Federal prosecutors are accusing a London-based natural gas company of illegally polluting a local water source and killing an endangered species of fish.
U.S. Attorney James A. Zerhusen filed documents in U.S. District Court in London Aug. 13 accusing Nami Resources Company, LLC of violations of the Clean Water Act and Endangered Species Act in 2007.
According to court documents, the company "negligently" discharged pollutants, drilling fluids and "fracturing fluids", used in the production of natural gas into a Knox County waterway between May 14, 2007 and Aug. 22, 2007. During that same time, Zerhusen accuses the company of "knowingly and unlawfully taking and causing to be taken two Blackside Dace, a threatened species of fish…"
The information does not say if the discharge of pollutants led to the death of the fish.
Both alleged violations occurred at the Don Mills lease property.
An arraignment hearing in the case scheduled for Aug. 13 in Lexington was continued until Oct. 13 by Magistrate Judge James B. Todd.
The violations carry cumulative penalties of up to one and a half years in prison and fines of up to $25,000 per day of the violation.
According to records on file with the Kentucky Secretary of State’s Office, Nami Resources Company, LLC is located at 104 Nami Plaza Suite 1 in London. Majeed S. Nami is listed as a "member" of the company. The company is represented in this case by Frankfort attorney George L. Seay Jr.
Last month, Nami was hit with a $967,280 judgment from a Laurel County jury following a trial on claim that he sexually harassed and wrongfully fired a former female employee of another natural resources business he owns – Vinland Energy Operations. Nami is also owner of Falls Auto Group in Corbin.
