NOTICE OF COMMISSIONER’S SALE
Pursuant to Judgment and Order of Sale entered by the Whitley Circuit Court on May 7, 2012, I shall offer for sale at the door of the Whitley County Judicial Center, (new courthouse), 100 Main Street, Williamsburg, Kentucky, at public auction on Monday, July 9, 2012 at 12:00 p.m., or thereabout, the real property described in this Notice.
The judgment against the Defendant, Chester Wilder, plus costs, is as follows:
(1) The principal sum in the amount of $35,725.30, plus interest at the rate of 7.250% per annum from August 1, 2011 until May 7, 2012, plus accrued late charges in the amount of $38.46, with interest accruing on the entire balance at the Note rate until paid, and its reasonable attorneys fees and court costs herein expended.
The said real property is located in Whitley County, Kentucky and is more specifically described as follows:
Property Address: 28 Charlie Bunch Road, Williamsburg, Whitley County, Kentucky 40769.
Beginning at the southwest intersection corner of old Highway 26 and the Charlie Bunch Road; thence leaving Old Highway 26 and running tangent with the north right of way of the Charlie Bunch Road, S 84-14-22 W, 112.56 feet to a point; thence continuing tangent with the north right of way of the Charlie Bunch Road S 82-02-17 W, 22.00 feet to a point; thence continuing tangent with the north right of way of the Charlie Bunch Road S 67-51-09 W, 19.35 feet to a point; thence continuing tangent with the north right of way of the Charlie Bunch Road S 58-41-48 W, 60.10 feet to a rebar, which has been agreed to by Lula Bell Petrey, currently the owner of Eddie and Jennifer West parcel (DB 344, Page 563 and Chester Wilder; thence leaving Charlie Bunch Road and running with the agreement line N 36-45-32 W, 32.74 feet to an 18 inch oak tree bearing N 22-15-53 E, 35.45 feet from a utility pole; thence continuing with the agreement line N 12-45-24 E, 111.60 feet to a utility pole; thence continuing with the agreement line N 12-45-24 E, 69.84 feet to a point in the center of Blakes Fork of Browns Creek; thence running with Blakes Fork S 72-33-12 E, 51.93 feet; S 52-12-00 E, 95.07 feet and S 69-35-21 E 51.15 feet to a point which bears S 26-27-40 W, 16.93 feet and N 45-57-05 W,16.95 feet from the west ends of a concrete bridge over Blakes Fork; thence leaving Blakes Fork and running approximately tangent with Old Highway 26 S 09-44-42 E, 59.67 feet to the point of beginning and containing 0.57 acre.
Being the same property conveyed to Chester Wilder and Carolyn Wilder, husband and wife by Deed of Joint Survivorship dated December 17, 1996 of record in Deed Book 390, Page 116 in the Office of the Clerk of Whitley County, Kentucky. Said Carolyn Wilder having died on February 26, 1998 therefore vesting the property to Chester Wilder, in fee simple.
TERMS OF SALE
1. The above property is indivisible and shall be sold as a whole to produce the sum of money so ordered to be made.
2. On the date of sale, the purchaser shall either pay cash or, with surety on a bond approved by the Commissioner, may pay ten-percent (10%) down of the purchase price together with a bond (for the remainder of the purchase price) with good and sufficient surety, bearing interest from the day of the sale and payable to the Master Commissioner within ninety (90) days with interest at 12%. Signatures of principal and surety on the bond shall have the effect of a Judgment. In the event the Plaintiff or its representative is the purchaser, no payment shall be required and no bond shall be executed by them.
3. The risk of loss for the subject property shall pass to the purchaser on the date of sale. Possession of the premises shall pass to the purchaser upon payment of the purchase price and delivery of deed.
4. The purchaser shall be required to assume and pay all taxes or assessments upon the property for the current tax year and all subsequent years. All taxes or assessments upon the property for prior years shall be paid from the sale proceeds if properly claimed in writing and filed of record by the purchaser prior to payment of the purchase price.
5. The property shall be sold subject to the following:
a. Easements, restrictions and stipulations of record;
b. Assessments for public improvements levied against the following real estate;
c. Any facts which an inspection and accurate survey of the following described real estate may disclose.
6. If the property does not bring two-thirds of its appraised value, a one year right of redemption will exist pursuant to KRS 426.530.
7. This property is sold subject to the right of redemption, if applicable, provided in 28 USCA Sec. 2410.

The judgment against the Defendant, Rosetta C. Storms, plus costs and fees, is as follows:
1. The principal sum in the amount of $66,933.48, plus interest in and at the rate of 12% per annum from May 7, 2012, until paid in full, plus all costs and attorney fees expended herein.
The property to be sold is as follows:
LOCATED in Whitley County, Kentucky:
Property Address: 109 Ted Ball Road, Williamsburg, KY 40769.
BEGINNING at a stone 350 feet South to a stone on the Gold Bug Road; thence 142 feet westward to a stone; thence back 350 feet North to an oak tree; thence 297 feet eastward to the BEGINNING.
Being the same land acquired by Hoyl Wayne Storms by deed from Joe Singleton, et ux, dated December 13, 2007, and recorded in Deed Book 481, Page 197, Whitley County Clerk’s Office.
