NOTICE OF INTENTION TO MINE
Pursuant to Application Number 918-0434 Amendment No. 1
In accordance with the provisions of KRS 350.070, notice is hereby given that American Highwall Mining, LLC, P.O. Box 1539, Chilhowie, Virginia 24319 has applied for an amendment to an existing surface coal mining and reclamation operation located 1.0 miles southeast of Rockholds in Whitley County, Kentucky. The amendment will add 24.0 acres of surface disturbance and will underlie an additional 0.5 acres making a total area of 202.5 acres within the amended permit boundary. The Amendment also proposes 99.0 acres of postmining land use change from undisturbed unmanaged forestland use to 99.0 acres of pasture land.
The amendment area is approximately 1.2 miles east of junction of the Jack’s Fork Road and KY Rt. 26 and located on Helton Hollow of Jacks Fork of Watts Creek.
The proposed amendment is located on the Rockholds U.S.G.S. 7 1/2 minute quadrangle map. The surface area to be disturbed by the amendment is owned by Bart Davis, Barbara Roberts and Daymond & Joyce Helton.
This is the final advertisement of this application; all comments, objections or requests for a permit conference must be received within 30 days of this date. The amendment application has been filed for public inspection at the Department for Mining Reclamation and Enforcement’s Middlesboro Regional Office, 1804 Cumberland Ave., Middlesboro, Kentucky 40965. In accordance with KRS 350.070, notice is hereby given that Mountainside Coal Co., Inc.; 7692 South Hwy. 25W; Williamsburg, Kentucky 40769 has applied for a major revision to an existing permit for a surface/underground coal mining and reclamation operation located 1.7 miles northwest of the community of Permon in Knox and Whitley Counties, Kentucky. The major revision will add 17.3 acres of surface disturbance and delete 16.3 acres of surface disturbance and will not add any underground acreage, but will delete 16.3 acres of auger mining area, for a total of 647.5 acres within the revised permit boundary.
The proposed major revision area is approximately 1.6 miles northeast from HWY 1418’s junction with HWY 511 and located approximately 0.4 miles north of Cotton Creek. The Latitude is 36°48’52”N. The Longitude is 84°00’53”W.
The proposed major revision is located on the Barbourville & Rockholds U.S.G.S. 7½ minute quadrangle maps. The surface area to be affected by this major revision is owned by Robert Brown & Kathy Brown, Ray & Geneva Hill, David Logan & Tim Logan, Jack & Sadie Smith, David Rose, and Blair Farms, L.L.C.
The operation will also include a refuse disposal facility. The surface area affected by the refuse disposal is owned by David Logan & Tim Logan, David Rose, Jack & Sue Clark, David & Brenda Monhollen, Randy D. Mackey, Norma Lene Foley, Arthur Foley, Venda S.
