BE IT ORDAINED by the City Council of The City of Williamsburg, Kentucky as follows: SECTION I: Ordinance #003-005 is hereby repealed. SECTION II: Beginning with the bills dated July 1, 2011 the following garbage rates shall apply: A. Residential A &#8211; $14.00 per month-collection once a week, curb side. B. Residential B &#8211;&nbsp; Where the head of a household is 65 years of age or older and the total income of the couple is $7,200.00 or less per year, the charge shall be $11.00 per month. The Superintendent of Sanitation, in consultation with the City Administrator or Mayor, shall have the authority to adjust the above rates above the base rates, where there is a factor in the collection process. The rates shall be based on average time used in the pick up of the garbage. Section 3: No garbage shall be picked up when not in a container furnished by the City or special pick-up approved by the Superintendent of Sanitation, City Administrator or Mayor. SECTION 4: All grocery stores and restaurants shall be required to have a dumpster or dumpsters. The Superintendent of Sanitation shall determine the number of dumpsters and pick ups each customer shall have to adequately serve the place of business. SECTION 5: All garbage customers that do not utilize dumpsters, must have garbage containers furnished by the City of Williamsburg. SECTION 6: Within the City limits of Williamsburg. City of Williamsburg shall collect and dispose of all garbage, trash, waste and no other person or entity shall be permitted to collect and dispose of garbage, trash or waste within the City of Williamsburg except those that might contract directly with the City of Williamsburg. SECTION 7: No person and\/or entity other than the City of Williamsburg, Kentucky and its employee or contractors shall enter into a dumpster, compactor and\/or roll-off unit for any purpose. SECTION 8: No person and\/or entity shall place, cause to be placed or permit, within the City limits garbage, waste, or trash originating outside the City of collection by the City or for any other purpose. SECTION 9: Any and all violations of this Ordinance shall be considered a Class A Misdemeanor and shall be punishable by a fine of no more than $500.00 and\/or imprisonment or not more that twelve (12) months, or both. The Whitley District Court shall have jurisdiction in the enforcement for any and all violations of this Ordinance. SECTION 10: All Ordinance or sections of Ordinances in conflict with this Ordinance are hereby repealed. This Ordinance shall take effect after its passage and upon publication.
