There is currently a sign on the door to the main entrance of Veterans of Foreign Wars Post 3167 that reads, &#8220;we will be closed until further notice.&#8221; The VFW Post is located just outside the Williamsburg city limits between Three-Point and Goldbug. On April 19, the Estate of Richard Perkins sued VFW Post 3167 and Adam David Childress in Whitley Circuit Court for wrongful death. Childress, 31, is charged with murder, driving while under the influence and leaving the scene of an accident in connection with Perkins&#8217; April 13 death. Childress allegedly drove up on the sidewalk where he traveled for about 150 feet before running over Perkins, 53, and then left the scene of the accident. About 10 minutes later, Childress allegedly wrecked again on Ky. 92E. Prior to the crash, Childress had allegedly been drinking at VFW Post 3167. &#8220;VFW members, agents and\/or employees recklessly and negligently sold and served alcoholic beverages to Defendant Childress,&#8221; Williamsburg attorney B.J. Foley wrote in the lawsuit. &#8220;Said alcoholic beverages were knowingly provided to Childress in spite of his visible intoxication; or when a reasonable person under the same or similar circumstances should have known that Childress was intoxicated.&#8221; Williamsburg is &#8220;moist&#8221; allowing alcohol by the drink sales at restaurants that seat at least 100 people, and Corbin is &#8220;wet&#8221; allowing packaged alcohol sales and by the drink sales at restaurants that seat at least 50 people. However, VFW Post 3167 is located outside the Williamsburg city limits in the county, which remains &#8220;dry&#8221; with no legal alcohol sales allowed. Police investigation Williamsburg Police Chief Wayne Bird, whose department is investigating the Perkins&#8217; murder case, said that he was briefly investigating the VFW Post for illegal alcohol sales in light of the incident until it closed. Bird said that on April 18 he obtained a grand jury subpoena for video surveillance footage from the post after learning that the post had cameras inside. &#8220;They did the right thing. By the time I got there later that evening with the grand jury subpoena for the video, they had a sign on the door. The commander out there told me they shut down,&#8221; Bird said. He said that so far the post has been &#8220;very cooperative&#8221; with the investigation. Bird said that he plans to reopen the investigation into alcohol sales if the VFW Post reopens in the future. &#8220;It is something that had gotten out of control. This particular incident has shed a lot of light on it,&#8221; Bird noted. Whitley County Sheriff Colan Harrell said Tuesday morning that his department had not opened any kind of investigation into illegal alcohol sales at the post in light of the case. In regards to whether his department planned to open up an investigation, Harrell said, &#8220;if we need to, we will.&#8221; Kentucky State Police Trooper Lloyd Cochran, public affairs officer at Post 11 in London, said in an e-mail Tuesday afternoon that state police weren&#8217;t currently familiar with the Childress&#8217; investigation. &#8220;If Williamsburg P.D. opens an investigation we would be more than willing to assist if they request it,&#8221; Cochran added. So far no response has been filed to the lawsuit by either Childress or the VFW. A message was left on the answering machine at the VFW post Tuesday morning seeking comment on the situation, but as of press time Tuesday evening the call had not been returned. Alcohol vote Williamsburg Mayor Roddy Harrison admits that he doesn&#8217;t know what impact Perkins&#8217; death will have on Williamsburg&#8217;s June 28 vote to expand alcohol sales. &#8220;That bothered me a lot. Do I think it will hurt the election? I can&#8217;t really say but I hated that it happened,&#8221; Harrison said. Harrison, who knew both Perkins and Childress, said that when he thinks about the incident, he keeps coming back to one question. If Childress had been drinking at a licensed establishment where the bartenders, waitresses and waiters had Server Training in Alcohol Regulations (S.T.A.R.), would this incident have happened? &#8220;They would have cut him off. The thing about being regulated is they will cut you off because if they don&#8217;t they are going to get fined,&#8221; Harrison said."}
