 NOTICE OF INTENTION TO MINE

Pursuant to Application 918-0458

In accordance with the provisions of KRS 350.055, notice is hereby given that Mountainside Coal Company, Inc., 7692 South Highway 25W, Williamsburg, KY 40769, has applied for a permit for a surface and auger coal mining operation located approximately two miles west of the community of Jellico Creek in Whitley County. The proposed operation will disturb 229.0 surface acres and underlie an additional 57.2 acres.  The total area within the permit boundary will be 286.2 acres.

The proposed operation is approximately 0.04 mile northeast of KY Route 92’s junction with Newman Campbell Road and 0.1 mile south of Pleasant Run of Jellico Creek.

The proposed operation is located on the Hollyhill U.S.G.S. 7 ½ minute quadrangle map.  The operation will use the contour and auger methods of surface mining. The surface area is owned by Glenn & Marlene Hamblin, Pearl Davis, Irvin Scharfenberger, John & Deborah Gifford, Thomas & Inez Troxel, Paul & Delores Rowe, Keith Rowe, White Lumber Sales, LLC., Matthew & Ashley Ratliff, Clifford & Martha Partin, and Whitley County, Kentucky.  The operation will affect an area within 100 feet of Ball Branch Road.  The operation will involve closure of sections of this public road for a period of five years.

This is the final advertisement of this permit application. All comments, objections or requests for a permit conference must be received within thirty (30) days of today’s date. The application has been filed for public inspection at the Division of Mine Reclamation and Enforcement’s Middlesboro Regional Office, 1804 E. Cumberland Ave., Middlesboro, Kentucky 40965.  Written comments, objections or requests for a permit conference must be filed with the Director of the Division of Mine Permits, #2 Hudson Hollow Complex, U.S. 127 South, Frankfort, Kentucky 40601.

NOTICE OF PUBLIC HEARING?

The Public Service Commission of Kentucky issued an order on August 8, 2013, scheduling a hearing to be held on October 16, 2013, at 10:00 a.m., Eastern Daylight Time, in Hearing Room 1 of the Commission’s offices located at 211 Sower Boulevard in Frankfort, Kentucky, for the purpose of cross-examining witnesses in Case No. 2013-00263, which is An Examination of the Application of the Fuel Adjustment Clause of Kentucky Utilities Company from November 1, 2012 through April 30, 2013.
