Notice of Bond Release

Permit # 918-0470

In accordance with KRS 350.093, notice is hereby given that Alden Resources LLC, 332 West Cumberland Gap Parkway, Suite 100, Corbin, KY 40701, has filed for a Phase I Bond Release on Increment1 No. 1 of permit number 918-0470 which was last issued on February 12th 2015. The application covers an area of approximately 109.8 surface and 114.60 underground/auger acres for a total of 224.40 acres located approximately 0.7 mile south of Johnny Hollow Road’s intersection with KY Hwy 26 and on the waters of Watts Creek. The operation is further located 1.5 miles north of the community of Rockholds in Whitley County, Kentucky.

The bonds now in effect are as follows:

Increment one (1) is a Surety Bond in the amount of $332,800.00. Approximately 60% of the original bond amount of $332,800.00 is included in this application for release.

Reclamation work performed includes: Backfilling, re-grading, topsoil replacement, and drainage control including soil preparation and initial seeding and mulching in accordance with the approved reclamation plan, completed in October 2015.

This is the final advertisement of the application. Written comments, objections, and requests for a public hearing of informal conference must be filed with the Director, Division of Field Services, #2 Hudson Hollow, Frankfort, KY 40601, by 08/26/2016.

A public hearing on the application has been scheduled for 08/29/2016 at 9:00 at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, KY 40965-1229. The hearing will be cancelled if no request for a hearing or informal conference is received by 08/29/2016.

NOTICE OF BOND RELEASE

In accordance with the provisions of KRS 350.093, notice is hereby given that Davenport Coal Company, LLC, P. O. Box 856, Jellico, TN 37762, has applied for a combined Phase II and III bond release of Permit No. 918-0401, which was last issued on 1/04/2014. This application covers an area of 25.3 acres located approximately three miles east of Lot in Whitley County.

The permit area is approximately 0.6 mile northeast of Lot-Mud Creek Road’s junction Doc Siler Road and located 0.1 mile south of Sulfur Spring Church. The latitude is 36° 36’ 32”, the longitude is 84° 02’ 01”.

The cash and surety bonds now in effect total $33,900.00, of which 100 percent is requested to be included in this phase of bond release.

Reclamation work performed includes:   As of August 20, 2010, the mine site has been backfilled to the approved post mining slope, and seeded and mulched according to the revegetation plan. Trees were planted in March 2011.

Written comments, objections, and requests for a public hearing must be submitted to the Cabinet at: Director, Division of Mine Reclamation & Enforcement, 300 Sowder Blvd., Frankfort, KY 40601, by September 9, 2016.

A public hearing has been scheduled for 9:00 a.m. on September 12, 2016, at the Middlesboro Regional Office, 1804 E. Cumberland Ave., Middlesboro, KY 40965. This hearing will be canceled if the Cabinet does not receive a request in writing for the public hearing by September 9, 2016.

NOTICE OF BOND RELEASE

In accordance with KRS 350.093, notice is hereby given that Mountainside Coal Co., Inc., 7692 S. HWY 25W, Williamsburg, KY 40769 has applied for a Phases I Bond Release on Increments 3 and 5 of Permit Number 918-0466. The application covers an area of Approximately 499.1 acres of surface area located approximately 2.5 miles South of Pearl, KY and 1 mile south of the confluence of Wheeler Creek and Tiny Branch in Whitley County. The permit area is approximately .5 miles west of the intersection of Hwy. 190 and Tiny Branch Spur. The latitude is 36° 36’ 27”. The longitude is 83° 56’ 30”.

The bond now in effect is: Increment 3 – Two letters of credit in the amount of $32,450 and The Kentucky Bond Pool in the amount of $156,300. Increment 5 – $4,500 Cash.

Reclamation work performed includes: Backfilling, grading, fertilizing, seeding and mulching.

A public hearing on the application has been scheduled for September 12, 2016 at 10:00 a.m. at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, KY 409651-229. The hearing will be cancelled if no request for hearing or informal Conference is received by September 9, 2016.

Notice of Blasting Schedule

Alden Resources, LLC, 332 W. Cumberland Parkway, Corbin, KY 40701, phone number (606)523-9760, gives notice that blasting operations will be conducted on its coal mine permit number 918-0476, covering 161.39 acres. Latitude: 36° 48’ 48”, Longitude: 84° 04’ 06”

The proposed operation is located approximately 3.9 miles southeast of Rockholds in Whitley County Kentucky, and is approximately 0.8 miles northwest of KY 779 junction with KY 3423 and located 2.2 miles northwest of the confluence of an un-named tributary of Meadow Creek with Meadow Creek.

Blasting operations are projected to commence August 2016. Blasting will be conducted between sunrise and sunset except in emergency situations. Emergency situations include, but are not limited to, lightning, the imminent threat of lightning, or other circumstances that require unscheduled detonation for the safety of the public or miners.

Any major alterations to the blasting schedule will be published. Unscheduled blasting may occur in emergency situations when rain, lightning or other atmospheric conditions or operator or public safety requires unscheduled detonation. The nearby residents will be notified of the unscheduled blast by using audible signals and the blast shall then proceed as a regular blast. Entry to the blasting area will be regulated by signs or barriers. An authorized company representative will prohibit access to the blasting area by unauthorized persons at least five (5) minutes before each detonation and until the all clear signal is sounded. Warning signals will be made by using a siren in the following manner:

The pre-blast warning signal will be a one (1) minute series of long blasts five (5) minutes prior to the blast signal. The blast signal will be a series of short blasts one (1) minute prior to the detonation. The all clear signal will be a prolonged blast following the inspection of the blast area.
