unscheduled detonation for the safety of the public or miners.
Signs or barriers identify entry points to the blast area. A representative or representatives of the permittee will monitor the access point(s) and prevent entry of unauthorized persons during the blast.
The pre-blast warning signal will be a one (1) minute series of long blasts five (5) minutes prior to the blast signal. The final blast warning signal will be a series of short blasts one (1) minute prior to the detonation. The all clear signal will be a prolonged blast following the inspection of the blast area.
This notice is published pursuant to CFR 715.19 Surface Mining and Reclamation and Enforcement Provisions and KRS 350.220 and the regulations relating thereto. The MSHA ID Number is 15-19614. The Kentucky DNR Permit Number is 918-0447.
NOTICE OF INTENTION TO MINE

In accordance with KRS 350.055 notice is hereby given that Alden Resources LLC 332 West Cumberland Gap Parkway, Suite 100, Corbin, Kentucky 40701 has applied for an amendment to an existing permit for a surface, auger/highwall coal mining and reclamation operation. The amendment will add 43.81 of surface disturbance and 22.93 acres of Auger/HM area making a total of 66.74 acres within the permit area. The total area of the permit is 228.13 acres. The permit is located 3.9 miles southeast of Rockholds in Whitley County.
The proposed operation is approximately 0.8 miles northwest of KY 779 junction with KY 3423 and located 2.2 miles northwest of the confluence of an un-named tributary of Meadow Creek with Meadow Creek.
The proposed operation is located on the Rockholds, KY 7½ minute quadrangle map. The operation will use a combination of contour, area and auger/highwall miner methods of surface mining. The surface and auger/highwall mining area is owned by Glenn D. Miller, Gary McKeehan, Lloyd Jackson, Don Young and Donald Bunch. The operation will affect an area within 100 feet of public road (CR) Springtown Road. The operation will not involve relocation or closure of the public road.
The application has been filed for public inspection at the Department for Surface Mining and Reclamation and Enforcement’s, Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965-1229. Written comments, objections or requests for a permit conference must be filed with the Director, Division of Mine Permits, 300 Sower Blvd, Frankfort, Kentucky 40601.

An emergency ordinance amending the Whitley County Budget for Fiscal Year 2016-2017, to include unanticipated receipts increasing/decreasing from the GEN and AMB Funds in the amount of $208,902.00 and increasing/decreasing expenditures from the GEN and AMB Funds in the amount of $208.902.00 was passed on 08/16/16. A copy of the Emergency Ordinance with full text is available for public inspection at the Office of the County Judge Executive during normal business hours.

The annual financial statement of the County Treasurer required by KRS 424.220 has been prepared and accepted by the Whitley County Fiscal Court for the fiscal year ended June 30, 2016. Copies will be provided to each local newspaper of general circulation, each news service and local radio and television station which has a written request to be provided a statement.
The Whitley County Fiscal Court, pursuant to KRS 424.220 (8) chooses to however publish the auditor’s report for the fiscal year ended June 30, 2016.

The Whitley County Public Library, established under KRS 173.720, provides library services to citizens in Whitley County, Kentucky. In accordance with Chapters 65 and 424 of the Kentucky Revised Statutes, the financial records of the Whitley County Public Library District for the Period of July 1, 2015 through June 30, 2016 may be inspected at the Whitley County Public Library, 285 S 3rd St, Williamsburg, Kentucky during administrative office hours: Monday through Friday 9 a.m. – 5 p.m. Inquiries should be made to the library director.
