Thirty-four-year-old Burley “B.J.” Foley, who had been arrested May 31 following a traffic stop in London, pleaded guilty to one count of operating a motor vehicle under the influence of alcohol/drugs – first offense. In return for the guilty plea, which was entered June 30, Laurel District Court Judge John Chappell ordered Foley to pay $739 in fines and court costs. Foley’s driver’s license was suspended for 30 days. Under the terms of the plea agreement, the suspension was made retroactive to the date of arrest. “From the very onset of the incident, I took full responsibility,” Foley said in an e-mail response to The News Journal. “Inherent in taking responsibility is admitting guilt. I look forward to putting this behind me.” Laurel County Sheriff’s Deputy Brian Lawson stopped Foley just before 5 a.m. in the London Shopping Center on Ky. 192 after reportedly observing his vehicle change lanes on the 192 bypass without giving a turn signal, according to the arrest citation. “A strong odor of an alcoholic beverage was coming from this individual while I was talking to him,” Lawson wrote on the citation. Foley was given three standard field sobriety tests, and passed two of the three, according to his arrest citation. He passed the finger dexterity test and the alphabet test, but failed the walk and turn test by taking too many steps and not walking heel to toe as instructed, Lawson wrote on the citation. Foley was allegedly very unsteady on his feet and refused to take a portable breath test, the citation stated. Foley was arrested and lodged in the Laurel County Detention Center."}
