NOTICE OF ADOPTION OF ORDINANCE
The Fiscal Court of the County of Whitley, Kentucky, at a meeting held on September 21, 2010, adopted the following ordinance:
AN ORDINANCE APPROVING A LEASE FOR THE FINANCING OF A PROJECT; PROVIDING FOR THE PAYMENT AND SECURITY OF THE LEASE; CREATING A SINKING FUND; AUTHORIZING THE EXECUTION OF VARIOUS DOCUMENTS RELATED TO SUCH LEASE; AND MAKING CERTAIN DESIGNATIONS REGARDING SUCH LEASE.
It is hereby certified that the foregoing ordinance provides for approval of a lease with Kentucky Association of Counties Leasing Trust, as administrator, and bank or financial institution offering the lowest and best interest rate, as lessor for financing certain public improvements and provides a general obligation pledge to assess sufficient taxes to comply with the obligations to pay lease payments. The full text of the section relating to the pledge to levy and assess a tax to pay the lease obligation is:
Section 2. General Obligation Pledge Pursuant to the Constitution of the Commonwealth and Chapter 66 of the Kentucky Revised Statutes, as amended (the “General Obligation Statutes”), the obligation of the Lessee created by the Lease shall be a full general obligation of the Lessee and, for the prompt payment of the Lease Payments, the full faith, credit and revenue of the Lessee are hereby pledged. During the period the Lease is outstanding, there shall be and there hereby is levied on all the taxable property in the Lessee, in addition to all other taxes, without limitation as to rate, a direct tax annually in an amount sufficient to pay the Lease Payments on the Lease when and as due, it being hereby found and determined that current tax rates are within all applicable limitations. Said tax shall be and is hereby ordered computed, certified, levied and extended upon the tax duplicate and collected by the same officers in the same manner and at the same time that taxes for general purposes for each of said years are certified, extended and collected. Said tax shall be placed before and in preference to all other items and for the full amount thereof, provided, however, that in each year to the extent that the other taxes of the Lessee are available for the payment of the Lease Payments and are appropriated for such purpose, the amount of such direct tax upon all of the taxable property in the Lessee shall be reduced by the amount of such other taxes so available and appropriated.
There is hereby established, or it is acknowledged that there has heretofore been established, with the Lessee a sinking fund (the “Sinking Fund”). The funds derived from said tax levy hereby required or other available taxes shall be placed in the Sinking Fund and, together with interest collected on the same, are irrevocably pledged for the payment of all obligations issued under the General Obligation Statutes and all Tax Supported Leases, as defined in the General Obligation Statutes, including the Lease herein authorized, when and as the same fall due. Amounts shall be transferred from the Sinking Fund to the Lessor at the times and in the amounts required by the Lease.

Be it ordained by the City Council of the City of Williamsburg, Kentucky that the 2010 tax rate for Real Property shall be .2500 cents per $100 valuation, Personal Property including automobiles shall be .3586 cents per $100 dollar valuation.
Any City Property Taxes unpaid as of January 1, 2011 shall be assessed a penalty of Ten (10) percent, as well as interest at the rate of six (6) percent until paid.

NOTICE OF COMMISSIONER’S SALE
Pursuant to Judgment and Order of Sale entered by the Whitley Circuit Court on August 9, 2010, I shall offer for sale at the Courthouse door in Williamsburg, Kentucky, at public action on Monday, October 4, 2010 at 12:00 p.m., or thereabout, the real property described in this Notice.
The judgment against the defendants, Jerry Wayne Hart, plus costs, are as follows:
(1) The principal sum in the amount of $46,426.72 with interest continuing to accrue at the rate of 6.250% from and after July 26, 2010, until paid in full; plus any late charges, advances for taxes and insurance, and its costs herein expended, including a reasonable attorney fee and for other fees expended for services performed in connection with Defendant’s default and for the purposes of protecting Plaintiff’s interest in the property and its rights under the Mortgage instrument.
The said real property is located in Whitley County, Kentucky and is more specifically described as follows:
LOCATED AND BEING IN WHITLEY COUNTY, KENTUCKY AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING at the point where the north edge of a driveway belonging to Sonny Hart, Sr. intersects the right of way of 23rd Street; thence with 23rd Street in a northerly direction a distance of 300 feet, thence in an easterly direction parallel with the Sonny Hart, Sr. driveway a distance of 240 feet; thence in a southerly direction parallel with 23rd Street a distance of 300 feet; thence in a westerly direction a distance of 240 feet to the point of beginning.
Being the same real property conveyed to Sonny Hart and wife, Wanda Hart, by deed from Kenneth Robert Hart et al, dated June 27, 1997, of record in Deed Book No. 393, Page 505. Also see deed from Marie Hart to Sonny Hart and wife, Wanda Hart, dated March 27, 1997, of record in Deed Book No. 391, Page 457. TERMS OF SALE
1. The above property is indivisible and shall be sold as a whole to produce the sum of money so ordered to be made.
2. On the date of sale, the purchaser shall either pay cash or, with surety on a bond approved by the Commissioner, may pay 10% down of the purchase price together with a bond (for the remainder of the purchase price) with good and sufficient surety, bearing interest from the day of the sale and payable to the Master Commissioner within 60 days with interest at 12%. Signatures of principal and surety on the bond shall have the effect of a Judgment.
3. The risk of loss for the subject property shall pass to the purchaser on the date of sale. Possession of the premises shall pass to the purchaser upon payment of the purchase price and delivery of deed.
4. The purchaser shall be required to assume and pay all taxes or assessments upon the property for the current tax year and all subsequent years. All taxes or assessments upon the property for prior years shall be paid from the sale proceeds if properly claimed in writing and filed of record by the purchaser prior to payment of the purchase price.
5. The property shall be sold subject to the following:
a. Easements, restrictions and stipulations of record;
b. Assessments for public improvements levied against the following real estate;
c. Any facts which an inspection and accurate survey of the following described real estate may disclose.
6. If the property does not bring two-thirds of its appraised value, a one year right of redemption will exist pursuant to KRS 426.530.
