ONLY ONLINE: Corbin man says CUC to blame for sewer backup that damaged his home
A Corbin resident is suing the town’s utility company claiming that negligence on their part led to a sewer backup this past May that flooded and damaged his home.
Bill Breeding, a resident of Chestnut Street, filed the lawsuit in Whitley Circuit Court on June 11 through his attorney, David O. Smith.
In the complaint, Smith writes that the City Utilities Commission "failed to maintain its sewer system, sewer lines and manholes on or near Chestnut Street," which led to sewer backing up in the Breeding’s basement. Breeding claims the damage from the backup cost him in excess of $14,130.
"CUC acknowledged the manholes and sewer were not working or working improperly and clogged and that it had not cleaned this area of the system since 2009."
Breeding hired a professional cleaning service to clean up the damage caused by the backup.
CUC General Manager Ron Herd would not comment on the specifics of the lawsuit, but did say the sewer line had become clogged by a "plastic bag," causing the backup.
CUC has not filed any formal response to the lawsuit.
Breeding it asking for a judgment awarding him the compensation for the cost of cleanup.

It just so happens that D.O. Smith owns most of the chestnut street rentals and a lot more in the Gordon hill area and Corbin city limits. He always has his nose in other peoples business and thinks he is above the law. I know of a person who threatened him with arrest for entering a rental property illegally because the guy was 10 days late on his rent. He took it upon himself to change the locks and held the personal property as hostage until the man paid his rent. But D.O. soon found out that an arrest warrant was about to be issued by Judge Burton and changed his attitude very quickly. I am glad someone is finally holding CUC gestapo accountable, they violate the law as they please and dare you to challenge them.
