In accordance with KRS 350.070, notice is hereby given that Mountainside Coal Co., Inc.; 7692 South Hwy. 25W; Williamsburg, Kentucky 40769 has applied for an amendment to an existing permit for a surface/underground coal mining and reclamation operation located 1.7 miles northwest of the community of Permon in Knox and Whitley Counties, Kentucky. The amendment will add 0.0 acres of surface disturbance and will underlie an additional 80.5 acres, for a total of 653.1 acres within the amended permit boundary.
The proposed amendment is approximately 1.6 miles northeast from HWY 1418’s junction with HWY 511 and located approximately 0.4 miles north of Cotton Creek. The Latitude is 36°48’52”N. The Longitude is 84°00’53”W.
The proposed amendment is located on the Barbourville & Rockholds U.S.G.S. 7½ minute quadrangle maps. The amendment will underlie land owned by Robert Brown & Kathy Brown, Hubert Grant & Arnold David Grant, Ray & Geneva Hill, David Logan & Tim Logan, Randy D. Mackey, Norma Lene Foley, Arthur Foley, David & Brenda Monhollen, Jack & Sadie Smith, Blair Farms, L.L.C., Kevin Holbrook and Gary Partin.
The amendment application has been filed for public inspection at the Department for Surface Mining Reclamation and Enforcement’s Middlesboro Regional Office; 1804 East Cumberland Avenue; Middlesboro, Kentucky 40965-1229. The application covers an area of approximately 44.43 acres located 1.20 miles north of Louden in Whitley County.
The proposed area is approximately 0.2 miles north from KY 1064’s junction with Poynter Road and located 0.5 miles east of Whetstone Creek. The Latitude is 36°46’08”and the Longitude is 84°02’20” and is located on the Rockholds U.S.G.S. 7 ½-minute quadrangle map.
The bond now in effect for increments 1,2,3 and 4 is a total of $37,400 which is cash bond, Approximately 43% of the original bond amount of $87,600 is included in the application for release.
Reclamation work performed includes: Backfilling, grading, fertilizing, seeding, and mulching was completed in April of 2011.

NOTICE TO WHITLEY COUNTY TAXPAYERS
Kay Schwartz, Whitley County Clerk, pursuant to KRS 424.130, and the Whitley County Fiscal Court, announces that the 2014 Delinquent Real Property Tax Bills (Certificates of Delinquency) will be published in the News Journal Newspaper on August 12, 2015.
The list of Certificates of Delinquency is also available for public inspection during the hours of 7:30 am – 6:00 pm on Mondays and 7:30 am – 4:30 pm Tuesdays through Fridays, at the County Clerk’s office located at 200 Main St. (Courthouse) Room 2, Williamsburg, KY. This list may also be inspected on the Software Management, LLC website at kydtax.smllc.us.
The tax sale will be held on September 15, 2015 beginning at 9:00 am. All interested participants must register with the County Clerk’s office by the close of business on September 5, 2015.

Child Find for Children with Disabilities in Need of Special Education or 504 Services

The Corbin Independent, Whitley County & Williamsburg Independent School District keep educational records in a secure location in each school and Board office.
The Corbin Independent, Whitley County & Williamsburg Independent School District obtains written consent from a parent or eligible student (age 18 or who is attending a postsecondary institution), before disclosing personally identifiable information to an entity or individual not authorized to receive it under FERPA.
For students who have been determined eligible for Special Education, educational records will be destroyed at the request of the parents when they are no longer needed to provide educational programs or services. The Corbin Independent, Whitley County & Williamsburg Independent School District may destroy the educational records of a child without parent request 5 years after they are no longer needed to provide educational programs or services. Parents are advised that data contained in the records may later be needed for Social Security benefits or other purposes. The Corbin Independent, Whitley County & Williamsburg Independent School District may retain, for an indefinite period of time, a record of the student’s name, address, telephone number, grades, attendance records, classes attended, grade level completed, and year completed.
Children eligible for Special Education include those children with disabilities who have autism, deaf-blindness, developmental delay, emotional-behavior disability, hearing impairment, mental disability, multiple disabilities, orthopedic impairment, other health impairment, specific learning disability, speech or language impairment, traumatic brain injury, or visual impairment and who because of such an impairment need Special Education services.
Children eligible for 504 services include those children in a public elementary and secondary education program who have a current physical or mental impairment that currently substantially limits some major life activity which causes the student’s ability to access the school environment or school activities to be substantially limited.
Children eligible for the State-Funded Preschool program include three- and four-year-old children identified with disabilities and four-year-old children who are at-risk, as defined by federal poverty levels up to 150%. Preschool children eligible for special education must have an Individual Education Plan (IEP) instead of a 504 plan to receive State-Funded Preschool program services.
The Corbin Independent, Whitley County & Williamsburg Independent School District has an ongoing “Child Find” system, which is designed to locate, identify and evaluate any child residing in a home, facility, or residence within its geographical boundaries, age three (3) to twenty-one (21) years, who may have a disability and be in need of Special Education or 504 services. This includes children who are not in school; those who are in public, private, or home school; those who are highly mobile such as children who are migrant or homeless; and those who are advancing from grade to grade, who may need but are not receiving Special Education or 504 services.
The district’s “Child Find” system includes children with disabilities attending private or home schools within the school district boundaries who may need special education services.
The Corbin Independent, Whitley County & Williamsburg Independent School District will make sure any child enrolled in its district who qualifies for Special Education or 504 services, regardless of how severe the disability, is provided appropriate Special Education or 504 services at no cost to the parents of the child.
Parents, relatives, public and private agency employees, and concerned citizens are urged to help the Corbin Independent, Whitley County & Williamsburg Independent School District find any child who may have a disability and need Special Education or 504 services. The District needs to know the name and age, or date of birth of the child; the name, address, and phone number(s) of the parents or guardian; the possible disability; and other information to determine if Special Education or 504 services are needed.
Letters and phone calls are some of the ways the Corbin Independent, Whitley County & Williamsburg Independent School District collects the information needed. The information the school District collects will be used to contact the parents of the child and find out if the child needs to be evaluated or referred for Special Education or 504 services.

All taxes or assessments upon the property for the current year and all prior years shall be paid from the sale proceeds if properly claimed in writing and filed of record by the purchaser prior to payment of the purchase price.
5. The property shall be sold subject to the following:
a. Easements, restrictions and stipulations of record;
b. Assessments for public improvements levied against the following real estate;
c. Any facts which an inspection and accurate survey of the following described real estate may disclose.
6. If the property does not bring two-thirds of its appraised value, a six (6) month right of redemption will exist pursuant to KRS 426.530 (revised July 15, 2014).
7. This property is sold subject to the right of redemption, if applicable, provided in 28 USCA Sec. 2410.
