Former Cumberland Inn manager accused of theft
A Whitley County Grand Jury handed down a 21-count indictment against a former Cumberland Inn general manager Friday morning for allegedly stealing over $8,000 last year.
The grand jury charged David L. Maggard, 40, of Williamsburg, with 13 counts of theft by failure to make required disposition of property under $500, and eight counts of theft by failure to make required disposition of property over $500 but less than $10,000.
From Aug. 3 – Nov. 25, 2009, Maggard allegedly converted $8,654.83, which was the property of the University of the Cumberlands to his own use, according to his indictment. The university owns and operates the Cumberland Inn.
"He was manager at the Cumberland Inn, and he was charged with taking money, which was part of the receipts at the Cumberland Inn and not depositing them in the university’s account," said Commonwealth’s Attorney Allen Trimble.
Trimble said that the university discovered the missing money through an internal investigation, and then notified Williamsburg Police Detective Bobby Freeman, who was the investigating officer.
Maggard apparently worked at the Cumberland Inn until sometime in December.
The theft under $500 charges are misdemeanor offenses, but the theft over $500 charges are class ‘D’ felonies, which are punishable by up to five years in prison on each count.
Trimble said that as a practical matter, the most anyone can serve for a conviction on class ‘D’ felonies is 20 years in prison.
Maggard was not present in court Friday when the indictment was returned. Judge Paul Braden set a $5,000 bond.
